Manila, Philippines Already staggered by the freezing of his bank deposits, world boxing sensation and Sarangani Rep. Emmanuel Manny Pacquiao may yet face another blow after the Bureau of Internal Revenue (BIR) hinted yesterday at filing tax evasion charges against him for alleged misdeclaration of his income. Even if he declared his income in US in 2009, may kaso pa rin siya. I have not filed a tax evasion case against him. I am just collecting [taxes], BIR Commissioner Kim Jacinto Henares said yesterday in a press conference. The BIR confirmed that it is now weighing its options on whether to file criminal charges against Pacquiao, especially since the boxing Kim Jacinto Henares champion has failed and continues to ignore the agencys request for him to submit his US Internal Revenue Service (IRS) records during the past several years. BIR Deputy Commissioner Estella Sales said in that same press conference that the BIR is studying the filing of [tax evasion] case. Stop Media War President Benigno S. Aquino III, dismayed by Pacquiaos cavalier attitude against the BIR, called on the boxing hero to stop engaging in media war and just address his tax obligations before the court. Aquino also denied that the government was harassing Pacquiao over his P2.2-billion tax case and instead unleashed a flurry of criticisms against the lawmaker. Bakit siya iha-harass? Saan ang logic non? Aquino asked in a press conference in his visit to Bohol. (Why would we harass him? Where is the logic there?) Court Will Decide If he did right, then Im sure he will be able to prove that he did right, and therefore there is no issue. media war, added Aquino, who was among throngs of Filipinos who watched Pacquiaos recent victory in Macau. The President told Pacquiao that the media will not decide who is right or wrong. It will be our courts eventually, if it gets to that, who will decide, he added. In the BIR press conference, Henares said that the tax agency has given Pacquiao much leeway to comply with their requirements. She, however, declined to elaborate on BIRs future actions in connection with Pacquiaos tax woes. We have given him as much leeway as we can. I dont want to talk about what could happen in the future. As far as Im concerned, we are just collecting taxes, please pay us so we dont have to go to the next decision point, she added. P1.5 B Gross Income In 2008 BIR records show that Pacquiao pocketed a P1.5 billion gross income in 2008 from his fights abroad, his share in income from pay-per-view cable services that aired his fights, and his endorsements of various brands. Documents from the BIR showed Pacquiao was the countrys top individual taxpayer in 2008 with a tax due of P125.063 million. P340 M 2008 Income Tax On a 32-percent income tax rate, the boxer was obligated to pay P340 million in income tax to the BIR, on top of the P120 million he remitted to the US government. The BIR, however, said that the boxing sensation failed to pay the P340 million. Under the Tax Code, he said, the BIR shall impose surcharge and interest on unpaid tax liabilities. In Pacquiaos case, the BIR imposed a 50-percent surcharge, or P170 million, on basic income tax liability and a cumulative interest of P250 million for the four years that the boxer failed to pay the liability. P760 M 2008 Unpaid Taxes Ortiz said the BIR imposed the 50-percent surcharge as it believed that fraud was involved because of deliberate withholding of some of his earnings. As a result, Pacquiaos total unpaid tax liabilities amounted to P760 million. P2 B Gross Income in 2009 For 2009, Pacquiaos gross income was placed higher at about P2 billion, based on which the BIR is running after P688 million in basic income tax liability. Pacquiao, however, only declared P7,410,221 as his income in 2009. Worse, the eight-division champ, however, did not report any income tax payment to the US government and as a result, the BIR had nothing to deduct from the income tax liability, he added. P1.4 B Unpaid Taxes In 2009 The BIR, thus, imposed the surcharge of P344 million and the cumulative interest of P373 million for the three years that the liability had remained unpaid. Pacquiaos total unpaid tax liabilities for 2009 including the basic income tax plus the surcharges and interest stand at P1.4 billion and his combined unpaid tax liabilities for 2008 and 2009 amounted to nearly P2.2 billion. Henares said the BIR placed Pacquiao under investigation in late 2010 and early 2011, after the peoples champ dropped out of the top 100 individual taxpayers. US Income Undeclared Ito yung problema ng 2009 ITR (income tax return) niya, wala siyang i-dineklarang American income, i-dineklara lang niya yung Philippine source income at under declared pa, she said in a press briefing. According to Chapter VII, Sec. 34 of the National Internal Revenue Code, a Filipino citizen can avail himself of credit against tax for taxes of foreign countries if the taxpayer signifies in his return his desire to have the benefits.

