I.T. Park, Lahug Cebu City Through: Oscar P. XYZE Property Manager Dear MR. XYZE: This letter is in behalf of our client, MRS. HELEN ABCDE. On the morning of November 22, 2013, MRS. ABCDE was riding her motorcycle on her way to eBloc Tower 2 for work. As she was going to the fourth floor parking area of e Bloc Tower 2, her motorcyle suddenly slid and she fell. It turned out that at that time, the fourth floor parking area has just been mopped and was still wet. However, no safety precautions or any cautionary signs were placed to warn anyone that the fourth floor parking area was still wet. This particular incident was recorded in a Police Certification dated November 22, 2013 and signed by SPO1 Armando Seda Bao. The said Police Certification is attached and marked herein as Annex A. Due to this unfortunate accident, MRS. ABCDE was hospitalized at Perpetual Succour Hospital and was forced by her doctor to rest for two weeks since she suffered from cerebral concussion and confluent abrasion at the knee. A copy of her Medical Certificate dated November 23, 2013, is attached and marked herein as Annex B. During MRS. ABCDEs brief confinement at the hospital, you and a certain Jae Anne, visited Mrs. ABCDE to discuss the accident. In your visit, you promised our client that your office will extend financial support for her medical needs/recovery. After that meeting however, our client could no longer contact anyone connected to your office, and any subsequent communication became difficult. More importantly, your offices promise to extend financial help were never materialized and Mrs. ABCDE was forced to pay the medical expenses from her own meager salary. In light of all these, our client, MRS. ABCDE, is asking you to pay the following:
a. EIGHT THOUSAND SIX HUNDRED TWENTY NINE PESOS AND FIFTY
THREE CENTAVOS (Php 8, 629.53) as loss of income for five days worth of absence when she was forced to take a bed rest due to her injuries; b. TWO THOUSAND PESOS (Php 2,000.00) for her torn/damaged clothing on the day of the accident c. FIVE THOUSAND PESOS (Php 5,000.00) for the hospital expense; d. TEN THOUSAND PESOS (Php 10,000.00) for the medical expense; e. TEN THOUSAND PESOS (Php 10,000.00) for the damage to the motorcycle; f. FORTY THOUSAND PESOS (Php 40,000.00) as moral damages; ..... for a total of SEVENTY-FIVE THOUSAND SIX HUNDRED TWENTY NINE PESOS AND FIFTY THREE CENTAVOS (Php 75, 629.53). Since your building personnel refuse to divulge relevant information about your office, we are left with no choice but to send this demand letter to the Property Manager of eBloc Tower 2 Building, Mr. Oscar P. XYZE. If you wish to meet with us for an amicable resolution of this matter, you can contact us at the telephone numbers set forth in this letter. In this regard, you are given fifteen (15) days from receipt of this letter to fully pay the sum of SEVENTY-FIVE THOUSAND SIX HUNDRED TWENTY NINE PESOS AND FIFTY THREE CENTAVOS (Php 75, 629.53). Should you fail to do so, our client will be constrained to commence a suit against you to protect her interests.
