AN ADDITIONAL AMOUNT NOT-TO-EXCEED $25,000 (TOTAL
CONTRACT AMOUNT NOT-TO-EXCEED $270,790) AND A TIME OF
PERFORMANCE EXTENSION FROM JUNE 30, 2004 TO DECEMBER
31, 2004
SUMMARY
A r esolution has been pr epar ed author izing the City Administr ator or her designee to amend the
existing pr ofessional ser vices agr eement with Kimley-H or n and Associates (KH A) to conduct
Aver age Daily Tr affic (ADT) counts and Radar Speed Z one Studies (SZ S) for an additional
amount not-to-exceed $25,000 (total contr act amount not-to-exceed $270,790) and for a time of
per for mance extension fr om June 30, 2004 to December 31, 2004. The or iginal time of
per for mance had pr eviously been extended fr om June 30, 2003 to June 30, 2004.
Additional pr oducts and ser vices not included in the or iginal wor k scope necessitated this
amendment to incr ease the budget and extend the schedule.
The pr oject is consistent with the following Mayor /City Council goals and citywide objectives:
Make Oakland a Safe City by impr oving the per ception of safety.
Impr ove Oakland Neighbor hoods by impr oving tr affic, bicyclist, and pedestr ian safety.
FISCAL IMPACT
The or iginal agr eement had a not-to-exceed contr act amount of $245,790. To date, a total
contr act amount of $240,506 has been expended, leaving a balance of $5,284.
The r equested additional cost of $25,000 is for additional pr oducts and ser vices not included in
the or iginal wor k scope. Below is a br eakdown of the add-on wor k:

The ur gent need to slow down tr affic by way of r adar enfor cement r equir es the expedient
completion of this pr oject; ther efor e, a contingency is included to cover any unanticipated
additional wor k to avoid fur ther delay. Funds ar e available in the following coding blocks:
Tr affic Counts 2002-2003, C159910, Gas Tax Fund (2230), in the amount of $14,863
Speed Sur vey 2002-2003, C160010, Gas Tax Fund (2230), in the amount of $36,030
No gener al funds will be r equir ed for these pr ojects.
BACKGROUND
On May 7, 2002, the City Council appr oved Resolution No. 77109 author izing an agr eement
with KH A to conduct ADT counts and r adar SZ S for a not-to-exceed amount of $245,790. The
time of per for mance was fr om July 1, 2002 to June 30, 2003. The Notice to Pr oceed was issued
late on September 3, 2002. The or iginal wor k scope did not include the cr eation of summar y
maps that cover all 114 str eets in the r adar SZ S. The maps, 182 sheets in total, would ser ve to
summar ize visually the posted speed limits, r ecor ded speeds, accident r ates, and r oadway
conditions for the sur veyed str eets. They pr ovide clar ity to law enfor cement and the tr affic cour t.
By adding the 182 summar y maps and mor e ADT counts, speed studies, and dr aft submittals to
the or iginal scope, the contr act has to be incr eased by $25,000. The time of per for mance, which
was extended fr om June 30, 2003 to June 30, 2004, has to be extended to December 31, 2004.
KEY ISSUES AND IMPACTS
The Califor nia Vehicle Code (CVC) r equir es that str eets on which r adar is used to enfor ce speed
limits need a r adar SZ S no mor e than ten year s old. Out of the 114 str eet segments in Oakland
wher e r adar is used to enfor ce speed limits, 59 have expir ed SZ S, and the r emaining 55 have SZ S
that will expir e within thr ee year s. Without updated SZ S, the police cannot legally use r adar ,
which is the most effective way of speed limit enfor cement.
SUSTAINABLE OPPORTUNITIES
Economic: Updated SZ S will enhance speed limit enfor cement and incr ease citations.
Envir onmental: None.

ability to enfor ce speeding will impr ove the livability of communities impacted by this pr oblem.
DISABILITY AND SENIOR CITIZ EN ACCESS
Not applicable.
RECOMMENDATION AND RATIONALE
Staff r ecommends that the existing agr eement be amended to incr ease the contr act cost for an
amount not-to-exceed $25,000, and to extend the time of per for mance to December 31, 2004.

Staff r ecommends that Council appr ove the r esolution.

necessitated an incr ease in the budget and a second extension of the schedule; and
WH EREAS, the additional pr oducts and ser vices wi ll benefit law enfor cement and the
tr affic cour t in the r adar enfor cement of speed limits; and
WH EREAS, the City Council finds that the pr oducts and ser vices pr ovided pur suant to the
agr eement author ized her eunder ar e of a pr ofessional, scientific or technical natur e and ar e
tempor ar y in natur e; and
WH EREAS, Council finds that this contr act shall not r esult in the loss of employment or
salar y by any per son having per manent status in the competitive ser vice; now, ther efor e, be it
RESOLVED: That the City Administr ator , or her designee, is her eby author ized to amend
the agr eement with KH A to conduct ADT counts and r adar SZ S for an amount not-to-exceed
$25,000 (for a total contr act amount not-to-exceed $270,790) and a time of per for mance
extension fr om June 30, 2004 to December 31, 2004; and be it
FURTH ER RESOLVED: That the City Administr ator , or her designee, is her eby
author ized to appr ove any subsequent amendments to or extensions of said agr eement with the
exception of those r elated to an incr ease in the total dollar amount of the agr eement, pr ovided