Mansions, Car Not Included Meanwhile, the BIR said Pacquiaos mansions and flashy cars are not covered by the seizure warrant it issued. Henares said only Pacquiaos bank deposits are the subject of the garnishment relative to the P2.2 billion civil suit filed against him before the Court of Tax Appeals. She was reacting to news reports that the BIR has already attached Pacquiaos real estate properties via a Warrant of Distraint and Levy (WDL). The Warrant of Garnishment (WG) and WDL are administrative legal remedies applied by the BIR to keep the assets of delinquent taxpayers until their tax debts are settled, with the former covering bank accounts and share of stocks and the other referring to real properties. Henares said she will not withdraw the freeze order until Pacquiao presents the original or certified true copy of tax returns he filed with the IRS relative to the cash prizes he received and taxes he paid for his four boxing bouts in 2008 and 2009. Under the bilateral tax treaty agreement between Manila and Washington, Pacquiaos tax payments in the US can be deducted from his income tax return (ITR) filed with the BIR, thus preventing double taxation. BIR insiders said Pacquiaos estimated P2.2-billion deficiency tax assessment might be wiped out if he can prove his claim that he had paid the IRS some P400 million for the two-year period, plus deduction from allowable expenses, including transportation, hotels, and the salary of his staff. My best advice.... iwan mo na ang Pinas Manny. Leave and settle sa U.S na lang....wala kang magagawa sa basurang gobyerno natin. Common sense naman, nagbayad na ang tao ng 30% sa income niya sa U.S, binigay na sila ng resibo..bakit ayaw pang i honor...papatayin ko sarili ko kung si henares eh di hahabol ng senador next election. Pinoy ako pero wala na akong tiwala sa gobyerno natin......kaya umalis na rin ako at sinama ko ng pamilya ko sa abroad kahit mahirap...at least dito di mo ramdam ang politika..... buwisit sila

aha, mabuti sinabi mo na nasa US ka. matanong nga kita. sinubukan mo na bumili ng bahay dyan? alam mo ba na isa sa mga requirements ng bank ay IRS certified ITR na padala mismo ng IRS? kasi hndi pwede ung basta resibo lang ng ITR mo ang ipakita na dokumento. Pag pumasok ka sa university, ganun din ang hihingin sayo, certified transcript mula sa university sa pinas na pinag aralan mo. Pero direct na galing sa university ang dokumento. Pero tama ka siguro tungkol sa politics. mas bulok ang sistema sa pinas kaysa sa US.

Maraming mga successful na Pilipino dito sa U.S. (mga Engineers, doctors, nurses, etc.). . .kaya lang yong iba na ayaw mahirapan sa pagkayod ay siyempre, medyo hindi umunlad at ang iba ay bumalik sa Pilipinas. Sa tinggin ko kahit saang sulok ka man, pulubi ka pa rin kung di ka magsisikap na umunlad, tulad ng mga di nakatapos sa highschool man lamang na bulakbulero habang nagaaral . . .gayon pa man ang mga Pilipino ay balita sa kasipagan. wala pa akong nakitang Pulubi na Pinoy sa lugar namin dito sa Texas.

Pero never nming ipinagkanulo ang bansang mahal namin(Pilipinas). Lahat ng mga banyagang kasama nmin kwento lang nmin ang mga positive na bagay para pumunta sila sa atin at maging turista. sumubok na magtrabaho sa gobyerno taon 1996 (pagkatapos kong magtapos) , pasado ako sa prof civil service at dalawang ahensya ng gobyerno ang aking inaplayan at sabi eh sino raw ba ang kilala kong congressman at governor. kuha raw ako ng reference letter sa kanila at may kasamang pictures nila. Masisi mo ba ako kung pinilit kong mag ibang bansa. ang aking kapatid eh gustong magpatayo ng bahay sa tamang paraan....ang sabi ng munisipyo , aabutin ng 5 buwan bago lumabas ang building permit....pero gusto mo ng mabilisan, bukas din eh 50 tawsand. saan ka makakakita ng tao may driver license pero di marunong magmaneho, only in the philippines...saan ka makakita na mismong pulis , sila ang kurakot sa kalsada....naranasan ko iyan. saan ka makakita na pag may edad ka na eh hirap ka ng mamasukan. Ako po ay mahirap din pero pinilit na makapag abroad dahil alam kong wala akong maiibigay na magandang kinabukasan sa mga anak ko diyan. nakakalungkot isipin na maraming college graduates lalo sa mga province, pag dating sa maynila eh mga cashiers or sales sa mga mall....iyan ba eh tama.

