@6A The )oard of .ppeal shall hear appeals arising out of the following matters against the orders
of the authority or )uilding officer except land development permits I'
@aA conditions, if any, attached to the grant of building permissionG
@bA the grounds on which building permission has been refusedG
@cA suitability of alternative material or design or constuction of buildingG
@dA the matters related with building controls.
The appeals pertaining to land development permits shall be heard by appellate authority as
prescribed under Section /! of the .ct.
@/A The )oard shall ma0e regulations for conducting its investigations and lay down its own
procedure which, as far as may be, shall be consistent with principles of natural ,ustice for hearing
appeals and shall render all decisions and findings in writing to the )uilding +fficer and furnish a copy
of appellate decision to the appellant and may order such modification as if may deem necessary.
@7A The owner or engineer&.rchitect signing the plans out of which the appeal arises shall appeal
to the )oard, within thirty days from the grant or refusal of the permission, as the case may be. The
appeal shall be decided as far as, may be, within sixty days of the receipt of the appeal.
PART III PERMISSION AND INSPECTION
!7. Permission for 4evelopment or for Construction.
@!A 4evelopment or construction not to be without permission. -o person shall carry out any
development or erect, re'erect or ma0e alterations or demolish any building or cause the same to be
done without obtaining a prior permission in writing in this regard from the .uthority.
Provided that no permission shall be required for I'
@iA Such alteration under below mentioned heads in a building, as do not otherwise violate
any provisions regarding general building requirements, structural stability and fire safety
requirements of these rules,'

use of land for the other purpose or occasions, not involving permanent diversion or
diversion for substantial periodG

approval given order passed or any action ta0en or anything done in respect of the matters covered
by these rules under any law or rule in force immediately before the commencement of these rules
shall be governed in accordance with the provisions of law or rule under which such sanction or
approval was given, order was passed or any action was ta0en or anything was done, as if these rules
have not come into forceI
Provided that at the time of application for renewal of such building permit the wor0 had not
started fresh sanction under these rules shall be granted.
A//('20&'$, +$% /)%>'--'$, +$% D)=)($/>),& $% +$% B5'(9',8" .pplication for permission, for
development or for building. 3very person who intends to develop, erect, re'erect or ma0e alterations
in any place in a building shall give notice in writing to the .uthority of his intention in the form given in
appendix L.L and such notice shall be accompanied by plans and statements in quadruplicate. The
plans may be in ordinary prints on farro paper or any other type. +ne set of such plans shall be cloth
mounted which shall be retained in the office of the .uthority for record after the issue of permit or a
refusal. The application shall be accompanied by documents, if any, showing proof of ownership or of
any legal right in relation to the site.
The application shall also be accompanied by a certificate duly singed by Structural
3ngineer&.rchitect of the building ensuring all the provisions of rule $7 @for 3arthqua0e prone areas A
of this -iyam.
AA1@ A" n addition to the provisions contained in rule !9, for earthqua0e prone areas the certificates
as indicated in .ppendix +, +!, P, P!, P6 and P/ shall be submitted duly signed by the )uilder,
.rchitect and Structural 3ngineer. n case of larger buildings having more than 8:: sq. m. built up
area or incase of more than / storied buildings, the certificates as per .ppendix P7, P8 and P9 shall
be filled in and signed separately by )uilder, .rchitect and Structural 3ngineer respectively and
submitted on its completion.

site plan, building plan, service plan, specification, certificate of supervision and ownership title as

or the area layout plan approved by the 4irector.

18" P%)/0%0&'$, 0,9 -'8,',8 $+ /(0,-< The licensed architect, structural engineer, engineer,
supervisor or town planner, as the case may be, shall prepare and duly sign any plans and shall
indicate his name, address, qualifications and license number as allotted by the .uthority. The plans
shall also be duly signed by the owner indicating his address. The type of buildings to be underta0en
by the licensed professionals shall be as given in rule 69.
19" N$&'2) +$% 0(&)%0&'$, $,(4< =hen the notice is only for an alteration of the building, only
such plans and statements, as may be necessary, shall accompany the notice.
20" N$&'2) +$% (0,9 09F$',',8 &#) G$=)%,>),& P%$/)%&4< n case of a notice of intention to erect,
re'erect or ma0e alteration in a building or to made enlarge any structure abutting on property
maintained by Public =or0s 4epartment, Military or other %overnment 4epartments, the notice and
plan shall be in sufficient numbers to enable the .uthority to forward one set each to the appropriate
department for report before the permission is granted. The %overnment 4epartment shall report to
the authority within two wee0s from the date of the receipt of the notice and plans whether or not they
have any ob,ection to the proposed construction, and give brief reasons for ob,ection, if any. f no
reply is received within two wee0s or within such further period as may be extended by the .uthority,
from the %overnment 4epartment, the authority shall be free to consider the question of sanctioning
the plan.
A21" F))-< @!A ;alidity of -otice sub,ect to payment of feesI''' -o notice as referred to in rule !9
shall be deemed valid unless the person giving notice has paid the application fees for the time being
in force to the .uthority and an attested copy of receipt of such payment is attached with the notice.
9@" P(',&# 2$,-&%52&'$, 2#)2K -5%=)4 n the case of a high rise building on completion of the
construction of the plinth the owner of the building shall obtain from the authority a certificate to the
effect that the plinth has been constructed strictly in accordance with the permissible covered area
The owner shall give a notice to the authority, which shall either issue the certificate or order suitable
changes to be made as per the approved site plan. The owner shall carry out such instructions as are
given, failing which the authority will be competent to demolish such part of the plinth as in under
ob,ection. The granting of a certificate or the issue of instructions regarding necessary changes will be
done within !8 days of the notice, failing which it will be deemed that the certificate has issued.
A 97" I--5) $+ S)%='2) C)%&'+'20&) ' +n completion of the civil wor0s of the building the owner shall
give an application to the authority for issue of a service certificate on the basis of which service
connections, especially water, sewerage and power, shall be granted by the authorities concerned. f
the certificate is not issued within !8 days of the notice, or suitable instructions for changes have not
been issued by the authority within the period, it would be deemed that the certificate has issued.

A 98" C$>/()&'$, C)%&'+'20&) 3very owner of a high rise building on completion of the building
and before its occupation of the building and before its occupation shall obtain from the authority, a
completion certificate to the effect that the building has been completed as per the sanctioned plan.
+ccupancy of a building for which a completion certificate has not been obtained shall be deemed to
be a violation of the permission as per the provision of under Section /9 of the Madhya Predesh
-agar Tatha %ram -ivesh .dhiniyam !"#/ @-o. 6/ of !"#/A and shall invite the penalty prescribed
thereinL.
