4. To determine the probable cause of accident of FO1 JOHN CAEZAR C. BARLAAN BFP of Penaranda FS., Penaranda Nueva Ecija. 5. To determine his confinement / hospitalization prior to the incident.
FACTS OF THE CASE
6. That FO1 JOHN CAEZAR C. BARLAAN BFP Personnel was appointed in the Fire Service on December 01 2011. He was presently assigned at the Penaranda Fire Station, Nueva Ecija BFP Region 3 and designated as C,Admin, C,Opn,FSES clerk, PIS clerk DPO and nozzleman (a photocopy of the said designation hereto attached and mark as annex A)
7. That OOA 18 1810H February 2014 subject BFP Personnel Shift B was on his official duty (a photocopy of the said Duty Detail and Log book hereto attached, mark as annex B and C respectively for the month of February) when he was instructed by his immediate superior SFO4 ALLAN B CASTILLO BFP MFM of PENARANDA FS to submit the reports for Administrative Division. The subject BFP personnel, being designated as C,Admin, C,Opn,FSES clerk, PIS clerk DPO and nozzleman which his tasks in the station, submission of monthly reports and responding to fire call were part of his regular tour of duty as Admin officer and personnel on operation. That OOA 18 1341H February 2014 a Fire call was reported by Mr. Magtanggol Abesamis that there was a grass fire at Callos, Penaranda Nueva Ecija. As C, Opn, FO1 JC Barlaan as ordered by SFO4 A.B Castillo,the abovementioned together with FO1 FS De Guzman, FO1 R.G Capala and personnel of Gen.Tinio FS responded to fire call and returned to unit after the fire was controlled and declared fire out. After the fire incident, OOA 18 1810 February 2014 FO1 Barlaan proceeded to the OPFM-NEBFP to submit reports as monthly requirement and as ordered by his Municipal Fire Marshal, that on investigation the aforementioned while travelling towards to Cabanatuan, a dog suddenly crossed the street that stunned him and made him lost his control. Out of invesigation some factors may contribute to the accident. First, that there was no street lights in Brgy.Sinasajan,Penaranda(near the new municipal hall) and fatigue due to the after fire operation incident as stated earlier. That OOA 18 1820 February 2014 FO1 Barlaan called for help thru Cellphone that accident occurred and seek for assistance. That OOA 18 2130H to 0300H admission and operation took placed at Good Samaritan, Cabanatuan City. According to Federico Maralit M.D, the attending physician, a complete fracture of Right Forearm was suffered due to the accident. A major operation called Open Reduction, Internal Fixation (ORIF) was done to FO1 Barlaan. He spent 2nights and 2days in the hospital for observation and medication.
DISCUSSION
8. Based on the investigation, gathered information and medical certificate presented by FO1 JOHN CAEZAR C. BARLAAN BFP of Penaranda FS, it is evident without prejudice that the subject was hospitalized /confined at the Good Samaritan Hospital, Cabanatuan City for (2) four days from February 18 to February 20, 2014 due to the accident he incurred. After the surgical procedure and vigilant immediate monitoring, he was discharged on February 20, 2014 and shouldered the hospital expenses amounting to Sixty thousand three hundred pesos Php P44,696.00. Subsequent follow-up was scheduled for him for therapy and rehabilitation
CONCLUSIONS/FINDINGS
9. THEREFORE, after gathering all the facts and information it is hereby concluded that by FO1 JOHN CAEZAR C. BARLAAN BFP of Penaranda FS had actually incurred his injury in the premises of Penaranda, Nueva Ecija ,while on his way travelling towards the OPFM-NEBFP that due to accident. Subject BFP personnel sustained severe damage in his Right Forearm which caused confinement and subsequent major surgery at the Good Samaritan General Hospital, Cabanatuan City, Nueva Ecija and was institutionalized for two (2) days from February 18 to February 20, 2014 as advised by his attending physician for further medical treatment.
RECOMMENDATION
10. WHEREFORE; premises considered this instant case hereby recommend the herein request of the claimant FO1 JOHN CAEZAR C. BARLAAN BFP of Penaranda FS for his medical reimbursement / refund of his expenses and financial assistance shall be given favorable consideration in as much, that the subject depend only in his meager salary.
