Tony,
I know first-hand what it is to have an adult son who is a drug addict and wrecking his life.
Hence, I for one am not particular in favour of drug dealers. However, I oppose the death penalty
in general and view it is at times an easy way out. Our problem is we have a prison system too
nice for serious criminals as like a resort style of conditions where recently a rapist/murder was
glad to be back behind bars. Being in prison should be a deterrent and if one is to consider
rehabilitation it is that those convicted of serious crimes such as rapes, armed holdup, murder,
drug dealing, to mention a few, are given hard labour prison terms.
The (Russian) BLACK DOLPHEN kind of prison system for serious offenders I view is more
likely to have a rehabilitation affect in that they do not get television and internet services, or
other niceties often pensioners cannot afford.
Pensioners could die and for years left rotting away without anyone bothering about them.
Prisoners have a 24 hours care system. Pensioners may die due to lack of ability to afford in time
appropriate medical services (Hence my 82 year old wife persist with private health insurance
just in case) whereas prisoners are getting often the best of services.
Pensioners often have to do without appropriate meals whereas prisoners have protests if the
meals are not to their demands and liking.
What we need is not a prison system that so to say put prisoners in cotton balls but that they must
suffer consequences for their wrongdoing, appropriate to the severity of their crimes.
Having stated the above and knowing what Julie bishop stated in the Parliament it is obvious to
me that the Federal Government opposes the Indonesian government to execute the 2 of the Bali
9 drug organisers.
But I also may notice that the Australian Federal Police who I view betrayed our national
opposition to alert the Indonesian Government have not been dealt with appropriately. One has to
ask why not?
I understand that Scotts fathers lawyer had contacted the Australian federal Police but did the
AFP make clear to Scott that they were alerted of possible drug smuggling and so he better not
proceed with it? After all that on itself may have resulted to the planned drug smuggling to be
aborted?
Also, the AFP should have insisted that any cooperation with the Indonesian authorities had to be
upon the basis no death penalty would be applied.

even if he is ordered back to the U.S. to face another trial, he'll still have multiple appeals under Dutch law.

Again U.S. attorneys say they won't seek it now, because the Dutch would never hand him over, given
Europe's ban on capital punishment. And one has to question why no AFP member was held liable
for basically handing over suspected criminals to face a likely death penalty?

In my view the Federal Government ought to make clear to the Indonesia Government that the
AFP acted in violation of Australian legal principles opposing the death penalty and were the
Indonesian Government execute Australians then all and any further cooperation must be in
writing that no death penalty will be applied upon any person as to which the Australian
authorities assist, and may be convicted.
I understand that the Indonesian President is referring to the death of people in Indonesia but as I
understand it this was not relevant to the Bali-9 as they sought to export from Indonesia and as
such even if they were to have been successful then still no Indonesian lives would have been at
risk.
What is important is that the Australian Government review all treaties of cooperation
with any other country to ensure it includes that a criminal convicted will not be executed.
And any official who willingly and knowingly cooperate with a country that imposes the death
penalty will face a mandatory minimum of 10 years imprisonment if by his/her unauthorised
conduct to provide details that may lead to a person being executed. The time for nice ties for
ignorant authorities is over!
In my view give them hard labour so others will be deterred to such a life, but executions are not
the way to go and I view barbaric.
I personally would ban anything to do with Indonesia as a protest if they proceed with executing
Australians. I may make clear I oppose any execution of any person! In my view hard labour is
more appropriate and a better deterent.
