1.0 INTRODUCTION

1.1 Authorization

EnviroTrac Ltd. (EnviroTrac) prepared this Post-Class C-2 Response Action Outcome (RAO)
Status (Post-Class C-2 RAO Status Report) on behalf of Impact Environmental (Impact). The
report presents information related to Post-Class C-2 RAO operation, maintenance, and
monitoring conducted at the Disposal Site identified by the Massachusetts Department of
Environmental Protection (MassDEP) with Release Tracking Number (RTN) 1-16091.

1.2 Purpose

Pursuant to the Massachusetts Contingency Plan (MCP), as set forth at 310 CMR 40.0898(2),
this report includes:

a description of the type and frequency of inspection and monitoring activities conducted
during the reporting period of March 9, 2012 through September 9, 2013 [310 CMR
40.0898(2)(a)];
a description of any significant modifications of the operation, maintenance and/or
monitoring program made since the submission of the preceding Status Reports [310
CMR 40.0898(2)(b)];
an evaluation of the performance of the remedial action during the reporting period of
time since the last Status Report, including whether the remedial action is achieving
remedial goals specified in the applicable remedial action plan and a description of any
conditions or problems noted during the period that are or may be affecting the
performance of the remedial action [310 CMR 40.0898(2)(c)];
a description of any measures taken to correct conditions which are affecting the
performance of the remedial action [310 CMR 40.0898(2)(d)] and;
the name, license number, signature and seal of the Licensed Site Professional (LSP)
[310 CMR 40.0898(2)(e)].

1.3 Site Description

For the purpose of this report, the Facility is defined as the area located within the legal property
boundaries of the former Lia Honda automobile dealership located at 171-187 King Street, in a
mixed-use commercial and residential area of Northampton, Massachusetts. The Facility is
identified by the City of Northampton Assessors Office as parcels 24D-081-001, 24D-080-001,
and 24D-338-001. A Locus Map, depicted on the United States Geological Survey
Easthampton and Mt. Holyoke, Massachusetts topographic quadrangles, is included as Figure
1.

The Facility consists of three rectangular parcels of land, together totaling 5.36 acres in area.
The southern portion of the Facility has been used as an automobile dealership since the mid-
1940s. Currently the Facility is improved with a 20,331 square foot building, a shed, and paved
parking. The majority of the Facility property is covered with asphalt paving and is fenced on the
north, east and south sides. The paved parking area is accessible from King Street on the west
side. The building was constructed in approximately 1968 and is a two-story, masonry and
wood frame structure constructed on a slab-on-grade foundation. The building contains
showroom areas, a vehicle repair garage, a car wash, and parts storage and office space. The
Facility building is not currently in use. A former railroad right-of-way crosses the center of the

Facility diagonally from the northwest to southeast. No active rail line is present on the Facility
and the right-of-way is currently paved. The City of Northampton also holds a 30-foot wide
sewer easement that runs the length of the eastern side of the Facility.

The Facility is located in an area of mixed commercial and residential use. No hospitals,
schools, or daycare centers are located within 500 feet of the Disposal Site. The closest
residence is located on the west and opposite side of King Street, within 100 feet of the
Disposal Site. The Facility is bordered by the following:

North: A Massachusetts Electric Company (MEC) power distribution station, beyond
which are KFC/Taco Bell and McDonalds restaurants.
South: Commercial properties, including the Foster Farrar True Value hardware store,
Midas Muffler shop, and an automobile body shop.
West: King Street, beyond which are a residence and commercial properties, including
Acme Auto Body Collision Repair, Northampton Goodyear Tire and Auto Facility,
Family Wireless, Florence Savings Bank, King Cushman Insurance and Financial
Services, North Shore Seafood, King St. Liquors, a beer, wine and cheese
making supplier, and China Wok restaurant. Residences and a playground are
located beyond the commercial properties.
East: The Northampton Rail Trail and an active railroad line. An office building (former
paper box manufacturing facility) and residential properties are located east of
the railroad.

The Disposal Site is defined as the areas of the Facility where oil and/or hazardous materials
have come to be located as a result of the release at the Facility. The Disposal Site is located
at Universal Transverse Mercator coordinates of 4,688,398 meters (m) Northing and 694,970 m
Easting. The Site Plan (Figure 2) depicts pertinent Facility and Disposal Site features, including
environmental media sampling locations.

