Definitons of concepts

1.Dovana turtas ar turtin teis (reikalavimas), neatlygintinai perduotas pareignui, valstybs tarnautojui ar darbuotojui, dirbaniam pagal darbo
sutart, nuosavybs teise, taip pat pareigno, valstybs tarnautojo ar
darbuotojo, dirbanio pagal darbo sutart, atleidimas nuo turtins pareigos dovanotojui arba treiajam asmeniui.

2.Interes konfliktas situacija, kai valstybinje tarnyboje dirbantis asmuo, atlikdamas pareigas ar vykdydamas pavedim, privalo priimti
sprendim ar dalyvauti j priimant ar vykdyti pavedim, kurie susij ir su jo privaiais interesais.

3.Kodekso paeidimas asmens nusiengimas Kodekso nustatytiems etikos principams bei veiklos ar elgesio reikalavimams, padarytas dl to
asmens kalts.

4.Korupcija pareigno, valstybs tarnautojo tiesioginis ar netiesioginis siekimas, reikalavimas arba primimas turtins ar kitokios asmenins

pareigno, valstybs tarnautojo veiksmai (neveikimas) siekiant, reikalaujant turtins ar kitokios asmenins naudos sau arba kitam asmeniui ar i
naud priimant, taip pat tiesioginis ar netiesioginis silymas ar suteikimas pareignui, valstybs tarnautojui turtins ar kitokios asmenins naudos
(dovanos, paslaugos, paado, privilegijos) u atlikim (neatlikim) veiksm pagal pareigno, valstybs tarnautojo einamas pareigas, taip pat
tarpininkavimas darant ioje dalyje nurodytas veiklas.

5.Muitins staiga Muitins departamentas prie Lietuvos Respublikos finans ministerijos, teritorin muitin arba specialioji muitins
staiga.

6.Nestatutiniai santykiai pareign netarnybiniai ryiai su asmenimis, kurie rengia, daro ar padar su muitins veikla susijus nusikaltim arba

1.Unlawful gift - property or property right, transferred to the official without reward for his possession or exemption from the payment.

2.Conflict of interests it is a situation, when the customs official, while on duty, has to decide or to take a part in making decision related to his
private interests.

3.Breach of Code is violation of the Code of Ethics by the Customs official.

4.Corruption is seeking benefit, demand or acceptance of unlawful gift, service, promise or privilege by a customs official for himself/herself or
other person in exchange of activities implemented while in certain working position.

5.Customs Office - Customs Department under the Ministry of Finance of the Republic of Lithuania, territorial customs office and special customs
office.

6.Non-statutory relations customs Officials relations, who plan to commit or have already committed crime or administrative offence, when the
official knew about it and did not prevent it.

7.Repeated breach of the Code is violation of the Code, no later than one year after the latest violation.

8.Professional ethics of officials - defined by legislation and other regulations.

9.Private interests are private interests of customs official or his relative, personal property or immaterial interest affecting the officials
decisions while on duty.

10.Severe breach of Code is activity of the officer severely violating the principles of the Code or an effect of officer both on duty or off duty,
which damaging the title of the officer.

11.Public interests - the public interest to have people working in civil service, taking non-bias and just decisions.







