Subject: Actual verification of siting parameters related to closed stone crusher units on village
revenue areas of DEVDHAR, BALLE MAJRA, DIOWALA & KOLIWALA IN DISTT.
YAMUNA NAGAR and Extension of approved stone crushing zone on the factual grounds.
Respected Sir,
Respectfully, we are informing you that more than 5000 people, directly and indirectly, have
become jobless due to non operation of our stone Crusher units on village revenue areas of
DEVDHAR, BALLE

MAJRA , DOIWALA & KOIWALA in Distt. YAMUNA NAGAR Heavy
revenue losses are increasing In our book accounts. Cost of stone crusher products like
crushed stones and stone dust has gone extremely high., as a result, infrastructural cost of
.government development works like roads, bridges and buildings have gone more

than the actual
estimated /paid during last 2,years. It has become almost impossible for any

Common man to build
a shelter for his family. in present circumstances.
We all are making this request before you with a view to get proper solution to this present worst
situation caused due to closure orders of Haryana State Pollution Control Board in month of
April 2012 to close down the Operation of our stone crusher units. All are installed on village
revenue areas of DEVDHAR, BALLE MAJR,A, DOIWALA & KOLIWALA in Distt.
YAMUNA NAGAR outside the approved stone crushing zone.
The very first reason for the above referred closure orders of Haryana State Pollution Control
Board was: "NOT MEETING THE SITING PARAMETERS AS PER THE NOTIFICATION
DATED 18-12-1997. As a matter of fact that three villages BALLE MAMA DOIWALA &
KOLIWALA were washed away during floods In the year 1978, therefore the present
approved stone crushing zone was created. Till year 2011, As per the View of "ABADI the siting
parameters of distance were
-
Considered from the abadi of village DEVDHAR . Due to reasons
better known to some officers in and after 2011 the abadi was considered as per census report but
not as per actual field report.
We request your good self for considering the decisions of a high level meeting, in order to
solve the siting parameters problem related to stone crushing units ( which Is on records) under
the chairmanship of the then Chief Minister of. Haryana held on 20 July 1992. That meeting was
to solve as to vihether small Dhanies / Villages Should be considered while measuring siting
distances for the stone crushers from the abadi. In pursuance to the decision taken in the referred
meeting averments were made in the Honble Punjab and Haryana High court in CWP No. 19010 of
1995 in the matter of fatia Mohammed versus state of Haryana etc, that:


"Dealing with the objection of location of stone crushing unit within a distance of one
kilometre from the abadi of the village, reference has been made to a meeting dated 20-luly-
1992 wherein it was decided that in case the population of the village is of not more than 49
houses this conditions of one kilometre from the village abadi will not be applicable."
As per the decision of above referred meeting, three stone crushing units namely Satguru
Stone Crusher, Shiva stone Crusher and Walla Stone Crusher were permitted to operate at
village Doiwala & Devdhar in Distt YAMUNA NAGAR near the stone crushing zone of
village BALLE MAJRA and DOIWALA in Distt. YAMUNA NAGAR.
Our units had been working since last many years when abadi was considered from village
DEVDHAR and distance from actual forest was considered as per government records. The
land referred now as FOREST in the government records had its status as GAIR MUMKIN
DARIA as per Jamabandi of 1992-93 & 2001-02 but as per Jamabandi of 2007-08 the same
was shown as GAIR MUMKIN JUNGLE due to the plantation of extra trees by forest
department. The land referred as FOREST in the government records is as per creation of
NEW JAMABANDI. The said FOREST land falls in village DEVDHAR, Tehsil
CHHACHHRAULI, Di st t . YAMUNA NAGAR. Rect. Nos. 35, 36, 37, 38, 39, 40, 41,
42, 43, 44, 61, 62,63,64,65,66,69,87,88,89,90,93,95,116,117,118,119,120,121,122 etc.
Our stone crusher units were not running illegally whereas they were doing business since
1990 till 2012 .These units were taking regular consent to operate from H.S.P.C.B. and some
units had received official consent to run up to 2013.During the period from 1989 to 2012 no
objection was raised from the revenue and forest authorities. But In February 2012 H.S.P.C.B,
issued notices regarding cancellation of N.O.C. due to non compliance of parameters from
village abadi and forest.
We humbly request to your good self that kindly do the Actual Verification of Siting
parameters related to close stone crusher units on village revenue areas of DEVDHAR, BALLE
MAJRA, DOIWALA & KOLIWALA in Distt. YAMUNA NAGAR and the same may be
forwarded to the office of THE CHAIRMAN , HARYANA STATE POLLUTION CONTROL
BOARD, C-11, SEC- 6, PANCHKULA-Haryana at the earliest possible in order to save the
interest of people at large. Further, we request that our operational area may kindly be declared
as EXTENSION OF APPROVED STONE CRUSHING ZONE because as a matter of fact that
three villages BALLE MAJRA DOIWALA & KOLIWALA were washed away during floods
in the year 1978, therefore the present approved stone crushing zone was created and we were
also operating adjacent to approved stone crushing zone till 2012 after meeting the standards of
all compliances.