1.4 Release History

ECS completed a report entitled Phase I Environmental Site Assessment for Dealer Services,
Inc. (DSI) in J anuary 2001 for a 1.65-acre parcel owned by MEC. ECS completed the
assessment for property-transfer purposes and the report was not completed as an MCP
submittal. According to ECS, the parcel was leased to DSI. The parcel contained no structures
and was paved in 1985. Based on a Site Plan included in the report, the parcel assessed by
ECS was Lot 24D-080-001, the northernmost of the three parcels comprising the Facility. ECS
did not identify any environmental concerns, did not complete subsurface investigations for the
assessment, and recommended no further investigations.

HTE Northeast, Inc. (HTE) issued a report entitled Phase I Environmental Site Assessment, Lia
Honda Automobile Dealership, to Berkshire Development, LLC on J uly 11, 2005. HTE
determined the Facility was used for automobile sales since approximately 1946, and a junkyard
was listed in the City Directory at an address for the northern portion of the Facility between
approximately 1928 and 1951. A railroad spur was located at the Facility in 1902. Fire
department records documented that a 1,000-gallon waste oil UST and 7,000-gallon gasoline
UST formerly located at the east side of the existing building were installed in approximately
1969 and removed in 1986. HTE identified environmental concerns including a 1,000-gallon

oil/water separator in the southerly garage area of the building. The separator contained
approximately five feet of oily liquid. A floor trench drain appeared to discharge to the
separator, and the discharge location of the separator was not determined. Oil staining and
cracks in the concrete floor, and three former sub-slab hydraulic cylinder lifts were observed in
the southerly garage area. The floor trench drain in the northerly garage area reportedly
discharged to a holding tank which was pumped out if the trench drain backed up. Several 55-
gallon drums containing oily liquids and waste oil filters were observed in a shed structure
located behind and east of the building.

As documented in the 2005 Phase I report, HTE advanced 15 soil borings (B-1 through B-5, B-8
through B-15, T-1, and T-2) at the Facility on J une 30, 2005 and J uly 1, 2005. Soil borings B-4,
T-1, and T-2 were completed as groundwater monitoring wells. The soil borings were
completed to depths of 13 to 42 feet bgs. The depth to groundwater ranged from 8 to 16 feet
bgs. HTE identified extractable petroleum hydrocarbons (EPH) polychlorinated biphenyls
(PCB), metals (arsenic, cadmium, chromium, mercury, and lead) and polycyclic aromatic
hydrocarbons (PAH) in soil above the applicable MCP RCS-1 Reportable Concentrations. No
chemical compounds were detected in groundwater above the applicable MCP RCGW-2
Reportable Concentrations. Detections in groundwater below applicable standards included
EPH C9-C18 aliphatics, EPH C19-C36 aliphatics, barium, and selenium. MassDEP was notified
of the soil conditions on February 22, 2006, and issued a Notice of Responsibility to Don T. Lia,
LLC on February 24, 2006.

On April 4 and 5, 2006, ECS advanced ten soil borings (SB-1 through SB-7 and ECS-1 through
ECS-3) at the Facility. Three of the borings were completed as groundwater monitoring wells
(ECS-1 through ECS-3). Concentrations of lead (7 of 10 locations) and PCB (4 of 10 locations)
were detected in soil, typically in the top three (3) feet, at concentrations above MCP Method 1
soil category S-1 standards. Coal and coal ash were observed in soil samples obtained from
the borings and the presence of lead and PAH in soil was attributed to the coal and ash. No
source was attributed to the detections of PCB; however, ECS concluded the PCB Aroclors
detected were consistent with dielectric fluids used in electrical equipment.

Groundwater samples were collected from the monitoring wells ECS-1, ECS-3 and one
previously installed monitoring well (MW-1) on April 11, 2006. Depth to groundwater ranged
from approximately 14 feet bgs in ECS-1 to approximately 16 feet bgs in MW-1 on this date.
Groundwater was calculated to flow to the east-northeast. Monitoring well ECS-2 ran dry during
sampling. Groundwater sampling was conducted using low-flow sampling methods and
samples were analyzed for EPH, lead, and PCB. None of these compounds were detected in
groundwater.

