there. Offkers heard a television earning from inside the
apartment,-knocked on. the door, and announced their presence. Officers did not receive an
answer and Sgt. Condon subsequently made entry to the apartment through an unlocked window
after identifying himself and his purpose. Sgt. Condon then unlocked the front door to allow
other officers into the apartment. Officers searched the apartment with negative results and then
exited same. Sgt. Condon attempted to lock the window he entered through but determined he
could not. He then locked the front door and exited the apartment. SgL Condon confmned the
apartment door was locked and then exited the premises.

without her knowledge at any other time.

8. Based on the above information, it is the opinion

apartment. They confirmed the address with neighbor and made observations indicating that
an individual or individuals was located inside. Based on these observations, they entered the
apartment without causing damage to any exterior doors or windmvs. In the opinion of this
officer, the entry to the apartment was clearly 1awiUl and the methods used vvere entirely
reasonable. In addition, the complainant in this matter was activdy her husband avo.id
capture by the same officers she made the complaint on. oi truthful ;;v-ith
investigators throughout the thgitive investigation and this was clearly illustrated when her
husband was captured riding in her vehicle as her passenger. The undersigned theretore
recommends that Sgt. Condon, Tpr. Reis, Tpr. Cinelli, and aU officers involved in this complaint
be exonerated.
