Did You Know... that the Susan B. Anthony List (SBA List), a group dedicated to supporting pro-life candidates for public office, appeared before the U.S. Supreme Court this past Tuesday? Attorneys representing the organization argued for the groups right to sue Ohio election officials for violating its First Amendment freedoms. The group is petitioning the high court to allow its First Amendment challenge to Ohios false statement law to go forward. In Ohio, a false statement law puts election officials in charge of deciding what is true in campaign ads and what is false. If the justices agree with SBA List, the case will go back to Ohio and work its way through the system on the First Amendment claims. SBA List has already seen one victory in another case. After the election, the candidate filed a federal defamation lawsuit claiming SBA List contributed to his loss. Last year, the Court ruled in favor of the pro-life group. SBA List has long argued that Obamacare is the largest expansion of abortion since Roe v. Wade. Bruce Hausknecht, legal analyst with Focus on the Family, said the case could affect our rights as citizens to criticize our elected officials. Truth in campaigns includes a lot of gray areas, he said. Youve seen any number of campaign ads in your lifetime that say, This is true about Candidate X, and Candidate X gets on TV and says, Thats absolutely false, dont believe them. It all turns on the interpretation of the facts that theyre both arguing about. The danger in any democracy is having the government, or government bureaucrats, be the decider of what is true and what is false. That is a dangerous situation.