Principles of Professional Ethics of the Lithuanian Customs Officer

1. Pagarba mogui ir valstybs principas.
1.1. gerbti mog, jo teises ir laisves, valstyb, jos institucijas ir staigas;
1.2. atlikdamas savo pareigas vadovautis muitins staig ar j vadov suformuotais tikslais ir kryptimis;
1.3. laikytis Lietuvos Respublikos Konstitucijos, statym ir kit teiss akt reikalavim, vykdyti teism sprendimus;
1.4. pagarbiai iklausyti asmenis ir imtis vis teist priemoni jiems padti, dmesingai reaguoti piliei bei organizacij praymus ir
silymus;
1.5. tarnybinje veikloje ir vieajame gyvenime jokia forma ar bdu neskatinti asmen nesilaikyti statym bei kit teiss akt, juos
paeisti.
2. Teisingumo principas.
2.1. vienodai tarnauti visiems monms, nepaisydamas j tautybs, kilms, kalbos, rass, lyties, seksualins orientacijos, amiaus,
socialins, turtins ar eimins padties, religijos, sitikinim, politini ar kit pair, uimam pareig, ir imtis teist priemoni
pastebtai diskriminacijai paalinti;
2.2. bti teisingas nagrindamas praymus, skundus, pareikimus, priimti pagrstus sprendimus;
2.3. atlikdamas pareigas veikti pagal suteiktus galiojimus.
3. Nesavanaudikumo principas.
3.1. rengdamas, svarstydamas ir priimdamas sprendimus bei kitoje pareigno veikloje vadovautis tik vieaisiais interesais ir vengti
interes konflikto;
3.2. nesinaudoti valstybs nuosavybe ir tarnybos teikiamomis galimybmis netarnybinei veiklai, taip pat nesinaudoti ir neleisti kitiems
asmenims naudotis tarnybine ar su tarnyba susijusia informacija kitaip, negu nustato statymai ar kiti teiss aktai;
3.3. nesinaudoti savo tarnybine padtimi ir neusiimti kita veikla, kuri galt sukelti viej ir privai interes konflikt, sudaryt
prielaidas tarnybos teikiamas galimybes panaudoti ne vieajam interesui garantuoti, trukdyt atlikti tarnybos pareigas arba kenkt
tarnybos autoritetui ar j diskredituot;
3.4. naudoti savo tarnybos laik tik tarnybos tikslams
4. Padorumo principas.
4.1. laikytis duotos priesaikos ir pasiadjim;
4.2. bti lojalus Lietuvos valstybei ir muitinei;
4.3. elgtis nepriekaitingai, bti nepaperkamas, nepriimti dovan, pinig ar neatlygintin paslaug, iskirtini lengvat ir nuolaid,
iskyrus statym ir kit teiss akt nustatytus atvejus;
4.4. nesinaudoti kito asmens klaidomis ar neinojimu;
4.5. naudotis jam suteiktomis galiomis apginti visuomens interesus nuo galim paeidim.
5. Nealikumo principas.
5.1. bti teisingas, objektyvus ir neturti asmeninio iankstinio nusistatymo, utikrinti, kad priimami sprendimai bt ne tik teisti, bet ir
objektyvs, be savanaudik paskat;
5.2. elgtis nealikai, nedemonstruoti savo simpatij, antipatij ar iskirtinio dmesio atskiriems asmenims ar j grupms;
5.3. konfliktinse situacijose iklausyti abiej pusi argumentus ir iekoti objektyvaus sprendimo;
5.4. tarnybos metu ir (arba) dvint tarnybin uniform vieai nereikti politini pair.
6. Atsakomybs principas.
6.1. teiss akt nustatyta tvarka paaikinti ir pagrsti savo sprendimus ar veiksmus;
6.2. atsisakyti vykdyti neteist nurodym ar sakym, informuoti apie tai muitins staigos ar auktesnes pareigas einant vadov;
6.3. neturdamas pakankamai itekli, gdi ar kompetencijos vykdyti pavedim, apie tai nedelsdamas informuoti tiesiogin vadov;
6.4. asmenikai atsakyti u sprendim ar veiklos rezultat pasekmes, trumpalaiki ir ilgalaiki tiksl gyvendinim;
6.5. prisiimti atsakomyb u kolegialiai priimtus sprendimus;
6.6. pastebjs pavaldi pareign daromas klaidas, informuoti vadovyb ir imtis
neatidliotin veiksm dl j itaisymo.
7. Vieumo (skaidrumo) principas.
7.1. utikrinti priimam sprendim ir veiksm vieum, pateikti savo sprendim primimo motyvus;
7.2. teiss akt nustatyta tvarka ir slygomis teikti reikiam informacij kitiems pareignams, valstybs tarnautojams, darbuotojams,
dirbantiems pagal darbo sutartis, bei visuomenei.
8. Pavyzdingumo principas.
8.1. bti nepriekaitingos reputacijos, gebti deramai atlikti savo pareigas, nuolat tobulintis;
8.2. savo pareigas atlikti laiku ir kompetentingai;