naku, bakit naman sinabi mo ang tunay na nangyayari sa bayan natin. nakakahiya. dapat hindi mo na sinabi na kapag umedad ka ng 30 eh hindi ka na pedeng mamasukan bilang sales lady, kasi hanap nila up to 26 lang. at kapag 45 ka na at nawalan ka ng trabaho, mabuti pang magpakamatay ka na lang, dahil hindi ka na makakakita ng trabaho, dahil maraming bata ang madaling lokohin at paikutin..... at pag kinuha mo ang pension mo sa SSS, ay sasabihin antayin mo maging 61 ka, bago mo pakinabangan. etc etc.

masyado ka namang OA.. 61 daw... kakakuha lang ng pension ng officemate ko nag-retire eh 60 years old lang... bago ka sumampa sa 60 dapat nilalakad mo na ang mga requirements para eksakto 60 may matanggap ka na. eto lang january may natanggap na ang officemate ko 18 months advance na pension.. masyado kang OA.

Based on this info from BIR, against Pacquiao's crying foul and media attack, people may now see who is right or wrong. Obviously, Pacquiao and his camp of trusted accountant and battery of lawyers, including Bob Arum, are remiss in their obligations to document the Pacman's ITR. I see it as a failure on the latter to substantiate his claim for a much lower tax in the Philippines. It also suggests a possible mis- or under-declaration of his 2009 income which is disputed by the BIR. Two years of leeway to explain and document his ITR is long enough for Pacquiao to do, but his accountant and lawyers did not do their job. It's quite easy for him to get a certified true copy of IRS income tax, contrary to his statement that it was not possible to do so. He only pays a small amount and requests IRS to forward the certified copy to BIR. It is quite simple to do, no hassle. Unless Bob Arum and Manny have something to hide that they don't want the public to scrutinize, let alone to alert the IRS that something is also fishy in the IRS Form 1040 NR that he filed. This is always subject to tax audit in the future. Bob Arum's retort that Henares herself, or that a government to government can secure it, is out of tune. This goes against the US law on privacy that does not authorize any entity to do it, unless upon order of the court - which becomes more complicated. Besides, the simple rule is that the burden of proof lies on the person to do the documentation of his/her tax claim, not the collecting agency. Clearly, Pacquiao and Arum are making statements that deflect the real issue. A detailed analysis on this is also found in Randy David's most recent article in the Inquirer. Wish Pacquiao's men will read it and interpret it for him, not as a boxer idolized by millions of Filipinos but as a lawmaker elected by the people who must show obedience to rules. Emotions have no place in this game, which now plays out for Pacquiao's possible political advantage in the wrong direction.

Excellent Bro! You hit the Bullseye!! You are absolutely correct, some Kababayans are letting their emotions alone without getting the real picture and story beyond the show! Then they just bounce back that there was political motives etc. and ask why other rich tax evading tsinoys as Lucio Tan et al is not getting the cudgels without knowing that LUcio Tan has a long standing Civil Cases of Tax Evasion in the court sinse the time of Pres. Ramos.

Very well said! We travel for work too and wherever country we go as expats, we always have our US income and tax records available to the host country. Why would it be different for him? Their statements that US tax records is something that BIR should get from US IRS is ridiculous and undermines the intelligence of anybody who has knowledge of how these things work. That's tantamount to lying in my opinion.

siguro wala namang silang tinago kasi bakit tinuruan pa sila ni bob Arum at Manny kung paano makukuha ang tax record ni Manny sa pag log-on lang sa website ng IRS. Ito rin kasi si Henares at mga tauhan niya masyadung mayabang,sabihin ba naman na hindi raw nila trabaho yon. Kung duda ka sa binigay ni Manny na Tax record bakit di muna lang tingnan sa Website ng IRS,Hindi na kailangan yong certiified thru copy. Kung anong makita doon sa website eyon na yon. Kung sa Pilipinas baka puede ka pang mag-duda baka gawa lang yon sa Recto.

