CONSTRUCTION / RENOVATION GUIDELINES
FOR MALL SPACE TENANTS
STORE NAME

The following Construction / Renovation Guidelines shall form an integral part of the Contract of
Lease. Please review the Construction Guidelines and comply strictly with the provisions required
in the submission of plans for approval.

I.

PRE-CONSTRUCTION REQUIREMENTS
A. Site Visit The Lessee is obliged to conduct with his consultants (e.g. Designers and
Contractors) to verify actual space measurements and site conditions prior to the
preparation of Preliminary Design Phase. It is important that the Lessee and his
consultants meet with the Tenant Relations Officer and the Building Administrator to
discuss requirements prior to Lessees construction.

B. Turn-Over of Leased Space Lessor will schedule a turnover date wherein the
assigned space will be formally turned over to the Lessee as ready for construction. The
Lessee will affirm that all provisions in the space are present and in good condition. Upon
turnover of space, the Lessee shall be responsible for its security and must abide by the
guidelines set by the Lessor. If the Lessee does not renovate within two (2) months
renovation period, the security deposit shall then be forfeited in favor of the Lessor.

C. Plan Requirements
1. Design / Working Drawings & Outline of Scope of Works
1.1. Lessee shall submit four (4) sets of Specifications and Scope of Works. This
shall be reviewed and evaluated prior to the approval for Construction
Documents by the Lessor. These will describe all architectural, structural,
electrical, mechanical, fire protection and sanitary/plumbing works wherever
applicable.

1.2. Lessee shall submit six (6) sets For Construction Plans (Design and Working
Drawings) for review and comments prior to the approval for construction by the
Lessor with the following requirements:

must be complete (Refer to Plan Checklist, Item C.2) ;


must be signed by the Lessee / Owners;
must be signed and sealed by the registered trade required;
must comply with the standard guidelines on sheet presentation and contents as
specified in the National Building Code (P.D. 1096) and other related rules and
regulations;
must comply with the Guidelines set forth herein by Pacific Mall Management

1.3. All Construction Plans are subject to the approval of the Lessor. Lessee shall
comply with all revision notes given by Lessor and may be asked to resubmit
said construction plans (on major revisions) for final approval.
1.4. Incomplete plans will not be received for evaluation.
1.5. The efficiency of the design for the Lessees space and performance of the
materials used shall be the responsibility of the Lessees designer/contractor.
Such works are subject for Lessors Architect comment and inspection to
maintain the general aesthetics of the entire mall.
1.6. Lessee shall improve the leased premises with materials, fixtures, furnishings
and equipment that will enhance their image and the overall image of the mall.
1.7. The Lessor shall review plans only twice. Thereafter, a penalty of Three
Thousand Pesos (Php 3,000.00) shall be imposed for every revision.
1.8. Any additional changes and/or revisions on approved construction / renovation
plans must also be approved by the Lessor before implementation.
1.9. Any future work in the interior design, electrical, mechanical and plumbing
systems of the leased area shall be done by a contractor duly approved by the
Lessor.

2. Plan Checklist
All design & working drawings shall be in standard size 20 x 30 and shall
follow the front/cover sheet format, margins and title block standards as
stipulated in the latest edition of the National Building Code. Drawing scales to be
used shall not be smaller than 1:100 meters (except for Key Plans) and be
large enough to clearly convey the design intent.

1. Government Permits

Lessee shall submit all required documents to Lessor for review and approval.
Once such documents have been approved, then Lessor shall endorsed Lessees
for Construction Plan to the Office of the Building Official for joint site
inspection. Upon acceptance of the building official, Lessee shall then pay
necessary fee to the city treasury and be issued a certification of compliance by
the building official office.
All works shall be in accordance with the latest existing government
regulations, the National Building Code, the Philippine Electrical Code, The
Fire Code of the Philippines and other codes applicable for such work.

Contractors All-Risk Insurance

All contractors engaged by Lessee shall secure a Contractor All Risk


Insurance Coverage (CARI), from the insurance company acceptable to the
Lessor, with a combined single liability limit of not less than (Php 200,000.00) for
bodily injury and property damages to the Lessor and third party for the duration
of the construction. Otherwise, Lessor will not allow any construction.

