EXTRAJUDICIAL DEED OF PARTITION

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and entered by ,between and among BONIFACIA CERBITO UBALDO surviving
spouse of the late BENJAMIN GILLEGO UBALDO SR. who left this property located at Bon-Ot Big,Matnog,
Sorsogon hereby covenant that the said property be subdivided or partitioned among the heirs namely LETICIA U,
ROBERTO, BENJAMINC. UBALDO, RODOLFO C. UBALDO,ROMEO C. UBALDO, DOUGLAS C. UBALDO,
ALEX C.UBALDO,MURIEL U. PALACIO, EDITHA C. UBALD AND CYNTHIA U. GILLEGO, all of legal age,
Filipino and resident of Camcaman and Camachiles, Matnog, Sorsogon.

WITNESSETH:
That Bonifacia Cerbito Ubaldo, is the owner in fee simple of a certain agricultural land having been acquired as
inheritance from her husband, the late Benjamin Gillego Ubaldo Sr., covering an area of Fifty Thousand square meters
(50,000sq. m) or Two Hectares; and that same shall be subdivided or partitioned between and among the nine (9) heirs
and successors on interest mentioned above having a share more or less of five (5) thousand square meters (5,000sq. m.)
each. The said property as bounded on the North by the land of Salvador Encinas, by the seashore on the South, by Jose
Ubaldo on the West, and by Salvador Encinas and seashore on the East;
That this land is not tenanted and does not come or in the operation of the Land Reform Cod3e and allied
Presidential Decree and Circulars of the Department of Agrarian Reform;

A F F I D A V I T


I, BONIFACIA UBALDO Y CERBITO, of legal age, married to Benjamin Ubaldo Y Gillego, resident of
Camachiles, Matnog, Sorsogon, after having sworn to in accordance with law, hereby depose and say;

That I am one of the nine (9) lawful heirs of the late spouses Lucio Cerbito Y Blando and Nicolasa Cerbito Y
Gaspi, all of whom were residents of Matnog, Sorsogon;

That the aforecited children were named Bernardo, Natalio, Dionisio, Estanislao, Demetria, Guillermo,
Bonifacia, Felecitas and Romualdo;

That of the aforesaid children, Demetria barely two months from birth, died while Natalio, Estanislao and
Romualdo all died without heirs or assigns, preceding the death of our father Lucio;

That our father Lucio Cerbito died without written will as to how his estate shall be disposed off or shared
among us his heirs. Hence, by operation of law, the whole estate he left need be shared equally, dividing the property into
lots or assigned each of the co-heirs things of the same nature, quality and kind;

That indeed, our parents, left a real property more particularly located at Sitio Juag, Barangay Calintaan with land
area of 47, 075 square meters covered by Tax Declaration No. 2192 year 1952 later changed to 3551 under the name of
Lucio Cerbito as its lawful owner;

That the said property appears now as owned by Iluminada Cerbito Y Geneblazo the wife of the late Dionisio
Cerbito for which this affiant and all other heirs of their descendants (heirs, children) vehemently and strongly question
its propriety and genuineness of ownership on the following grounds;

1. That the property mentioned in the preceding paragraph 6

, not being partitioned yet either extra- judicially or
judicially, is still owned in common by the legitimate direct heirs as cited in paragraph 3 above;

2. That my late brother, Dionisio Cerbito could not have legally transferred or sold the said property by mere
act of charity to his wife Iluminada Cerbito. That there never was renunciation of right or quitclaim of
inheritance made by the other brothers and sisters so as to constitute Dionisio Cerbito as the sole owner of
the agricultural land in question and thereby upon his death, his wife, Iluminada Cerbito cannot rightfully
inherit the same;

3. That the series of cancellation of Tax Declarations transferring ownership on the property from Lucio
Cerbito to Dionisio Cerbito and finally to Iluminada Cerbito were willfully, maliciously and illegally
perpetrated by Iluminada Cerbito, the widow of Dionisio Cerbito and her daughter, Cristita Loberes Y
Cerbito to defraud and deprive the other rightful co-owners of the said property;

That on March 8, 1988, MRS. ILUMINADA CERBITO y GENEBLAZO without consulting the others heirs,
executed a DEED OF SALE WITH RIGHT TO REPURCHASE in consideration for the sum of Seventeen Thousand
Eight Hundred (P 17, 800) Pesos in favor of GLORIANA HACILDO GATON but it was not her who redeemed the
said property but ALEX C. UBALDO, who paid the said amount including the amount of Five thousand Five Hundred
for another lot known by tax declaration no.36-086, thereby mortgaging the said two lots in the total amount of Twenty
Three Thousand Three Hundred Twenty Four (P 23, 324.00) Pesos;
That of the two lots being mortgaged to Alex C. Ubaldo, again without giving notice to the redemptor and/or to
the only surviving heir, Mrs. Bonifacia Ubaldo Y Cerbito. Mrs. Iluminada Cerbito sold Lot designated by Tax
Declaration No. 36-086 to Alex C. Geneblazo for Thirty Thousand Pesos.
