Re: Revised Letter of Representation
Dear Mr. Perez:
You have requested this office represent the Board of Aldermens (Board)
interests in connection with an investigation concerning the manner in which discipline
is administered between those in the majority, as compared to those who are minorities
within the City of New Havens Department of Fire Services. The following represents
this offices terms of representation in connection with this matter:
1. Although this offices normal hourly billing rate is $375 per hour;
we have agreed, as a gesture of good will to you and the City of
New Haven, to charge a reduced hourly rate of $250 per hour.
The Board will be billed on a monthly basis. At this juncture, we
anticipate the investigation will take 30-40 hours to conclude.
2. The Board will be responsible for all out-of-pocket expenses as
they arise. These expenses include, but are not limited to, filing
fees, sheriffs fees, long distance telephone calls, copying, mailing
Costs, travel expenses, facsimile transmissions and/or the like,
However, any substantial fee, (meaning any expense in excess
of $250), will require your express approval pj to it being incurred.
3. As a matter of professional practice, we will forward to you copies of
any and all pleadings and/or correspondence generated in connection
with my handling of this matter. If you review these materials as you
receive them, they will give you a reasonable idea as to the status of
the work we are doing on behalf of the Board.
4. At this time, we have not thoroughly discussed the amount of
access that will be provided to this office by the Fire Department
regarding matters of discipline and/or personnel records. Any
information obtained during the course of the investigation from
personnel records will be held in strict confidence and not used

5. The city also agrees that in the event it is necessary to collect any
attorneys fees and/or costs generated in connection with this matter,
any costs and/or fees related to the institution of a civil action will be
borne by the city.
6. Please be aware of the fact that, occasionally, other attorneys within the
office may be required to perform certain matters relating to your case.
All the attorneys employed by this firm are committed to the goal of your
professional satisfaction.
If, after you have read the foregoing terms of representation, and you find them
to be acceptable, kindly affix your signature to the signature line provided below and
date it. Thereafter, kindly forward back to this office the original letter along with the
retainer requested. A copy of this letter is provided for your records, If, on the other
hand, you have any questions, or you require any clarification concerning any of the
foregoing, please do not hesitate to give this office a call at anytime.