II.

BUILDING PROVISIONS AND DESIGN CRITERIA


A. Architectural
A.1 Architectural Provisions
1. Floor Concrete floor designed to carry a live load of one hundred (100) PSF
with steel trowel cement finish.

2. Walls and Partitions CHB walls with approximate height of 3.5m will be used
as partitions in between tenants. .For security reasons, tenants are required to
install light materials above such as steel grills, cyclone wire, and the like subject
to Lessors approval.

4. Storefront none
5.Temporary Board-Up -thick. (at 2.4 m high) Ficem Board enclosure,
painted white, to extend 50 cm beyond the boundary of the leased premises is to
be provided by the Lessor at Lessees expense (on a per square meter basis). A
white plastic cover will be placed above the 2400 mm high enclosure for high
storefront heights. Lessees Store name will be posted on the enclosure. Any
proposed additional marks, texts or artwork on the enclosure are subject for
approval by the Lessor. Lessee may obtain said board-up after completion of
works.

A.2 Architectural Design Criteria


The criteria, which are applicable to all lessees, have been formulated to ensure that
the design requirements are understood by each Lessee, his architect or designer,
contractor and representatives. Variety and creativity of designs are allowed and
encouraged by Lessor. It is the intent of these criteria that stores maintain a show
window concept for store front design and therefore, tenants are encouraged to
maximize the use of glass as a basic storefront of material.
The Lessor shall have absolute right of review and approval over all aspects of
Lessee improvements within the leased premises, especially display and presentation
appearance at all times. The Lessor may, at his discretion, waive of any of the
design criteria as long as the concept, quality and character of the project are not
significantly affected.

1. Floor

Lessee may use vitrified tiles, granite, wood parquet, marble or carpet
flooring.
If Lessee selects to make a storefront setback from the lease line, Lessee
shall install flooring material identical in quality, color, and pattern to the
mall flooring within the area extending from the lease line to such new
storefront line.
Lessee may use frameless glass with top and bottom rails with
fluorocarbon aluminum frame powder coated or analok finish. (Verify with
mall administration on the allowed finishes for frames)
Satin or mill finish is not allowed.
Plinths and zocalos are not allowed except for slope frontages/entrances.
The completed floor finish/covering materials must be consistent with the
mall floor finish level.
In case the shop occupies two or more levels, provisions for vertical
access, including all adjustment and relocation of the utility provisions,
shall be at Lessees account. Structural design has to be approved by the
Lessor.

2. Walls

For new CHB partitions, Lessee shall provide stiffener columns & lintel
beams.
Use metal framing and plaster board as alternative materials for wall
partitions. Wood nailers and other combustible materials are not allowed.

3. Storefront

Storefront width of 5.00 meters or less;


* Minimum entrance width of 1.0 meter.
* Maximum entrance width of 50% of the storefront width.
* Maintain an entrance height of 2.40 meters
Storefront width of more than 5.00 meters;

* Minimum entrance width of 1.80 meters.


* Maximum entrance width of 50% of the storefront width.
* Maintain an entrance height of 2.40 meters.

Entrances shall have a minimum distance of 1.00 meter from neutral pier
(Verify minimum distances depending on store location.)

No projection of storefront is allowed beyond the lease line.

All glass panels used in conjunction with storefront works shall have
fluorocarbon coated frame or its equivalent.

All glass panels shall be tempered and have a minimum thickness of one
and a half (1/2) inch or 12 mm.

Corner spaces shall have a minimum of two openings. (Verify minimum


openings depending on store location)

Maintain existing storefront with aluminum slats and standard height of


signage band required by the Lessor.

4. Ceiling
One manhole shall be provided for maintenance purposes. Specifications:
0.60 x 0.60 meter opening with padlock access only to Lessee.
Suggested materials are fiber cement board, gypsum/plaster board;
metal linear ceiling; high quality perforated metals; various creative ceiling
systems or any non-combustible ceiling materials are encouraged.