HTE issued a report entitled, Additional Soil Sampling and Analyses Services, Former Junkyard
and Railroad Track Area, to Berkshire Development, LLC on May 2, 2006. In the report, HTE
documented the advancement of 27 soil borings (B-16 through B-41) to depths of 8 to 12 feet
bgs on April 6 and 7, 2006. Groundwater was not encountered in the soil borings. HTE
described subsurface soil as 11 feet of fill overlying 4 to 10 feet of silty and sandy alluvium and
outwash deposits, below which was soil described as glacial lacustrine deposits. The fill was
described as sand, gravel, and silt with some coal cinders and coal fragments. Soil samples
were screened with a photoionization detector (PID). HTE reported PID readings for all samples
were below detection limits. Soil samples from the fill layer were analyzed for EPH, metals, and
PCB. Select samples were also analyzed for volatile organic compounds (VOC), pesticides and
Toxicity Characteristic Leaching Protocol arsenic and lead. PCB, EPH fractions, PAH, and
metals (including arsenic, cadmium, chromium, and lead) were detected in soil above applicable

standards. The pesticides p,p-dichlorodiphenyl trichloroethane and p,p-dichlorodiphenyl
dichloroethene were detected at two locations below applicable standards. VOC detections
included 1,2,4-trimethylbenzene, 1,3,5-trimethylbenzene and naphthalene. The
trimethylbenzenes are C9-C10 volatile petroleum hydrocarbon fractions. In addition, HTE
obtained a sample of an in-situ wooden railroad tie from soil boring B-40 for analysis. PAH,
arsenic, and lead were identified in the tie, consistent with creosote.

On J une 6, 2006, ECS advanced 18 borings (A through R) to further delineate the extent of
PCB in soil at the Disposal Site. Soil samples were collected from 14 of these borings and
analyzed for EPH, metals and PCB.

Lia Honda submitted a Release Abatement Measure (RAM) Plan prepared by ECS to MassDEP
on J une 28, 2006. The RAM Plan proposed the excavation and removal of approximately 250
cubic yards of soil containing PCB.

On J une 29, 2006, ECS excavated four areas (designated Excavations A, B, C, and D) of
impacted soil in the vicinity of ECS-1, southwest of SB-3, in the vicinity of SB-5, and in the
vicinity of SB-7. Approximately 151 cubic yards of PCB-impacted soil was excavated and
stockpiled on-Site.

Soil samples were collected from the endpoints of each excavation. Concentrations of PCB in
endpoint samples in excavation areas A and D exceeded Method 1 S-1 standards. PCB
detections were below Method 1 S-1 standards in samples collected from the completed
excavation of areas B and C.

On J uly 20, 2006, ECS excavated an additional 0.5 cubic yard of soil from area A and 1.5 cubic
yards from area D. Soil samples were collected from the completed excavations.
Concentrations of PCB exceeded Method 1 S-1 standards in endpoint soil samples obtained
from the completed excavations. On August 7, 2006, ECS excavated 6 cubic yards of impacted
soil from area A. Soil samples collected from the excavation endpoints contained
concentrations of PCB above Method 1 S-1 standards. ECS excavated an additional cubic yard
of impacted soil on September 22, 2006.

On J anuary 12, 2007, MassDEP issued a Notice of Noncompliance (NON-WE-07-3005) to Don
Lia. The NON stated that a deadline of October 26, 2006 for submittal of a RAM Status Report
was not met, and established an interim deadline of J anuary 29, 2007 for the RAM Status
Report submittal.

According to MassDEP records, a RAM Status Report was submitted to MassDEP on February
1, 2007. The RAM Status Report documented the excavation and stockpiling of approximately
171 cubic yards of soil at the Facility between J une 29, 2006 and September 22, 2006. In
response, MassDEP issued an Interim Deadline letter requiring an evaluation of the feasibility of
reusing the excavated soil on-Site by February 22, 2007, and if on-Site soil could not be reused
on-Site, removal of the soil was required by April 1, 2007.

An MCP Phase I Initial Site Investigation and Tier II Classification prepared for the Disposal Site
by ECS was submitted by Lia Honda to MassDEP on March 1, 2007. ECS recommended Tier II
Disposal Site classification based on a Numerical Ranking System score of 123 and the
absence of Tier I inclusionary criteria. Data obtained subsequent to the MCP Phase I are
consistent with data utilized for the Tier II classification, and the exposure potential in 2009 is

similar to the exposure potential in 2007. Therefore, reclassification of the Disposal Site is not
required.

ECS concluded groundwater conditions met applicable standards, and PCB were present in soil
above applicable Method 1 standards. ECS listed former occupants of various portions of the
Facility as Carlson and Berger J unk (1928), LaMontagne Motors (1930), Standard Oil of NY
(1928 and 1930), Porter and McLeod Machine and Tool Company (1942 through 1946), Samuel
Carlson & Co. junk automobiles (1942 through 1946), Blyda Ford Sales, Inc. (1951 through
1981), and Northampton Honda (1990).

On May 9, 2007, MassDEP issued a Field NON (FNON-WE-7-3001) stating that the excavated
soil (remediation waste) was not removed within 120 days of its initial excavation, as required by
the MCP, and the soil was not stored in a secure manner. The Field NON required the covering
of the soil pile by May 11, 2007 and submittal of a written plan for soil removal by May 30, 2007.

