PROBABLE CAUSE


Defendant.

JAMES S. SCHACHT, declares under penalty of perjury:

That I am a deputy prosecuting attorney for Pierce County and I am familiar with the police
report and/or investigation conducted by the LAKEWOOD POLICE DEPARTMENT, incident number
140400785;

That the police report and/or investigation provided me the following information;

That in Pierce County, Washington, on or about the 9th day of February, 2014, the defendants,
JOSHUA MICHAEL TAMBLIN and ZACHARY DALE HARDIE BRIZILLE, committed ROBBERY
FIRST DEGREE and ASSAULT FOURTH DEGREE as follows:

According to the reports submitted by the Lakewood Police Department the incident took place at
a residence located at 9672 Bridgeport Way SW. Officer Paul Osness reported that he was dispatched to
that area concerning a robbery at gunpoint. He made contact with victim J. Howard. He reported the Mr.
Howard had injuries to his head that had resulted in significant blood loss. He was later treated at an
emergency room for a laceration to the head that required stitches. Officer Osness was able to interview
Mr. Howard while other officers made contact with the residence and detained the two defendants.

Mr. Howard reported that he had been accused of having a relationship with defendant Brazille's
girlfriend. He was called to meet Brazille. He was met and accompanied to the residence. Upon entering
an upstairs area he was assaulted by defendant Brizille. He stated that defendant Brizille hit him
repeatedly in the head and that he lost consciousness. While he was being assaulted others were
displaying what appeared to be a handgun. He also stated that he tried to call 911 on his cell phone and
that the phone was taken from him. Mr. Howard reported that defendant Brazille had a butterfly knife
during the assault. He saw that the defendants had duct tape and feared that he was going to be abducted
and killed. He fled by jumping out a second story window.

The two defendants were detained at the residence. A search warrant was obtained. Among the
items recovered was a knife described as a brass knuckles knife as well as an air soft pistol. The air soft
pistol was manufactured so as to appear to be an actual handgun.

The defendants were advised of their Miranda rights. Defendant Tamblin stated that the
altercation was about the relationship that victim Howard had with defendant Brizille's girlfriend. He
denied being involved. Defendant Brizille claimed that Howard was invited to the residence to consume
alcohol and drugs. He denied assaulting him. He stated the defendant Tamblin had choked Howard in a

martial arts choke hold and that Tamblin had an air soft pistol. Brizille had an injury to his hand that
appeared to be consistent with having him Mr. Howard in the head.