The Lessee will shoulder all expenses to be incurred on all safety


requirements as recommended by Lessor and on safety consultant if this be
deemed necessary.
The Lessee is required to install extra sprinkler heads as per design by
Lessors Safety consultants.
Ceiling height shall vary according to area level, as stated below:

Location of aircon diffusers and sprinkler heads should be reflected in the
ceiling plan. Lessee shall provide access panels for service to the Lessors
and or Lessees equipment and or facilities, and all connections to Lessors
services and facilities above the ceiling level within the premises.

5.

Doors
Lessees are encouraged to adopt an open front concept for storefront. The use of
roll up doors is then required. Other specifications are as follow:
Maintain an entrance height of 2.4 meters.
Viewing slots for roll-up doors should be provided with a standard height of 1.50
meters from the finished floor line.
Viewing slots maybe optional, if store fronts are fifty percent (50%) glass.
Provide rigid anchorage / hangers for roll-up doors.
For spaces where building roll-up doors are located, the Lessee is not allowed to
construct or obstruct the maintenance access located inside the leased premises

6.

Signage
6.1 General Requirements

Drawings must include full dimensions, font/text styles, colors,


materials used, thicknesses, lighting type, mounting details, ballast &
transformer location/access, and placement. Signage drawings should be
scaled on storefront elevation.

All Lessee storefront entrance/store identification designs shall be subject


to Lessors approval.

All permits prior to signage installation must be obtained by Lessee.

All signs shall be constructed, installed and maintained at Lessees
expense.

6.2 Design Requirements

Signage bands shall have a standard height of 0.80 meter. (Please


note that on newly renovated mall, please refer to the accompanying
drawings as reference since this height may vary.)

Signage of all tenants located at the mall fronts should have


signage at same length of their entire frontage.

All texts of the signage shall have a maximum height of 50 cm.


(Please note that on newly renovated mall, please refer to the
accompanying drawings as reference since this width may vary.)

Only the LESSEEs trade name and logo shall be placed on the
signage band. Logos printed on the glass storefronts are not allowed.

Texts and Logos shall only occupy a maximum of 50% of the


secondary signage fascia.

No sign, advertisement, notice or other lettering shall be exhibited,


inscribe or affixed on any part of the storefront except as specifically
approved by the Lessor in writing.

Lessee shall have identification signs designed in a manner


compatible with the overall design concept of the Mall and as an integral
part of the storefront design.

Imaginative designs are encouraged.


6.3 Signage should be incorporated in the following locations within the leased
area:

Behind the glass storefront : Horizontal Bands ( Lessee to verify


allowed locations and heights in Mall Signage Guidelines/ Drawings)

Freestanding within the Lessees space

6.4 Signage Types The following signage types are allowed:

Metal Cut Outs, Backlighted


Acrylic Cut Outs, Backlighted
Stencil cut Plexiglass letter, Backlighted.
Raised Letters Metallic Finish or Solid Color
Other unique signs for consideration of Lessor

6.5 No exposed conduit, tubing or raceways, as well as conductors, ballast,


transformers and other equipment shall be permitted.
6.6 For neon lighted signages, a High Voltage Transformer should rest above the
steel plate, HV cable penetrating the wall, and that the ceiling should be
properly insulated (using glass tubing). All transformers should be located
away from combustible material.
6.7 All signs, bolts, fastenings and clips shall be of hot-dipped galvanized iron,
aluminum, stainless steel, brass or bronze.

6.8 No sign-makers labels or other identification shall be permitted on the


exposed surface of signs except those required by local authorities.

Electrical

B.1 Electrical Provisions


Lessor shall advice the location of the tapping point. For calculation
purposes, the electrical allowance for leasable space is 24 watts per square meter.
All additional loads in excess of 24 watts per sqm. shall be submitted for approval
by the Lessor.

Each leasable space is supplied with 230 volts electrical line.

Lessee shall provide its own electrical sub-meter with Calibration
Certificate from Energy Regulatory Board.

All power shall be made available up to the pull box only located in each
rentable space.
Feeder lines shall be provided for cash registers. Internal wire
interconnection shall be at Lessees account.

Food Tenants are provided with normal power: 3 Phase, 230 Volts, for
general lighting, power & HVAC requirements
7.
Non-food/small tenants are provided with normal power: 24 watts/sqm.
for general lighting, power & HVAC requirements .

