Appellees state that: 1. On July 25, 2014, this Court set this case for oral argument on August 26, 2014, and assigned the argument for 20 minutes for each side. Case: 14-2386 Document: 185 Filed: 08/06/2014 Pages: 5 Page | 2
2. On August 1, 2014, this Court denied a motion filed by appellees in the Baskin case to conduct the entire argument in this case. Instead, the Court noted that [i]n the absence of an agreement, plaintiffs counsel in appeal nos. 14-2386, 14- 2387, and 14-2388 will each be given five minutes to present an oral argument. 3. Appellees have conferred and have reached an agreement and hereby notify the Court and the appellants that at oral argument in these consolidated cases Camilla B. Taylor and Kenneth J. Falk will be arguing for the appellees. 4. Ms. Taylor will argue for 8 minutes and Mr. Falk will be arguing for 12 minutes. 5. Ms. Taylor will argue first. WHEREFORE, appellees provide this notice.