A RAM Status Report prepared by ECS was submitted by Lia Honda to MassDEP on May 21,
2007. The report stated no RAM activities were conducted since February 2007, and stated
that approximately 200 cubic yards of soil was stockpiled on and under polyethylene sheeting
within construction fencing at the northern and western portions of the Facility. The report
provided an estimated date of J une 2007 for removal of the stockpiled soil.

On J une 6, 2007, Lia Honda submitted a Release Notification Form and summary letter
prepared by ECS to MassDEP. The notification was submitted to notify MassDEP of the
presence of PAH and metals in soil above MCP Reportable Concentrations. The PAH and
metals, which were detected during investigations completed by HTE in 2006, were not
previously reported to MassDEP. MassDEP did not issue an additional RTN for the Facility.

Impact, on behalf of Lia Honda, advanced 36 shallow soil borings (SP-1 through SP-36) at the
Facility on October 24 and October 25, 2007. Each boring was advanced to approximately 2
feet bgs using Geoprobedirect-push equipment. Soil samples were collected and visually
inspected. One soil sample from each boring was analyzed for PCB. The soil borings were
completed to delineate the extent of PCB in shallow soil at the Disposal Site.

On December 14, 2007, MassDEP issued a NON (NON-WE-07-3132) to Don Lia. The NON
stated a November 17, 2007 deadline for submittal of a RAM Status Report was not met, and
established an interim deadline of December 28, 2007 for the report.

According to MassDEP records, a RAM Status Report was submitted to MassDEP on J anuary
7, 2008.

A RAM Completion Statement prepared by Woodard & Curran, Inc. (W&C) was submitted by
Lia Honda to MassDEP on April 28, 2008. The report stated the stockpiled soil was classified
as a characteristic hazardous waste for disposal purposes and 228.03 tons of soil was
transported on J une 11, 2007 and J une 12, 2007 to the EQ Detroit, Inc. Facility in Detroit,
Michigan for disposal. The report further stated RAM activities were complete.

EnviroTrac prepared a Phase II Scope of Work for Impact, which was submitted by Lia Honda to
MassDEP on J anuary 27, 2009.

On March 1, 2009, Lia Honda submitted Notices of Delay for submittals of a Phase II
Comprehensive Site Assessment (Phase II CSA) and Phase III RAP. The notices, prepared by

EnviroTrac, stated additional data were necessary to delineate the extent of the Disposal Site,
and requested extensions of deadlines for submittal of the Phase II CSA and Phase III RAP.
MassDEP issued an Administrative Consent Order (ACO) on August 3, 2009. The ACO
established a deadline of September 30, 2009 for submittals of the Phase II CSA and Phase III
RAP.

Subsequent communications between EnviroTrac and MassDEP, on behalf of Lia Honda, kept
MassDEP informed verbally and in writing of delays associated with negotiating an access
agreement with MEC for the installation of soil borings along the rail trail right-of-way on MEC
property located to the east of the Facility. An agreement was signed between Don Lia and
MEC on March 5, 2010 allowing access. EnviroTrac, on behalf of Lia Honda, submitted a
written request to MassDEP to extend the ACO deadlines on J une 24, 2010. The Phase II CSA
was submitted to MassDEP on August 10, 2010.

The Phase II CSA concluded that a condition of No Significant Risk (NSR) to human health
does not exist relative to current or foreseeable future Disposal Site activities and use. Indoor air
and surface water were not identified as Exposure Points, and groundwater conditions were
consistent with NSR. Therefore, additional Response Actions are required to attain NSR
relative to soil.

Subsequently, an amended ACO was issued by MassDEP establishing a deadline for submittal
of the Phase III RAP by March 31, 2011 and the Phase IV Remedy Implementation Plan (Phase
IV RIP) by J une 30, 2011. The Phase III RAP was submitted to MassDEP on March 31, 2011.
On J une 6, 2011, on behalf of Lia, EnviroTrac submitted a Notice of Delay to MassDEP,
requesting a 30-day extension of the deadline for submittal of the Phase IV RIP. The Phase IV
RIP was submitted to MassDEP on August 1, 2011.

The Phase III RAP stated that the remedial goal for the Disposal Site is the achievement of a
Permanent Solution and attainment of background where feasible. A Permanent Solution would
be obtained if S-1/GW-2/3 soil standards (under a Method 1 risk characterization approach) and
background concentrations, where feasible, are achieved for all COC in soil. Based on current
soil and groundwater conditions at the Disposal Site, and identification and evaluation of
Remedial Alternatives, limited excavation to achieve S-1/GW-2/3 soil standards was selected as
the CRA. The Phase III RAP concluded based on a cost-benefit analysis that it is infeasible to
approach and achieve background at the Disposal Site.