B.2 Electrical Design Criteria


1.
All methods of wiring shall conform to the Philippine Electrical Code,
general specifications of the Mall and approved plan for construction.
Electrical load shall not exceed the capacity of the circuit breaker and the
feeder wire designated for the area, otherwise, cost of revisions shall be at the
Lessees expense.

All wiring for power and lighting shall be done in intermediate metal
conduit (IMC) or rigid steel conduit (RSC) of high quality. All pipes should be
provided with supports and hangers.
4.
All telephone and communication lines shall be inside an Electrical metallic
tubing (EMT) (Matsushita Brand or approved equal) with compression type
coupling. All pipes should be provided with supports and hangers.

The minimum size of wire is 3.5mm 2 THHN/THWN (Phelps Dodge,


American Wire or Columbia Brand)

Ballast of the fluorescent lamp shall be rapid start, high power factor type.

All electrical installation shall be provided with insulated green-colored
ground wire and white-colored wire for neutral.

EMT pipe for the cash register.

9.
Provide Security Pilot lights (maximum of 25 watts) inside the area using
PL Bulbs.

Circuit Breakers shall be Bolt-on type.

Sanitary / Plumbing

C.1 Sanitary Provisions


The Lessor shall provide waste stub-out within the leasable area for
restaurants and salons. Other Lessees that require sewer line need approval from
the Lessor.

Actual water and sewage tapping point shall be verified on site.

Lessee shall provide its own water meter calibrated by accredited
agencies. Water meter should be accessibly located.

C.2 Sanitary & Plumbing Design Criteria


Lessees sanitary, vents and domestic waterlines shall conform to the
Sanitary and Plumbing Code, National Building Code, City and Municipal Ordinance
and approved plan for construction.

Water Meter - Water meter should be valved before and after the meter.
Lessee shall provide piping provision for the water meter.

2.

Water Supply Line - All water lines shall be G.I. Pipe and fittings sch. 40
(P.S.). All water lines shall be hydrostatic tested, at least 100 PSI prior to tapping.

Waterproofing - Comfort rooms, kitchen, AC/AHU Room, food handling


and other wet areas shall be waterproofed with a brand approved by the Lessor.
All waterproofed areas shall be flood tested for twenty-four (24) hours to be
witnessed by Lessors representative.

Valves - All water pipes before the fixtures shall be provided with a valve.

Sewer Lines - All sewer/waste lines with kitchen sink and with discharge
greasy waste or heavy oil shall be PVC 1000 Neltex Brand or approved equal.
Lessees sewer/waste line serving non-greasy waste shall be PVC Neltex brand or
approved equal.

Existing Lines - For leased area with existing plumbing installation, the
Lessee shall be responsible for the repair, declogging, resealing of existing sewer
line, vent line and water line up to malls main line.

Grease Traps - All kitchen sink at food area shall be provided with castiron grease traps (METMA or approved brand) with seven (7) GPM minimum
capacity. Grease trap installation shall be provided with vent on its outlet and a
cleanout before the tapping point.

8.

Pipe Hangers - All waste, vent and water line shall be provided with
adequate pipe hangers.

9.

Vents - All fixtures shall be properly vented unless otherwise noted.


Lessees air vents shall use PVC (Neltex, Atlanta, Emerald series 1000 or approved
equal) and shall be connected to the existing centralized air ventilation system.
Installation of new stub-outs for water waste vent shall be approved by the
Lessor.

Drains AC/AHU Drain shall be PVC Series 1000, Neltex, or approved


brand with rubber insulation one inch (1) thick.

11.

Pipe Penetrating Slabs - Pipes penetrating the slabs shall use sleeves/
blackout. The new opening shall be epoxy sealed, properly restored and
waterproofed.

12.

Tests - Lessee shall be required to test all sanitary/plumbing line based on


the standard testing procedure (CWL 150 PSI as pressure test required). Sanitary
stub- out must be gravity tested.

Cleanouts - All sewer lines must be provided with floor cleanouts with
brass plate and must be accessible for maintenance.

14.

