Magnusonbadge#2845,aWhitemaleNassauCountyandformerNYPD
officerandhispartnerMcGory.Iamwritingtoformallycomplain
thatofficerMichaelDaragjatiwasright.Iamrequestingyour
assistancetoensurethatIamtreatedfairlywithdignityand
respectinaccordancewiththeCrimeVictimsRightsAct.
OfficerDaragjati,aWhitemaleeightyearveteranNYPDofficerwho
wasrecordedbytheGovernmentbragging,"IfriedanotherNigg@r,and
itwasnobigdeal,"pleadedguiltytoviolatingthevictim'sCivil
Rights,andtoldaBrooklynFederalcourtjudge,Ichargedan
individualknowingthatnoprobablecauseexistedtosupportthe
charge.
Oversevenyearsago,beforeMichaelBrown'sdeathinFerguson
Missouri,IfellpreytotheperpetratorsduringthenightonDr.
MartinLutherKingJr.Day.Ididnotcommit,wasnotcommitting,or
linkedtoanycrime.Myvehiclewasregisteredandinsured,andmy
driver'slicensewasvalid.Theyarrestedmewithoutprobablecause
forOPERATINGMOTORVEHICLEWITHOUTSEATBELT.
AtthetimeofmyarrestIwashavingaconversationwithtwo
uniformedBlackmaleofficersintheparkinglotattheHomeDepot
ShoppingCenterinElmont.

Inordertoprovidealegalbasisfortheircriminalacts,they
preparedandfiledtheaffidavitsupportingthecriminalcomplaint
Docketnumber2007NA001345falselystatingthattheypersonally
observedmeoperatingmyvehicleonHempsteadAvenuewithoutaseat
belt,eventhoughIhadencounteredthetwouniformedofficers
severalminutesafterIenteredtheparkinglot,andtheyarrivedon
thesceneandarrestedmeseveralminutesaftertheencounter.
FollowingthearrestofficersMagnusonandMc.Gorytransportedmeto
theFifthprecinct,subjectedmetoastripsearch,"impounded"my
registeredandinsuredvehicle,andconfiscatedmymedicationand
tools.
Asyouareaware,theFourteenthAmendmenttotheUnitedStates
Constitutionpreserves,amongotherthings,therightofeveryperson
tobefreefromprosecutionandthedeprivationoflibertyand
propertyonthebasisoffraudulentevidenceintheformofwritten
reportsorfalsetestimony.Inaddition,section242ofTitle18
makesitacrimeforapersonactingunderthecolorofLawto
willfullydepriveanotherpersonofarightorprivilegeprotectedby
theConstitutionorlawsoftheUnitedStates.
ByarrestingmewithoutprobablecauseforOPERATINGMOTORVEHICLE
WITHOUTSEATBELT,falsifyingPoliceandCourtdocumentsinorderto
justifytheircriminalacts,andinitiatedmyprosecutiononthe
basisofmanufacturedevidence,officersMagnusonandMcGory,did
willfullysubjectmetothedeprivationofarightguaranteedbythe
ConstitutionandLawsoftheUnitedStatesofAmerica,namelythe
righttobefreefromthedeprivationoflibertyandpropertywithout
dueprocessoflaw,inviolationoftheFourteenthAmendment,the
FourthAmendment,andTitle18,UnitedStatesCode,Section242,and
havecausedfalseinformationtobeenteredintotheCourtrecordat
greatPublicandpersonalharm.
Oversevenyearsago,NassauCountyExecutiveThomasSuozzirequested
byannexedletterdatedApril24,2007,thatPoliceCommissioner
JamesH.Lawrenceassigntheappropriatepersonneltolookintothe
"impounding"ofmyvehicle.Hisrequesthasbeenignored.
Today,Iamrequestingyourhelpthatwillensurethatthe
perpetrators'seriouscriminalactssupportedbycredibleevidence
theCourtrecord,receivetheappropriatescrutinysimpleJustice
requires,lestitwillappearthatcriminalactsarerewardedand
endorsed.

Ihavebeenhomelesseversincethey"impounded"myvehicle,
confiscatedmytools,anddeprivedmeofmylivelihood.
GivenwhatIhavegonethroughoverthepastsevenyears(7)theres
nowayanyofuscanexcusewhatthesePoliceofficersdid.