Ok, pero yung sinabi ni Pacquiao at Arum ay hindi pwede gawin. Meron US privacy law na hindi ka basta makapasok sa IRS website at kunin ang ITR ni Pacquiao. Kelangan sya mismo ang mag apply at mg authorize matapos mag fill up ng IRS Form 4056T at magbayad ng $50. Yun ang proceso.

sa palagay niyo ba, kung di tama ang pagbabayad ni manny sa tax due nya sa U.S eh di siya hahabulin. U.S pa eh ang lupit ng IRS magmonitor ng tax payment, may nabalitan na ba kayo ng u.s tax evasion to anyone including american, bihira...dahil kung mali ang declaration mo, mabilis pa sa alas dose eh may sulat ka na galing sa kanila. common, i am ofw too for 12 years, at tax exempt tayo. nakakalungkot, pero mas ginusto ko na dito na lang mamalagi sa ibang bansa kaysa sa PINAS....sa bulok na sistema ng gobyerno..kung may karapatan lang akong ikulong ang mga lintik na iyan eh baka wala ng maiwan na nasa gobyerno......

Naniniwala naman kami na nagbayad sya wala naman question dun kabayan ang isyu lng e nasaan ang pinagbayaran mo ipakita mo sa BIR kailangan lng ung Certtified true copy nung IRS hindi ung resibo na ipinapakita nya sa TV. Simple lng kabayan kung maipapakita nya ung Certified copy tapos ang isyu. all happy. Ang kaso pinalalabas nya na pinag-iinitan sya ng gobyerno andun nako tama ka kabayan bulok ang sistema ng gobyerno pero kung dadagdag pa ang isang Congressman lalu ng mabubulok ang gobyerno natin. 2 years ang ibinigay sayo para e submit ung hinihingi nila pero wala kang ginawa anong gagawin ng BIR pabayaan ka na lng? Di dumagdag ka na naman sa bulok. Hinahangaan natin si Manny bilang isa sa pinaka magaling na Boxer sa buong mundo pero bilang Mambabatas baka pwedeng ibigay mo na lng sa iba. Dun sa mas nakakaintindi sa paggawa ng Batas.

Clear as water Madam Commissioner! Thank you for serving the best interest of the Filipino People!! I admired Manny too much for being a kind hearted, good honest person and a Pilipino Boxing icon. But I deeply pity him so much. He was "cooked on his own lard" and misguided by crooked and leech people that surrounds him, Pilipinos and Americans alike. Tsk! Tsk! Tsk! Poor Manny! Must wake-up before its too late! Must keep and manage the blessings of GOD carefully. Everyday is not Christmas Day!

Why can't the Government get real big fish like the Henry Sy's of BDO and SM, Lucio Tan, Manny Pangilinan. the Lopezes, the Ayala's who pays questionable amount but no one complaint, ? Why Pacman? Or a powerful figure wants to destroy the Pacman? Sometimes the law was being use and utilize as a powerful weapon to destroy a man's credibility by those person in power. Has anybody has a better explanation for this?

That's the point! How much money did he actually make? We don't know until he presents his tax returns from IRS. How hard is that? Everybody who worked in the US has this return, why can't he show it? I think he's hiding something.

Based on the BIR pronouncements, Pacman's subject tax returns appear to be substantially incorrect. Blame it all to a bad advice from his tax lawyer and CPA. These supposed professionals can be on the hook even if Pacman is not convicted. The foreign tax credit for any citizen or resident taxpayer is not covered by any US-RP tax treaty. It is provided for in the RP Internal Revenue Code to prevent double taxation. The foreign income tax paid or its equivalent can either be taken as an itemized deduction or a tax credit. Compute it both ways and see which one produces the most benefit.