Slopsinks - All food based tenants are required to provide their own
slopsinks/ mopsinks.

Structural

D.1 Structural Design Criteria


Minimum height of common CHB wall partition in between tenants is 3.50
meters. For security reasons, tenants are encouraged to install fire rated light

materials above such as steel grills, cyclone wire, and the like subject to Lessors
approval.
Special installation such as vaults, safety deposit boxes and similar heavy
load installation shall be approved by the Lessor in writing.

Special installation such as ACU condenser and Genset shall be approved


by the Lessor in writing.
4.
Channeling or cutting of the structural slabs shall not be permitted within
the premises (except coring of the slabs which shall be subject to Lessors prior
written approval of core size and location).

3.

All proposed CHB wall partitions including stiffeners shall subject to


approval by the Lessor.

5.

6.

Secondary partitions within the leased premises restrict the use of CHB.

7.
Tenants with mezzanine floors are required to submit floor framing plan
and load computation before approval of plans.

E. Communication Design Criteria


Lessor shall provide every leasable space only One (1) Telephone line from
Telephone cabinet direct line. Additional lines will be at Lessees expense.

F. Airconditioning
G.1 Airconditioning Provisions by the Mall
Chilled water will be provided by the Lessor any relocation of chilled
water pipe will be done by Lessors contractor at Lessees account . Lessees shall
be providing their own Fan Coil Units.

Any additional works on the existing airconditioning system of the mall


should have prior approval of the Lessor.

2.

Lessee may request in writing additional cooling capacity. If approved,


Lessor shall undertake the necessary revision at the Lessees expense.

Additional A/C equipment shall be furnished with catalog brochures
indicating its performance rating and electrical characteristics.
5.

All airconditioning design should be checked and approved by the Technical


Department of Pacific Mall Mandaue prior to construction.

All ductwork construction/installation shall conform to the existing code
requirements.
2.

All ductwork insulation shall follow existing duct insulation specifications.

3.
All FCU/AHU should have secondary drip pans. It should lap to the units 6
around the corner.

H. EXHAUST SYSTEM / FRESH AIR


H. 1 Food and Non-food Areas
All odor and moisture producing areas and high heat producing equipment
and appliances must have special exhaust system to prevent the heat, odor, and
moisture from entering the mall and the Lessors air-conditioning system.

All exhaust and fresh air fans shall be provided by the Lessee.

Exhaust air quantities shall be adequate and shall be no less than required
by ASHREA code.
4.
All ductwork construction/installation shall conform to the latest SMACNA
code requirements, and PACIFIC MALL Guidelines and Specifications.
Location of equipment serving special exhaust system shall be designated
and approved by the Lessor.

All fresh air supply shall be adequately designed to prevent the kitchen
odor from getting into all air-conditioned spaces.

Lessor shall provide an exhaust duct in all levels. All kitchen hoods are
Lessee supplied and should not exceed 3 wide x 6 long x 2 height per hood or
18 SF (1.67 SM) face area. Lessee occupying two stalls can have one (1) hood of
equivalent area (18 x 2 etc.).

Exhaust ducts are of heavy-gauged (ga. # 16) black iron sheets of welded
construction joints, and insulated throughout on the outside with 3PCF fiberglass
blanket insulation with aluminum foil backing.
Grease traps with drain valves are evenly spaced for grease removal.

Kitchen hoods take off are provided with fire damper boxes. Lessees are required

to submit all proposed kitchen layout in advance and in writing to the Lessor for
approval.

H. 2 Fresh Air Fan Centrifugal (SWSI) F.C.

Type The units shall be of the centrifugal type completely assembled

as shown on the plans. Submit shop drawing before fabrication and installation.
The unit shall be suitable for outdoor installation.
2.
Capacity The capacity shall be as shown on drawings. The total static
pressure are estimated values and deemed adequate for the purpose of bidding.
This contractor shall verify the static pressure for each unit during actual
operation.
3.
Arrangement of Discharge The arrangement of discharge shall be as
shown on the drawings or as may be approved based on the shop drawing
submittals.
4.
Mounting The fan shall be mounted and supported as shown by the
drawings. The mounting shall be complete with spring vibration isolators.
5.
Construction Shall be constructed of steel or aluminum and all parts shall
be triple coated with baked primer finisher especially formulated to meet
stringent corrosion resistance relative to the units location.

