The following summary has been prepared to assist you in complying with the state and local laws
regulating the placement of political advertising (signs) in the Town of Salem. Please refer to these
guidelinestoensuretheproperplacementofyourpoliticaladvertising.
AsdefinedbyRSA664:2, VI,politicaladvertising meansanycommunicationwhichexpresslyor
implicitlyadvocatesthesuccessordefeatofanyparty,measureorpersonatanyelection.
PursuanttoRSA664:17:
o No political advertising shall be placed on or affixed to any public property including
highwayrightsofwayorprivatepropertywithouttheowner'sconsent.
o AllpoliticaladvertisingshallberemovedbythecandidatenolaterthanthesecondFriday
following the election, unless the election is a primary and the advertising concerns a
candidatewhoisawinnerintheprimary.
o Politicaladvertisingshallnotbeplacedonoraffixedtoutilitypolesorhighwaysigns.
o Politicaladvertisingplacedonoraffixedtoanypublicpropertymayberemovedbystate,
city,ortownmaintenanceorlawenforcementpersonnel.
o Political advertising may be placed within stateowned rightsofway as long as the
advertisingdoesnotobstructthesafeflowoftrafficandtheadvertisingisplacedwiththe
consentoftheownerofthelandoverwhichtherightofwaypasses.
PursuanttoChapter275oftheTownofSalemMunicipalCode,placementofpoliticaladvertisingon
allTownownedproperty,includingrightsofwayisprohibited.
o Rightofwaymeansalllandadjacenttothetraveledportionofapublicwayorstreetthatlies
betweenthepropertylinesofadjacentpropertyowners.
o Typically, the rightofway includes 1012 feet of land beyond the edge of the paved or
improvedsurfaceoftheroadway.
o Telephone poles, fire hydrants, and sidewalks are typically located within the rightofway;
therefore,politicaladvertisingshouldalwaysbeplacedtothenonstreetsideoftheseobjects.
InaccordancewithChapter275oftheTownofSalemMunicipalCode,nopersonshallaffix,attach,
ordisplayanypoliticaladvertisinguponanyobjectofnature,utilitypole,telephoneboothorhighway
sign.
PleasenotethatpoliticaladvertisingremovedbytheTownofSalemwillbeheldatthefieldopposite
theSalemTransferStationforoneweekfollowingtheelection.
