MARITAL SETTLEMENT AGREEMENT FOR DISSOLUTION OF MARRIAGE WITH MINOR CIDLD We, Andre Fladell and Erica being sworn, certify that the following statements are true: I. We were married to each other on September 23, 2002. 2. Because of irreconcilable differences in our marriage, we have made this agreement to settle once and for all what we owe to each other and what we can expect to receive from each other. Each of us states that we believe the other has been open and honest in writing this agreement. 3. Each of us agrees to execute and exchange any papers that might be needed to complete this agreement, including deeds, title certificates, etc. SECTION L MARITAL ASSETS AND LIABILITIES A. Division of Assets. There are no marital assets. B. Division of Liabilities/Debts. There are no marital liabilities. Each party shall pay his or her own debts. C. Contingent Assets and Liabilities: None. SECTION II. SPOUSAL SUPPORT (ALIMONY) I. HUSBAND agrees to pay lump sum alimony in the amount of$3,000.00 on or before November 1, 2003. SECTION IlL ClllLD CUSTODY, PARENTAL RESPONSIBU.ITY, AND VISITATION 1. The parties, minor child is: Name Birth date Eli Martin Fladell September 4, 2002 2. Parental responsibility for the minor child will be shared. 3. The primary residential parent will be Mother and the other parent will be the secondary residential parent 4. Secondary Residential Responsibility, Visitation, or Time Sharing will be as follows: At any time when Father wants to see the child, he will call the Mother. If it does not conflict with the Mother's work or other obligations, she will bring the child to the Father at a mutually agreed place. The Mother and Father will freely communicate on any issues regarding the child's school, heath, religion and other important matters. 5. Neither parent shall take the child from the custody of the other parent or any child care provider or other person entrusted by the other parent with the care of the child without the agreement of the other party during the other party's time of parental responsibility or visitation. SECTION IV. CHILD SUPPORT 1. Father will pay child support in the amount of $800.00 per month until the child's third birthday. Father will pay child support in the amount of $650.00 per month on and after the child's third birthctay. This parent shall be obligated to pay child support in the amount of $800.00 and $650.00 respectively, as set forth above, every month, beginning November 1, 2003 and .continuing on the first of every month until modified by court order, the youngest child turns 18, becomes emancipated, marries, dies, otherwise becomes self-supporting. 2. ms Income Tax Deduction(s). The Father shall have the benefit of any tax deductions for the child. The other parent will convey any applicable IRS form regarding the income tax deduction. 3. Education: The Father and Mother, both believing that the funding ofthe minor child's education is in the child's best interest, agree that Father shall pay educational funds to the Mother, within six (6) months of the date.hereof, by delivering the following accounts: A An account of at least $15,000.00 in the form of the Florida College Investment Plan. B. An account of$8,240.00 in the form of the Florida Four Year Tuition Plan. They agree that neither will ever withdraw funds from these plans except for the education of the child. The Mother and father believe that this $23,400 payment on behalf of the minor child far exceeds in benefit to the child an additional monthly payxp.ent in regular child support which they would have used for the same purpose but with less benefit. 4. Automobile: Father agrees to purchase for the minor child an automobile at the time he is issued a licence to drive. The make and model will be as agreed upon by the Father and Mother, with the expense anticipated by them to be more than $20,000.00. SECTION V. OTHER: None.
