SUMMONS BY PUBLICATION
WHEREAS, plaintiffs filed a verified complaint for partition of real property
which is quoted as follows:
COMES NOW the plaintiffs unto this Honorable Court must respectfully allege:
1) That plaintiffs, German Pahang, of legal age, Filipino, married and a resident of
M. Parras Street, Tagbilaran City, Maria Visitacion Pahang Bacamante, of legal age,
Filipino, married and a resident of Bool District, Tagbilaran City, Sisinio Pahang
Sarigumba, Victorino Pahang Sarigumba, Maria Rachel Pahang Sarigumba, Proceso
Pahang Sarigumba Jr., all of legal ages, Filipinos, residents of Bool District, Tagbilaran
City, representing their deceased mother Cirila Pahang Sarigumba, Jose Mario Pahang,
Bernardo Pahang, Gemma Pahang, Catalino Pahang Jr., Amalia Pahang, Leonilo Pahang
all of legal ages, Filipinos and residents of Antequera, Bohol, representing their deceased

father Catalino Pahang Sr., who died on November 5, 2000 at Bungahan, Antequera,
Bohol; Exaltacion Pahang Cuajao, of legal age, Filipino, resident of Maligaya,
Malaybalay, Bukidnon, representing her deceased mother Faustina Pahang Cuajao, Elisa
Cuajao, Fortunato Cuajao, Patricio Cuajao, Quirino Cuajao, all of legal ages, Filipinos,
residents of Sta. Cruz, Baclayon, Bohol, representing their deceased father Eulogio
Pahang Cuajao, who died December 22, 1997; Clarita Cuajao Confesor, Avelina Cuajao
Confesor, Elisa Cuajao Confesor, Carlos Cuajao Confesor, Gloria Cuajao Confesor,
Josefina Cuajao Confesor, Minda Cuajao Confesor, Lano Cuajao Confesor, Eufracia
Cuajao Confesor, all of legal ages, Filipinos, residents of Lala, Lanao del Norte,
representing their deceased mother Fermina Pahang Cuajao Confesor, who died on
January 8, 2001;
2) That defendants, Genaro Pahang, Desamparados Pahang Laguitao, Segundina
Pahang Nalan, Aristarta Pahang Salada, Asuncion Pahang Rara, Tita Pahang, heirs of
Balbino Bisol Pahang, who died on November 21, 1982, all of legal ages, Filipinos,
residents of Dimiao, Bohol; Regoberto Pahang, of legal age resident of Espuelas St.
Tagbilaran City, Romana Pahang Ydulzura, Heracleo Pahang, of legal ages, Filipinos,
residents of Bool District, Tagbilaran City, Merlie Pilayre, Leonora Pilayre, Eugenio
Pilayre, Seranio Pilayre Jr., Generoso Pilayre, Franklin Pilayre, Felipe Neri Pilayre, all of
legal ages, Filipinos, residents of Bool District, Tagbilaran City, children of deceased
Felomina Pahang Pilayre, Joseph Pahang, George Pahang, Noel Pahang Estella Pahang,
all of legal ages, Filipinos, residents of Bool District, Tagbilaran City, children of
deceased Urbano Biagcong Pahang, who died December 19, 1989, heirs of Felipe Bisol
Pahang, who died on August 13, 1980, Cirila Pahang Galimba, Pascasio Pahang,
Cornelio Pahang, Teofila Pahang Acabo, all of legal ages, Filipinos residents of Garcia
Hernadez, Bohol, heirs of Aniano Bisol Pahang, who died on January 26, 1999, where
they maybe served with summons;
3) That defendants Genaro Pahang, Desamparados Pahang Laguitao, Segundina
Pahang Nalan, Aristarta Pahang Salada, Asuncion Pahang Rara, Tita Pahang, whose
father Balbino Pahang, who died on November 21, 1982, Regoberto Pahang, Romana
Pahang Ydulzura, Heracleo Pahang, whose father Felipe Bisol Pahang, who died on
August 13, 1980, Cirila Pahang Galemba, Pascasio Pahang, Cornelio Pahang, Teofila
Pahang Acabo, whose father Aniano Bisol Pahang, who died on January 28, 1999 are
first cousins of plaintiffs German Pahang, Maria Visitacion Pahang Bacamante whose
father Antonio Bisol Pahang was the elder brother of defendants Felipe Bisol Pahang ,
Aniano Bisol Pahang and Balbino Bisol Pahang; that the plaintiffs Sisinio Pahang
Sarigumba, Victorino Pahang Sarigumba, Maria Rachel Sarigumba, Proceso Pahang
Sarigumba Jr., whose mother Cirila Pahang Sarigumba died on October 3, 1998 and
plaintiffs Clarita Cuajao Confesor, Avelina Cuajao Confesor, Elisa Cuajao Confesor,
Carlos Cuajao Confesor, Gloria Cuajao Confesor, Josefa Cuajao Confesor, Minda Cuajao
Confesor, Lano Cuajao Confesor, Eufracia Cuajao Confesor , whose mother Fermina
Pahang Confesor who died on January 8, 2001, Eliza Cuajao, Fortunato Cuajao, Patricio
Cuajao, Quirino Cuajao, whose father Eulogio Pahang Cuajao who died on December 22,
1997; Jose Pahang, Bernardo Pahang, Gemma Pahang, Catalino Pahang Jr., Amalia
Pahang, Leonilo Pahang whose father Catalino Pahang Sr., who died on November 5,
2000 are nephews and nieces of the defendants, their fathers Eulogio Pahang Cuajao and
Catalino Pahang Sr., being the first cousins and therefore, all the plaintiffs are relatives
within the first and second degree by consanguinity of the defendants.
4) That during their lifetime, Marcelo Bisol Pahang, who died on January 27, 1934,
without a child, Faustina Bisol Pahang, Antonio Bisol Pahang, Felipe Bisol Pahang,
Aniano Bisol Pahang and Balbino Bisol Pahang, who were brothers and sisters were coowners pro-indiviso of five (5) registered parcel of land, more particularly described as
follows:

improvements thereon, situated in the Barrio of Bool, Municipality of Tagbilaran.
Bounded on the NE. and NW. by Lot No. 1787; on the SE. by Lot No. 1807; and
on the SW. by the provincial road. Beginning at a point marked 1 on plan, being
S.60 deg. 36E., 114.44m. from B.B.M. No. 3; thence N. 56 deg. 41W., 14.49m.
to point 2; thence N.48 deg. 15E., 28.58m. to point 3; thence S.36 deg. 54E.,
14.14m. to point 4; thence S.48 deg. 28W., 2.64m. to the point of beginning,
containing an area of THREE HUNDRED SIXTY SEVEN (367) SQUARE
METERS, more or less. All point referred to are indicated on the plan; bearing
true; declination 1 deg. 37E., date of survey, September 1, 1926 October 30,
1928.
5) That under the Law on Succession, the above-mentioned parcels of land should be
divided among the heirs of BALBINO BISOL PAHANG, FELIPE BISOL PAHANG,
ANIANO BISOL PAHANG, FAUSTINA PAHANG CUAJAO and ANTONIO BISOL
PAHANG, the fact that MARCELO BISOL PAHANG died single and without a child
and died on January 27, 1934;
6) That the above-mentioned parcels of land remained undivided up to the filing of
this complaint despite repeated demands by the plaintiffs who are excluded in equal
rights of ownership by the defendants even after plaintiffs have submitted for amicable
settlement under the Barangay Justice Law, as evidenced by a Certificate to File Action,
hereto attached as Annex A, and made an integral part hereof;
7) That the Extra-judicial Settlement and Sale in favor of Felipe Pahang dated May
27, 1964 by the heirs of Faustina Pahang Cuajao was/is falsified document because the
heirs of Faustina Pahang Cuajao did not sign said document and the Deed of Absolute
Sale by Balbino Pahang in favor of Spouses Oscar Dote and Felipa Pahang was executed
without notifying the other co-heirs of the right of preemption under Article 1088 of the
Civil Code, which document where made as the basis for the partition of OCT No. (1851)
2902 into four (4) lots to the prejudice of the other co-heirs hereto attached as annexes
B and C respectively and made and integral hereof;

8) That because of defendants bad faith, unjustified and illegal refusal with plaintiffs
valid, just and demandable claim, plaintiffs were compelled to engage the services of
counsel in the amount of Twenty Five Thousand (P25,000.00) Pesos and One Thousand
(P1,000.00) Pesos per appearance.
WHEREFORE, premises considered it is most respectfully prayed of this
Honorable Court that judgment be rendered in favor of the plaintiffs:
1) Declaring null and void the Extra-Judicial Settlement and Sale in favor of
FELIPE PAHANG by the heirs of FAUSTINA PAHANG CUAJAO and the Deed of
Sale of BALBINO PAHANG in favor of Spouses OSCAR DOTE and FELIPA
PAHANG and all subsequent sales and partition of OCT No. (1851) 2902 in accordance
therewith;
2) Ordering the partition of the Original Certificate of Title Nos. 1651, 2264, 1385,
2320 and 1675 into five (5) equal parts corresponding to the plaintiffs who are the heirs
of FAUSTINA PAHANG and ANTONIO PAHANG, and defendants who are the heirs
of BALBINO PAHANG, FELIPE PAHANG and ANIANO PAHANG;
3) Ordering the defendants to account all the fruits of said parcel of land, especially
the rentals received by the defendants from the lease of said parcel of land located in
Banat-I Hill;
4) Awarding TWENTY FIVE THOUSAND (P25,000.00) PESOS as Attorneys Fee
and ONE THOUSAND (P1,000.00) PESOS per appearance;
5) For cost; and
6) For such other relief as this Honorable Court may deed just and equitable under
the premises.

two of the plaintiffs in the above-entitled case after having been sworn in accordance to
law, hereby states:
1) That we cause the preparation of the above-entitled case;
2) That we read the contents hereof and are true and correct the best of our personal
knowledge;
3) That we further certify that we have not commenced any other action or
proceeding involving the same issues in any court, tribunal and quasi-judicial

body, if there be such action or proceedings, the plaintiffs will report that fact to
the Honorable Court within five (5) days from knowledge thereof.

WHEREAS, on July 28, 2003, an Order was issued granting the motion to
serve summons by publication in a newspaper of national circulation.
NOW THEREFORE, defendants ZENAIDA CABAILO-ZEBANDAL,
allegedly residing in Leyte, BERNARDO CABAILO and GERARD CABAILO,
both allegedly residing in Metro Manila, are hereby summoned through this
medium of publication and are therefore required to file with the Office of the
Clerk of Court, Regional Trial Court, Branch 3, Tagbilaran City, your responsive
pleading and/or answer to the above-quoted petition, within sixty (60) days from
the date of last publication, serving at the same time a copy of your pleadings to
Atty. MARIANO CAPAYAS, counsel of the plaintiffs, at Tagbilaran City and your
failure to do so within the period prescribed will enable the plaintiffs to take
judgment against you and demand from the Honorable Court the remedies and
reliefs prayed for in the petition.
Let this Summons be published at the expense of the plaintiffs in a
newspaper of national circulation once a week for three (3) consecutive weeks,
furthermore, let a copy of this Summons and complaint be deposited by
registered mail to the last known address of the defendants.
