APPROVING
THE
AWARDING
OF
THE
HEREUNDER
PREVIOUSLY VACATED ONE HUNDRED NINETY-FIVE (195)
TRICYCLE FRANCHISES TO NEW APPLICANTS AS SCREENED
AND RECOMMENDED BY THE TASK FORCE KAAYUSAN.

WHEREAS,
pursuant to the provisions of Ordinance No. 02, S.
1999, as amended, otherwise known as the Guinobatan
Tricycle Code of 1999 (GTC 99), a franchise that is
declared vacant and dropped is automatically opened for
new qualified occupants;
WHEREAS,
the Task Force Kaayusan approved about one
hundred ninety-five (195) tricycle franchises for dropping
and was eventually declared vacant and thus, open for
new qualified applicants;
WHEREAS,
the following had been among the applicants that
had been screened and recommended by the Task Force
Kaayusan to be qualified to be awarded of the existing
vacant franchises, to wit:

WHEREAS,
after thorough review and deliberation, the same
were found to be in order and meritorious to the LGU if
said vacant franchises would be awarded to the abovementioned tricycle applicants, duly screened and
recommended by the Task Force Kaayusan;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,
as it is hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to approve as it
hereby approves the awarding of the above-declared
vacant tricycle franchises to the above-named new
qualified tricycle franchise holders, as screened and
recommended by the Task Force Kaayusan, subject to the
following conditions, to wit:
1. That although the above-enumerated new qualified
franchise applicants-awardees have been initially found
to have satisfactorily satisfied the qualifications
provided for by the code, but still majority of them (new
holders) have not totally complied yet the payments
and the parada colors of their tricycles being applied
for, hence, a provisionary Municipal Tricycle Operators
Permit (MTOP) of one (1) month is hereby granted to
the concerned franchise grantees-awardees;
2. That the new tricycle franchise awardees-grantees
must comply their respective deficiencies such as but
not limited to full payment in the Treasury Office of the
required fees and tricycle whole-body painting

according to applied parada, within the 1-month

provisionary period which shall commence on the day
this resolution is signed/approved by the mayor; and,
3. That any of the above-named grantee who shall
remained deficient after the 1-month provisionary
period shall mean an automatic exclusion from the list
of tricycle franchise holders without further notice and
those who shall completely comply the remaining
requirements shall be permanently included in the
official list of tricycle franchise holders of LGUGuinobatan who are eligible to renew every year but
without
prejudice
however,
from
its
cancellation/revocation for cause/s authorized by the
code. All payments made by the grantees who shall
remain deficient after the provisionary period shall be
forfeited in favor of the Municipal Government.
RESOLVED
FURTHERMORE, that the above-named tricycle
franchise awardees/grantees be now informed by the Task
Force Kaayusan of their obligations and the corresponding
consequences that they may suffer in case of violation
thereof as provided for in the GTC 99 and by this
resolution.
RESOLVED
FINALLY, that this resolution be furnished the
Office of the Mayor, Presidents of TODAs, Task Force
Kaayusan Members/Officers, Parada Presidents and all
other concerned persons, for their information and
guidance.
APPROVED UNANIMOUSLY on motion of Councilor Juris L.
Villareal and duly seconded by the members present this
11th day of February, 2013 during their 6th Regular
Session.