H. 3. Kitchen Exhaust Fan Centrifugal, SWSI, BC


1.
Type The units shall be of the centrifugal type completely assembled
with backward inclined blades, fan scroll, motor, drive, motor mount all
fabricated for installation as shown on the plans. Submit shop drawings before
fabrication and installation.
2.
Capacity The capacity shall be as shown on the plans and drawings.
The total static pressures are estimated values and deemed adequate for the
purpose of bidding. This contractor shall verify the static pressure for each unit
during actual operation.
3.
Arrangement of Discharge The arrangement of discharge shall be as
shown on the drawing or as may be approved based on the shop drawing
submittals.
4.
Mounting The fan shall be mounted and supported as shown by the
drawings. The mounting shall be complete with spring vibration isolators.
5.
Construction Shall be constructed of steel or aluminum and all parts be
triple coated with baked primer finisher especially formulated to meet stringent
corrosion resistance relative to the units location. The fan scroll shall be
attached to the side plates by means of continuous lock seam or welded seam
construction. Intermittent spot welded type construction will not be acceptable.

6.
Fan Wheels The fan wheels shall be backward inclined type preferably
LAU, or similar.
7.
Motor and Drive The motor nameplate horsepower shall exceed brake
horsepower by a minimum of 50 percent and the motor shall be sized to meet
the maximum requirements of the fan based on its performance curve. This shall
be the totally enclosed fan-cooled type.
8.
Disconnect Switch A factory wired non-fused disconnect switch shall be
located near the unit.

H. 4. Ceiling Cassette Type Exhaust Fans


1.
Type The exhaust fans shall be of the built-in ceiling cassette type,
suitable for ducted operation. Sizes and capacities are based on KDK models or
approved equal.
Brand and model indicated herein is for the purpose of establishing product
quality, capacities and dimensions. Other brands satisfying the same shall
likewise be accepted. Submit fan data for approval prior to purchase and
installation.
2.
Capacities The capacities of the units shall be as shown on the plans and
drawings.
3.
Motors and Drives Motors shall be of the compact, moisture proof, dust
proof, dust proof totally enclosed condenser motor type with automated oil
circulation systems for bearing lubrication.

H. 5. Kitchen Exhaust Ductwork


1.
Duct Material The kitchen exhaust air ducts shall be constructed of black
iron Ga. # 16 U.S. Standard gauge.
2.
Duct Workmanship All exhaust ducts shall be constructed and installed in
a permanent manner with the interior of the ducts smooth and free from any
obstruction. All joints shall be welded, flanged with tight gaskets or soldered air
tight. Provide the necessary access ways for grease cleaning at convenient
location complete with air-tight gasket covers. All joist between duct sections
and grease drip-proof. Changes in dimension and shape of ducts shall be
gradual. All ducts sizes shall fall within the limiting dimensions indicated on the
engineering plans, unless otherwise approved. Curved elbows, unless otherwise
specified shall have a center line radius equal to 1.5 times the diameter of the
duct.

3.
Flexible Connectors Whenever the ductwork is connected to fans, or
vibrating equipment, the duct shall be provided with flexible connectors, unless
otherwise specially instructed. Where flexible connectors become necessary, a
non-collapsible type of flexible tubing shall be used. Its length shall be kept to a
minimum and it shall be non-combustible, weather proof and grease resistant.
4.
Duct insulation All kitchen exhaust ducts inside the building shall be
insulated with 50mm thick blanket type fiberglass insulation with aluminum
vapor barrier, 32 kg/cu. M. density. The AC contractor shall also insulate the
transition duct atop the kitchen hoods.

H. 6. Specialty Food Concessionaires


Lessees specialty food concessionaires, must be guided accordingly by the above
and should not exceed to the following allowances for ventilation equipment
provided by the Lessor.

1.

Restaurant A/C as provided by the Lessor is calculated at 0.10 TR per person.

Example: Stall with 5 TR units can cool restaurants for 100 people. (Computation: 5 TR
divided by 0.10 TR/person)

2.

