7. (hat the plaintiffs, 4eing a resident of the said 4arangay, are
suffering a lot 4ecause of the e8tre9e noise produced 4y the
:4uffles; or spea<ers that are 4eing used 4y the a9pli operators5
1. (hat 4ecause of such noise, the plaintiffs are 4eing depri=ed of
sleep, silence and peace of 9ind5
>. (hat the noise caused 4y these a9plifiers does not only cause
distur4ance to the residents in the said 4arangay 4ut also to
near4y 4arangays and islands5
?. (hat the noise 4eing produced 4y these a9plifiers not only
causes distur4ance to people 4ut also frightens the ani9als and
insects such as the fireflies or @alitaptapA that produces light,
4irds, gec<o or @tu<o,A and @<uligligA 6hich produces sounds that
contri4ute to the 4eauty of our en=iron9ent5
B. (hat 4ecause the ani9als and insects are frightened 4y such
sounds, they 6ill no longer =isit the island and the future
generations 6ould no longer e8perience, see the light and hear
the sounds that they produce5
2. (hat due to such sounds produced 4y the sound syste9, the
future generation 6ould no longer see the real 4eauty of our
en=iron9ent 6hich also includes the contri4utions of such
ani9als and insects5

acts of the defendants herein5

respecti=ely, ha=e failed and refused to properly regulate the

President of the )iesta %o99ittee and the operator of the
soundE4arrier 4rea<ing sound syste9, should also 4e
i9pleaded in this case5
CAUSE OF ACTION
VIOLATION OF CLEAN AIR ACTOF 1888
10. (hat there has also 4een a =iolation of the %lean Air Act 6hich
defines e9issions as:
Any air contaminant, pollutant, gas stream or unwanted
sound from a known source which is passed into the atmosphere.
17. !ince e9ission also includes un6anted sound fro9 a <no6n
source, 4ased on the gi=en facts, it is also co=ered 4y this Act.
11. 'ased on the tests that 6as conducted 4y the +ENR, the
deci4el le=el of the bailes and the =ideo<e 9achines has
e8ceeded that 6hich is allo6ed under the la6 as also pro=ided
under the +ENR !tandard for Noise in #eneral Areas:

HClass AA- a section of contiguous area which requires quietness, such as areas
within 1 meters from school sites, nursery schools, hospitals and special
homes for the aged.
!Class A- a section or contiguous area which is primarily used for residential
purposes.
!Class "- a section or contiguous area which is primarily a commercial area.
!Class C-a section primarily #oned or used as light industrial area.
!Class $- a section which is primarily reser%ed, #oned or used as a hea%y
industrial area.

the la6, there is then a =iolation of the %lean Air Act 4ecause
the sound e9itted 4y the bailes and the =ideo<e 9achines is
considered as noise pollution.
1?. (he =iolation of the %lean Air Act only re=eals that the
4arangay captain and the 9ayor are not perfor9ing their duties.
nder !ection 723, paragraph F4G of the Local #o=ern9ent
%ode, a 4arangay captain has the duty, a9ong others, to:

of the Local #o=ern9ent %ode pro=ides, a9ong others:

for under /ection -- of this Code, implement all appro%ed policies,

12. (he failure of the defendants to perfor9 their official
duties had led to the =iolation of the %lean Air Act. (here has