A Class C-2 RAO was submitted to MassDEP on March 9, 2012. The RAO documented that a
condition of No Significant Risk (NSR) was attained with respect to safety, public welfare and
the environment. A condition of NSR with respect to human health for unrestricted future land
use was not attained. A condition of No Substantial Hazard (NSH) was attained provided the
asphalt paving overlying the Disposal Site soil remained intact to prevent human exposure to
soil.

On October 15, 2012, MassDEP issued a letter indicating that the Disposal Site was selected
for audit, with the audit focusing on the RAO, as well as the Phase II, Phase III and Phase IV
reports. MassDEP personnel conducted an audit site inspection on October 24, 2012 and
issued a Notice of Audit Finding and Notice of Noncompliance (NON-WE-12-3A081) on
December 11, 2012. On September 13, 2013, a Consent Order was signed with MassDEP
which specified deadlines for the submittal of specific information.

On September 9, 2013, a Post Class C RAO Status Report was submitted to MassDEP. On
November 20, 2013, pavement repairs were made to maintain a condition of No Substantial
Hazard. Documentation of the pavement repairs was submitted to MassDEP on November 22,
2013. On December 23, 2013, a revised Class C-2 RAO was submitted to MassDEP, including
a revised Substantial Hazard Evaluation.


2.0 POST CLASS C-2 RAO STATUS REPORT [310 CMR 40.0898(2)]

2.1 Type, Frequency and Results of Inspections Conducted [310 CMR 40.0898(2)(a)]

In accordance with the provisions of the Class C RAO, an inspection of the pavement condition
was conducted by EnviroTrac personnel on November 8, 2013. The pavement within the
Disposal Site boundary was inspected and photographed and locations where potential
exposure to underlying soil might occur were noted.

The pavement inspection revealed a number of locations where the asphalt paving was absent
or degraded. The locations were marked and pavement repairs were conducted by Duffy &
Willard Paving on November 20, 2013. A copy of the pavement repair documentation submitted
to MassDEP in included as Appendix A.

2.2 Significant Modifications Initiated [310 CMR 40.0898(2)(b)]

No significant modifications of the CRA were initiated during this reporting period.

2.3 Evaluation of the CRA [310 CMR 40.0898(2)(c)]

A condition of No Substantial Hazard is applicable to the Disposal Site under current conditions.
A Permanent Solution will be implemented at the time of property redevelopment.

2.4 Conditions and/or Problems Affecting CRA Performance [310 CMR 40.0898(2)(c)]

There are currently no conditions and/or problems affecting CRA performance.

2.5 Measure Taken To Correct Conditions and/or Problems [310 CMR 40.0898(2)(d)]

As stated in Section 2.1, pavement repairs were completed on November 20, 2013.

2.6 Summary and Conclusions

As stipulated in the Class C RAO submitted to MassDEP on March 9, 2012, a pavement
inspection was conducted on November 8, 2013. The inspection revealed a number of
locations where the asphalt paving was absent or degraded. The pavement repairs were
completed on November 20, 2013.

2.7 Name, License Number, Signature, and Seal of the LSP [310 CMR 40.0898(2)(e)]

The required LSP certification, seal, and signature are incorporated in the CRA Transmittal
Form (BWSC108) to which this Post Class C-2 RAO Status Report is attached.

Dear Ms. Tor,

In accordance with the Section 10(C) of the ACOP and NON executed September 24,
2013, this letter documents that the paving necessary to support the Class C-2 RAO has
been completed and the conditions necessary to support the Class C-2 RAO are being
maintained.

On November 8, 2013, Robert Bird, LSP of EnviroTrac Ltd. (EnviroTrac) inspected the
pavement within the Disposal Site at the Subject Site. A total of 13 areas were identified
which exhibited significant pavement deterioration with the underlying soil exposed.
Photographs of the areas identified for repair are provided as Attachment A.

On November 20, 2013, Duffy Willard Paving and Excavating of Florence,
Massachusetts completed paving of the 13 identified areas. Each area was prepared by
removal of the deteriorated asphalt and placement of clean gravel fill to restore the
appropriate grade. In vegetated areas, the vegetation was removed and clean fill
placed. A 2-inch layer of pavement was placed over each area, extending
approximately one to two feet horizontally beyond the deteriorated area. Photographs of
the areas following pavement repair are provided as Attachment B.