All provisions for kitchen hoods which are Lessee supplied are provided with
kitchen fresh air make-up grills adequate for 90% of exhaust air-hood or 1600 CPM each
from the centralized supply air blower Lessor-supplied at the roof deck to keep the
kitchen pressure negative to present kitchen odor from going out to restaurant A/C
space.

Lessees one or more stall can likewise avail of the quantity of fresh air at 1600
CFM / stalls multiply the no. of stalls occupied.
Example: 2 stalls of equipment head space area of 18 SF x 2 stalls or 36 SF will have
exhaust air available at 1800 cfm / hood x 2 or 3600 cfm / hood and supply
air at 1600 per head x 2 stalls or 2400 CFM, etc.

I. Fire Protection System


1.
During construction/renovation, Lessee is to provide minimum of two (2)
units 10 lbs. capacity of Fire Extinguishers. Number of units required shall
depend on the volume of hazardous materials.
Fire Sprinkler System Any relocation, modification, and additional
installation of sprinkler heads shall be at Lessees account. Lessee shall submit
plans for approval of Lessor.

All Sprinkler work shall be done only by a Contractor with technical
expertise in Sprinkler system installation or have already done Sprinkler works in
any Pacific Mall Complex.

The buildings fire protection system within the tenant space must be
operational at all times during the construction.
In the event of the fire protection system has to be shut off (e.g. pipe
relocation, etc.) prior written approval to the Lessor is required at least two days
prior to the scheduled work.

All means of alarm shall be provided at all times in the construction site.

Cooking is strictly prohibited within the construction site.

Water supply and distribution facilities for fire fighting purposes shall be
provided and maintained in the construction site in accordance with the National
or Local Fire Code.

Sprinkler heads shall be rated at 175 psi, and spaced @ 3.0 m.o.c.

10. Kitchen areas, high temperature storage areas should be provided with
sprinklers rated at 212 degrees Fahrenheit.
11.

Every confined area should be provided with a Fire Sprinkler.

12. Smoke or Heat Detector shall be provided by the Lessee and should be
compatible and linked to the centralized fire protection system of the mall.

Permit to Construct shall be issued by the Lessor after all the


requirements are complied with.

III.

CONSTRUCTION / RENOVATION

Approved plans must always be at the construction site. These plans are considered
the construction plans and must be followed by the Lessees contractor. Any deviation
from the approved plans is considered violation. The Lessor reserves the right to
issue a work stoppage to the Lessee if any requirement is not met.
A. Approvals
1. An approval is required to authorize the Lessees Contractor on any construction/
renovation made on the existing electrical, mechanical (air-conditioning, exhaust and
ventilation, sprinkler), sanitary and plumbing systems of the mall.
2. The Lessor reserves the right to disapprove any request/proposal they find
inappropriate to the overall image of the mall and unsafe to its overall operations.

B. Public Safety
1. Lessee shall confine the construction work within the leased premises and shall
work in an orderly manner; removing trash and debris from the project on a daily
basis and disposing the same to an assigned area outside the complex during a
designated time period. Construction debris will be hauled every night after mall
operation hours.
2. No work or materials shall obstruct the hallways and sidewalks.
3. Mixing of concrete should be done within the leased area, with the use of a
mixing box. Contractors must provide their own containers to be used for water
storage.

4. Lessor shall not be liable for any damages or injuries sustained by Lessee and/or
his workers or any third party during the construction. First Aid Kits must be
available and provided for by the Lessee at the construction site for use in case of
emergency.

5. The Lessors representatives will make routine inspections during construction.


Designated contractors of the Lessee shall take note of observations and instructions
noted by the Lessors representatives.

6. The Lessor reserves the right to issue construction orders based on Lessees
approved plans if it concerns the overall safety and operations of the mall.

