EUROPEAN Toy Safety Standards
The new European Toy Safety Directive (2009/48/EC) was
published on 30 June 2009 in the Ofcial Journal of the European
Union. The purpose of the new directive is to enhance existing
toy safety regulations and improve the quality of toys.
The new toy safety directive which enforces the chemical
compliance from 20 July 2013 imposes more stringent regulations
and embraced more products than the previous directive
including the restriction of 19 heavy metal elements, as opposed
to the former 8, migration of N-nitrosamines and N-nitrosatable
substances, ban of 55 allergenic fragrances etc.

In addition, EU New Toy Safety Directive denes that toys shall
meet all EU general chemical regulations including REACH
directives, which provides legal basis for the future adding of new
chemical substances. In respect of market supervision, the New
Directive emphasizes on the responsibilities of manufacturers,
importers and distributors in product certication, adding clauses
related to the member countries enforcement power over market
supervision and their punishments arising from the breach of the
directive.
Organic Compounds in Toys: EN 71-9, 10
and 11
Besides correspondent test standards for the content of heavy
metal and other substances in toys for children, EN 71-9 is a new
requirement adding to the existing EN 71 series of standards. EN-
71-9 focuses on the possible hazardous consequences caused
by some organic compounds in toys, such as cancer, organic
mutation, damages to reproductive system, etc. To minimize these
hazardous consequences, EU issues EN 71-9 to limit the content
of hazardous organic compounds in toys and toy materials.
EN 71-9 clearly defines the content and migration of hazardous
compounds contained in toys and toy materials. The related
requirements are classified according to the following ways of
exposure:

In normal and visible use conditions, special attention shall be
paid to childrens behaviors, and the designs and functions of
toys.
EN 71-9: Organic Compounds Requirements
These requirements only cover certain materials used in the
following toys or toy materials such as
Toy intended to be placed into mouths of children under 3, such
as teether;
Toys and component exposed to children under 3;
Mouthpiece components of mouth-actuated toys;
Solid toy materials or others intended to leave a trace

All substances or mixtures used at olfactory board games,
gustative board games, cosmetic kit and gustative kits should not
be classied as dangerous. Corresponding denition as following:
1/ Olfactory board games to learn, to recognize different
odours or avours
2/ Cosmetic kits (not include play cosmetics for dolls) to make
soaps, lipstick, shampoos, etc
3/ Gustative board games to learn different tastes or avours
4/ Gustative kits to make sweets or dishes which involve the
use of food ingredients, e.g. powders and aromas
Follow the restricted allergenic fragrances requirements according
to 2009/48/EC.
55 fragrances shall not be contained in toys (unless technically
unavoidable and not exceed 100mg/kg)
11 fragrances allow to be used in toys, but its name shall be
listed on toys or packaging if exceeding 100mg/kg
26 fragrances out of 66 shall be allowed in olfactory board
games, cosmetic kits and gustative games, provided that:

To determine migration of N-nitrosamines and N-Nitrosatable

in the mouth. To describe analytical methods to be used for the
following types of toys:
(a) Migration of N-nitrosamines and N-nitrosatable
substance from elastomeric toys and parts of toys.
E.g. balloons, teethers
(b) N-nitrosamines and N-nitrosatable
substances content in nger paints.

Toy shall bear i) the name and address of Manufacturer and/or
Importer*, ii) identication number.
Identication number can be a type, batch, serial or model number or
other element allowing their identication.

CE Marking shall be xed to the toy, a label or to the packaging. It is
sufcient for the CE mark to be on the packaging if it is visible at the

Packaging, literature accompanying toys shall provide the safe
use or assembly of a toy. No words, statements or graphics that
illustrating a dangerous situation and inconsistent with the safety
labeling instructions for use.

Safety Labeling Requirements for Certain Toys
Safety labeling shall consist of:
i) an alert symbol (an exclamation mark within an equilateral triangle),
ii) a signal word (CAUTION or WARNING),
iii) text that describes the hazard that is present.
iv) may contain text about what to do or not to do to avoid injury (for example, Keep out of babys reach).
1) Crib and playpen toys intended to be strung across
a crib or playpen by means of string, cord, elastic,
or straps
(including, but not limited to, crib exercisers, crib
gyms, and activity toys).
2) Mobiles intended to be attached to a crib, playpen,
wall or ceiling

- Items that are determined to contain hazardous
materials must have appropriate warnings based on
the advice from a toxicologist who conducted the
formulation review.
- If item does not contain hazardous material, it needs

8) Magnets [packaging and instructions]
Hobby and crafts items and science kit-type items for hcildrne over 8 years of age which contain a loose as-
received hazardous magnet or a loose as-received hazardous magnetic component shall carry following or
equivalent text:
This product contains (a) small magnet (s). Swallowed magnets can stick together across intestines causing
serious infections and death. Seek immediate medical attention if magnet (s) are swallowed or inhaled.
9) Battery powered ride-on toys
The packaging or point-of-sale literature of battery-powered ride-on toys shall contain following or equivalent text:

- (a) To reduce the risk of injury, adult supervision is required. Never use in roadways, near motor vehicles, on or
near steep inclines or steps, swimming pools or other bodies of water; always wear shoes, and never allow
more than ________ rider(s), and
- (b) RISK OF FIRE. Do not bypass. Replace only with ________.
(Note: This warning must be placed at the location of any user replaceable fuse or circuit protection device.)

10) The packages of small balls, marbles, balloons, and certain toys and games shall carry safety labeling to
address the possible choking hazard as dened by ASTM F963 is outlined below:
