SUMMARY
Californiansaccesstoaffordablelegalservicesisseverelythreatenedbytherisingcostoflawschool.New
lawyersareburdenedwithdebtsthatpreventthemfromofferingaffordableservicestolowandmoderate
incomeclients.Risingtuitioncostsalsoreduceaccesstolawschoolforaspiringlawyersfromlowincome
communities,underminingeffortstodiversifythelegalprofession.
Inresponsetothiscrisis,thereisagrowingdemandforaffordableandpracticebasedlegaleducationthrough
theStateBarsLawOfficeStudyProgram(LOSP).ThroughtheLOSP,aspiringlawyersmaybecomeeligibleto
takethebarexamafterstudyingforfouryearsunderthesupervisionofanattorneyorjudge.Unfortunately,
restrictiveprovisionsoftheBusiness&ProfessionsCodepreventanenormousnumberoflawyersfrom
supervisingaLOSPstudent.Asaresult,arapidlygrowingnumberofaspiringlawyersarestrugglingtofind
lawyerseligibletosupervisetheirLOSPstudy.
Thisbillwould:
Removetherequirementthatsupervisingattorneyshaveengagedinfiveyearsofcontinuouslaw
practiceimmediatelypriortobeginningsupervision,recognizingthatnewlawyersarewellpositionedto
teachbasiclawcurricula,andrecognizingthatthecontinuouspracticerequirementisverydifficultto
meet,giventherealitiesofthelegaljobmarketandvariouslifecircumstancesthatinterruptlaw
practice.
Enableattorneystosuperviseuptofourstudentsatonce,raisingthecurrentlimitoftwo.
Removetherequirementthatallstudymustphysicallytakeplaceinanoffice,giventhatthislimits
learningopportunitiesandputsaparticularburdenonlawyerswithhomeoffices.
RemovetherequirementthatstudytakeplaceinsidethebordersofCalifornia,recognizingan
increasinglymobilesocietyandthegrowthofvirtuallawpractices.
Fixtheproblematicformulabywhichstudentslosestudycreditiftheydonotpassthefirstyearlaw
studentbarexamwithinthreeexamadministrations,sincethecurrentformuladisparatelyimpacts
studentsdependingonthemonthoftheyearinwhichtheybeginstudy.
SAMPLEBILLLANGUAGE
Section6060(e)(2)(B)ofArticle4ofChapter4ofDivision3oftheBusinessandProfessionsCodeisamendedtoread:
InalawofficeinthisstateanduUnderthepersonalsupervisionofamemberoftheStateBarofCaliforniawhois,
andforatleastthelastfiveyearscontinuouslyhasbeen,engagedintheactivepracticeoflaw.Itisthedutyofthe
supervisingattorneytorenderanyperiodicreportstotheexaminingcommitteeasthecommitteemayrequire.The
supervisingattorneymaysuperviseuptofourstudentsatonetime.
Section6060(h)(1)ofArticle4ofChapter4ofDivision3oftheBusinessandProfessionsCodeisamendedtoread:
Havepassedalawstudentsexaminationadministeredbytheexaminingcommitteeaftercompletionofhisorher
firstyearoflawstudy.Thosewhopasstheexaminationwithinitsfirstthreeadministrationsuponbecomingeligible
totaketheexaminationshallreceivecreditforalllawstudiescompletedtothetimetheexaminationispassed.
Thosewhodonotpasstheexaminationwithinitsfirstthreeadministrationsuponbecomingeligibletotakethe
examination,butwhosubsequentlypasstheexamination,shallreceivecreditforoneyearoflegalstudyonlyshall
loseoneyearofcreditforlegalstudy,andmaynotaccumulateadditionalcredituntilheorshepassesthe
examination.
