Winter Weather and Wage and Hour and OSHA Concerns Weathering the Storm - Wage and Hour and OSHA, Reminders As the Northeast braces for more winter storms, the following guidance to may help employers navigate wage & hour issues arising from potential closures, as well as workplace safety issues related to severe winter weather. Wage and Hour Issues for Weather-Related Closings The effect of a weather-related closure on compensation requirements varies for different types of employees and also varies by state. Exempt Employees Most employees who are exempt from federal overtime requirements and paid on a salary basis are not subject to reductions to their weekly salaries because of a closure. Even if an exempt employee misses a full day of work, the employer may not reduce the employee's weekly salary (unless the employee misses an entire work week). Employees who do not have enough accrued vacation or PTO to cover the closure, however, must still be paid their full weekly salaries Read More HR Library & Important News Measles Outbreak Raises Compliance Questions The measles outbreak may stay confined primarily to southern California, but employers still aren't prepared to deal with infectious diseases, Howarc Mavity, an attorney with Fisher & Phillips in Atlanta, told SHRM Online. Employers have been caught off guard even though the legal issues are the same as with the severe acute respiratory syndrome (SARS), avian flu, HIN: flu and Ebola scares. Southern California has a higher rate than elsewhere in the country of people who have not been vaccinated, making the area more vulnerable to the virus, Mavity said, California has an “odd law" that lets parents opt out of vaccinating their children, and southern California is home to a high percentage of those wh have opted out. "Plus, there has been an influx of people who are new to the country who have not been vaccinated," he added. There have been about 110 reported cases of measles, Mavity said. According to the California Department of Public Health, 42 of the confirmed cases have been linked to an initial exposure in December 2014 at Disneyland or Disney California Adventure Park in Anaheim, Calif. Five Disney employees were among the confirmed cases. Mavity called measles, "the Arnold Schwarzenegger of viruses." It is hardy, capable of surviving in the air or on a surface up to two hours, he remarked The virus can be contagious four days before and four days after symptoms appear, he noted. Even if no medical information was compromised, information concerning current or former members’ enrollment in health insurance or information about members’ health claims from a TPA generally qualifies a: protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). This is true even if neither diagnostic codes nor other sensitive information is included among the identifying information. If a plan participant's name, Social Security number, address or other identifying information were compromised while held by an insurer or TPA, that would constitute a breach for purposes of the Health Information Technology for Economic and Clinical Health (HITECH) Act and HIPAA. In such a situation, state-level breach notification laws also are likely to be implicated.
