Dear Ms. Simmons,

For a research study we are conducting on view preservation ordinances in
California, and pursuant to California Government Code section 6250 et seq., we are
requesting that the City make the below-described documents available for inspection
and copying:
1.
All documents pertaining to the number of people who have utilized the City of
Oakland's ("City") Municipal Code Chapter 15.52.90 application process to resolve view
preservation/restoration claims between 2009 and the present.

2.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims that have been filed with the City between 2009 and the
present.

3.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims that have been filed with the City between 2009 and the
present that have resolved through the use of mediation.
4.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims that have been filed with the City between 2009 and the
present that have resolved through the use of arbitration.
5.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims have been filed with the City between 2009 and the
present that have not resolved through the use of mediation or arbitration, and have

proceeded to a formal hearing at the planning commission or similar municipal body,
i.e., tree equity board, tree commission.
6.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims that have been filed with the City between 2009 and the
present that have not resolved through the use of mediation or arbitration, or at a formal
hearing at the planning commission or similar municipal body, i.e., tree equity board,
tree commission level, and have proceeded to a formal hearing before the Oakland City
Council.
7.
All documents pertaining to the number of applications to resolve view
preservation/restoration claims that have been filed with the Citybetween 2009 and the
present that have not resolved through the use of mediation or arbitration, or at a formal
hearing at either the planning commission or similar municipal body, i.e., tree equity
board, tree commission level, or at the City Council, and have proceeded to litigation.
8.
A list of all current fees associated with the City's view preservation/restoration
program.
9.
The name of the person most knowledgeable about the City's view
preservation/restoration program.
Please advise me of the estimated date and time when the records will be made
available. If possible, I would prefer to receive the documents in electronic form (i.e,
PDF) in lieu of inspection and copying.