Sobra na ang kabulukan nga gobyerno natin, saan ka makakakita ng mga taong may mataas na pinagaralan (senador, congressman, etc) na magnanakaw ng pera ng bayan thru pekeng projects na tinatawag na NGO? Dapat ngang umalis ka na talaga sa Pilipinas. Punta ka U.S. embassy at mag apply para maging immigrant dito. Maganda ang kinabukasan ng mga anak mo kung dito sila magaaral at mahusay ang hospital (with Pilipino doctors and nurses, you will feel at home kahit malayo sa atin).. Punta ka sa Texas, MALAWAK ANG LUPAIN DITO AT MURA PA.. Sabi nila: BIR records show that Pacquiao pocketed a P1.5 billion gross income in 2008 from his fights abroad, his share in income from pay-per-view cable services that aired his fights, and his endorsements of various brands.Bakit di nila habulin ang pocketed PDAF na garapal na nakaw ng mga senador/congressman, etc? MGA UNDECLARED INCOME YAN, KAYA DAPAT REVIEWHIN NILA ANG MAGA INCOME TAX PAPERS NG MGA YAN.

Craven--hesitant or full of it?..It is not surprising because the much maligned agency has at the helm , is the Scrooge-Henares who stole Christmas from the nation .Singularly she sucked all the oxygen from the celebratory mood of the country when Pacquaio won against Rios.

pacquiao is one of them politicians. therefore he is one of them looters. I don't think he understands the gravity of this issue. Everybody (at least the middle and upper classes) pay taxes and you're not an exemption. Ignorance is no excuse. Pay up and shut up and loose the stupid grin.

About 3 years ago I met local Thai MP, who shown me pictures of him and Manny during his visit to Bangkok. He also told me that Manny was desperately looking for "money parking" or "investment" as he had huge amounts of money he didn't want to show back home. As it turns there were no chances to park his millions in Thailand, so his next stop was shady Casinos in Cambodia. Reuters show him in disaster affected provinces in Philippines, smiling and waiving, while he is avoiding to pay taxes which will go to exactly the same people he smiles. What a dirty shame!

Taxpayers like us including Manny should demand the revert of a general lifestyle check of all executive agencies/bureau specially the BIR. Start with Comm. Henares. I am disgruntled with the character and style of this person. Jacinto-Henares has no mandate from a good and judicious number of Filipinos . Her proverbial statement is " ginagawa lang and nasa batas" ? It is not adequate and relatable to make such selfserving and egotistical statement. The point is - TAMA ba ang ginagawa mo na pagpapatupad sa sinasabi mong batas ? You are not the only one who knows Philippine Tax laws and its statutory amalgamates and integral laws. I have been evenhandedly observing both sides in this issue and Henares is off-putting the entire situation. Jacinto-Henares is offensively disgusting the taxpaying public- the very lifeblood- of this government. Rep. Manny must congregate his entire staff at the House to re-visit the Tax laws and the malevolent delegated "right" of the BIR Chair to issue revenue regulations. Even the most develop country viz the mainly underdeveloped ones, do not treat their taxpayers with the Jacinto-Henares hounding and suppressive approach and behaviour .Virtually, there may be no more wiling, - notwistanding , able "bloods" to enliven nor stimiulate this governenment bacause of this disgusting treatment and weighted self-serving , interpertation of the Laws. ang OFW kasi iyong filipino na doon nakatira sa bansa kung saan sya nagwowork, halimbawa 2 years ang contract mo sa dubai don ka nakatira. Si Manny naman dito sya nakatira sa Pinas lumalabas lang siya ng bansa kung saan siya may laban, kaya hindi sya considered na OFW.

The OFW's income tax posture is different from that of Pacman's in that OFW's foreign earned income is exempt from RP taxation under the "Foreign Earned Income Exclusion" from taxes statute. Almost always, there is a limit on the amount of the exclusion. Besides being too rich a sum of money to easily surpass the maximum exclusion, professional boxers' prizes are not deemed earned income for purposes of the Foreign Earned Income Exclusion statute. This is true whether or not the host foreign country imposes income taxes. However, the OFW's incomes other than the foreign-earned is still taxable. The idea is to export unemployment and to raise foreign exchange for RP by providing worker tax incentives. Since foreign earned income is tax exempt, foreign income tax credit doesn't come into play. If Pacman is allowed (for the sake of discussion) to use the "Foreign Earned Income Exclusion", it won't be advisable to do so because the exclusion is limited in amount compared with his gross income plus he can no longer make use of the foreign tax credit. You can't have both.
