LEAVE AND LICENCE AGREEMENT
THIS AGREEMENT IS made and entered into at Bhiwandi on this
__st day of _________, 2007;

BETWEEN
________________________________________Hereinafter called the
LICENSOR; (Which expressions shall unless it be repugnant to the
context of meaning thereof deemed to include its executors,
administrator, successor and assigns of the first part).

AND

_________________________________, Age __ Years, Occupation :


__________; Hereinafter called the LICENSEE; ( Which expressions
shall unless it be repugnant to the context of meaning thereof deemed to
include its executors, administrator, successor and assigns of the second
part).

And Whereas, the licensee being in need of the Godown on leave


and license basis to allow to use and occupy the said premises by the
licensor on leave and license basis for a period of ________ commencing
from __/__/_____ to __/__/_____.
And whereas, the licensor has acceded to the request of the
licensee on the terms & conditions hereinafter contained.
Now it is hereby agreed by and between the parties hereto as follows:
1.

That in consideration of the stipulated herein described and the

observance of the terms and agreed by them, the licensor do hereby grant
permission to the licensee to use and occupy the said premises for a
period ___________ only commencing from the __/__/_____

to

__/__/_____.
2.

This agreement shall be for a period of Eleven months only and on

the

expiry

of

this

agreement,

the

licensee

shall

remove

himself/goods/material and servants and all things belonging to him from


the said premises and vacate the said premises without causing any
obstruction or hindrance whatsoever to the licensor.
3.

The licensee shall keep with licensor a sum of Rs. ________/-

towards

Security Deposite without any interest for fulfillments of the terms,


covenants & conditions by the Licensor. (the same the licensor hereby
admits, acknowledges and releases the Licensee forever.)

4.

The licensee shall bear the charges for the electricity bills,

telephone bills and other charges during the period of licence. All such
payments shall commence from __/__/______.
5.

That the licensee shall use the said premises for storage of goods /

material purpose only with his bonafide servant and shall not permit
anyone else to use and occupy the said premises or any apart thereof.
6.

That this agreement shall not entitle the licensee to make or have

claim of tenancy, sub tenancy or any other right, title or interest of


whatsoever nature in the premises or any portion thereof. It is agreed
between the parties hereto that the licensee shall not grant a sub licence to
any other person and shall not keep any other person in place instead of
the licensee.
7.

That the licensee shall not store any hazardous or inflammable

articles in the said premises. The licensee shall not cause any nuisance or
annoyance to the neighbouring people/factory.
8.

That the licensee shall not change or alter whether of temporary or

permanent nature in the said premises or any portion thereof without the
written consents of the licensor.
9.

On the expiry of this agreement the licensee shall handover vacant

and peaceful possession of the said premises to the licensor without any
objection whatsoever.

10.

In the event of licensee fails to hand over vacant and peaceful

possession of the premises to the licensor, the licensor will be entitled and
shall be at liberty to enter into the said premises and retake possession of
the said premises from the licensee without recourse to a court of law
without prejudice to the right of licensor to recover damages from the
licensee. The licensees occupation of the premises after the expiry of this
agreement will be deemed to be that of a trespasser.
10.

In the event Licensor fails to refund the security deposit on

termination of this agreement, the Licensee shall be entitled to remain in


possession without rent till the amount is refunded.
11.

That the licensee agrees and assures to pay Rs. __________/-

(Rupees

____________________________________Only) per month

to the licensor towards monthly licence fees on or before 10th day of


every month during the execution of agreement.
The Exclation in monthly licence fees will be @ _________%
after __ Year/__ months.
12.That it has been agreed that the licensee shall employ his security
personnel for the security of his goods/material stored in the licensed
premises at his cost and risk. The licensor shall not be liable for loss of
goods/ material in any manner like theft/ misappropriation or else.
13.That the licensee shall not use the said premises for any illegal,
immoral or improper purposes.

14.That the said premises having been given on leave & license only, the
licensee shall not deal with it in any manner whatsoever and shall not part
with the possession of the said premises under any circumstances to any
person or persons whatsoever.
15.The licensee shall not be deemed to be in the exclusive occupation
and possession of the licensed premises.
16.This agreement can be terminated by either party by giving one month
notice to other party.
17.The Licensee shall pay Rs. ______/-(Rupees _______________ Only)