7. Lessee shall observe all security and safety measures.


C. Movements, Deliveries and Demobilization
1. Deliveries/Egress activities shall be allowed one (1) hour after mall closure until

7:00 AM. Special schedules are subject to Lessors approval. All supplies and
materials shall be delivered directly to the leased area. Sand and gravel are to be
delivered only in sacks. Contractors must provide concrete mixing box and water
containers. Hauling of construction debris shall be done within the same schedule.
2. Deliveries/egress of all supplies, tools, equipment and any other materials require
a gate pass signed by Lessees authorized representative and approved by Pacific
Mall Administration. The Gate Pass Forms are available at the 4th Floor Pacific Mall
Admin. Guard. The proper permit/pass shall be presented to the guard on duty at
the gates or entrances.

1. Construction hours shall start from 7:00 AM and end at 10:00 PM daily. Overtime
works require written approval from the Lessor. Additional security charges for the
extra hours of the guards on duty shall be charged to Lessees account.

2. In the event the Lessee decides to hire, solicit, engage the services of a private
security guard or watchman agency for its own use, it shall only hire and engage the
services of a reputable agency acceptable and subject to prior written approval of
Lessor. Proper orientation with the Malls security agency should be made. In this
event, it is recommended that the Lessee engage the services of the shopping malls
security agency for mutual protection, coordination and cooperation.

E. Identification System
1. All Lessees contractors/workers are to secure IDs from the Administration at cost.
Contractors must submit a complete list of workers indicating respective positions
together with ID pictures; duly endorsed by the Lessee. IDs must be worn at all
times within the mall premises. Upon completion of the construction, said IDs must
be surrendered.

F. Utilities and Facilities


1. Electricity and water during construction shall be either billed based on actual
consumption (metered) or charged based on estimated computation as agreed upon
by both parties.

2. The Lessee shall shoulder expenses for all temporary electrical fixtures, lights,
circuit breaker, meters, etc. which, will be used during construction.

3. Lessor shall identify the temporary power and water provisions to the Lessee. An
appropriate circuit breaker for the temporary power shall be provided by the
Lessees contractor.
4. All utilities (power and water) shall be turned off after each working day.

G. Prohibitions
The following shall be prohibited within the Lessors premises:
1. People under the influence of drugs, liquor, or other intoxicating beverages.
2. Gambling, loitering and littering.
3. Ambulant peddlers and vendors.
4. Cooking inside the working area.
5. Improper working attire.
6. Public disturbance like shouting, use of indecent words, horseplaying, etc.

7. All works that produce foul odor and unpleasant sound (spray painting, cutting of
tiles, etc.) during store hours.
8. Use of elevators and escalators at any time. There shall be an assigned service
vertical access.
9. Bathing and washing of clothes at comfort rooms and urinating at the jobsite.
There shall be designated comfort rooms for the use of workers during construction
period.

H. Access to the Leased Space


The Lessor or its authorized representative reserves the right to be given access
at any time to the leased space to conduct inspection, repair or do any related
work.
I. Permits, Licenses and Codes

Lessee shall post the Bulding/Renovation Permit on its board-up all throughout
the construction period.

IV.

PRE-OPERATION REQUIREMENTS
A. Final Inspection of Premises
1. Formal Request for final inspection of the leased area by the Administration
shall be done five (5) days prior to any projected store opening to verify if
the space is ready for operation.
2. The Lessor reserves the right to ask the Lessee to construct/renovate any
portion of the leased space that does not conform to the approved plans at
Lessees expense.
3. Lessor has the right to restrain the stores opening depending upon the
degree of deficiencies stipulated in the final inspection report.
J. Permits, Licenses and Codes

Lessee shall secure on his account all government permits and/or licenses as
required by the national and/or city authorities prior to store operations, such as:
1. Certificate of Occupancy
2. Fire Safety Inspection Certificate
3. Certificate of Electrical Inspection
4. Permit to Operate Cash Register

POST-CONSTRUCTION REQUIREMENTS
As-Built Plans - The Lessee is required to submit two (2) sets of
complete As-Built Plans, which will include all Architectural, Structural, Electrical /
Communications, Mechanical and Plumbing drawings wherever applicable.
These plans will be used as reference for any renovation works in the future.

As-Built Plan Formats - The As-Built Plans will have to be in HARDCOPY


and SOFTCOPY formats. The Hardcopy will be in 20 x 30 sheet format and the
Softcopy will be in CD Format, CAD File. Lessee will submit two (2) copies for