8.3. tarnybinje veikloje ir vieame gyvenime savo ivaizda, kalba ir elgesiu gerinti savo institucijos, profesijos ir visos alies vaizd, su kit
taut, valstybi atstovais elgtis nepaeidiant kit taut ir valstybi orumo;
8.4. visose situacijose veikti humanikai, bet kartu argumentuotai ir taktikai atmesti neteistus praymus;
8.5. nuolat tobulintis ir kelti savo kvalifikacij;
8.6. nereikti paniekos bendradarbiams, pavaldiniams, vadovams, neeidinti, neplsti, nevartoti smurto;
8.7. nepriekabiauti, vieai nesirodyti neblaiviam ar apsvaigusiam nuo narkotini ar
toksini mediag, savo elgesiu neeminti pareign orumo, ugdyti visuomens pasitikjim muitine ir pareignais.
1. Principle of respect towards a person and the state.
1.1 respect the person, his/her rights and freedoms, also respect state, its institution and offices.
1.2 follow customs offices or their directors orders and trends.
1.3 follow LR constitution, legislation, provisions.
1.4 respectfully listen persons opinion and take all measures in order to help them, pay attention to theirs requests and suggestions.
1.5 do not let persons to offend against the law and other legislation.
2. Principle of justice.
2.1 To serve all persons despite their nationality, origins, race, sex, age and other attitude. Take all measures if you need to eliminate
discrimination.
2.2 Make a right decision investigating appeals, complaints, statements
2.3 Exercise your obligations by law.
3. Principle of unselfishness.
3.1 Follow only public interests and avoid conflict when you making an important decision.
3.2 Do not spend states property, services and information against law and legislation.
3.3 Do not spend your official position and other activity, which could arouse harm and disturbance to do the service duties.
3.4 Spend your official time only for service purposes.
4. Principle of decency.
4.1 follow you own given swear and pledge
4.2 to be loyal to LR and customs office.
4.3 Behave perfectly, do not take any unlawful gifts, money or bribes
4.4 Do not use other persons mistakes or ignorance
4.5 Improve validity to protect society interests from possible offences.
5. Principle of non-bias
5.1 be just, objective and do not have personal attitude. Make sure that decisions would be only just but also objective without
selfishness purposes
5.2 Try to behave without bias, do not show your personal feelings to other persons.
5.3 During the conflict situation, listen both side arguments and try to seek an objective solution.
5.4 During service time or wearing your official uniform, try not to spread your political view.
6. Principle of responsibility.
6.1 to explain and argument your decisions or actions.
6.2 Refuse to carry out an unlawful order, inform more privileged customs official.
6.3 Do not able to have any reservoirs, skills or ability to perform an assignment, you have to inform direct chief.
6.4 Personally respond for the decisions or activity effects of short-term and long-term objectives
6.5 To assume responsibility for collectively decisions
6.6 When you notice officers mistakes, inform the headquarters and immediately take special measures for their correction.
7. Principle of openness and transparency.
7.1 Ensure that the decisions and actions in the public are made motivated.
7.2 Provide the necessary information to other officers, civil servants, employees, working under a contract of employment, and for
society.
8. Principle of model behaviour.
8.1 Have a good reputation, able to properly perform your duties, regularly improving by itself.
8.2 Perform your duties in a timely and competently.
8.3 Improve your agency, the profession and the country's image by yours appearance, language and behaviour.
8.4 Act humanely in all circumstances, reject unlawful requests.
8.5 Continuously develop and improve your skills
8.6 Do not arouse panic to colleagues, managers, try not to abuse other persons.
8.7 Do not appear drunk or under the influence of drugs in public, do not humiliate the dignity of officials, to promote public confidence
and customs officials
