Please ensure that you read the terms and conditions of the International Student Written Agreement very carefully. It contains
important information about your course(s) including costs, refunds, your rights and obligations, and the grounds upon which your
enrolment may be deferred, suspended or cancelled.
This Agreement constitutes a formal offer to you for admission into the course at Victoria University.
If your offer includes one or more conditions for entry into a course, you will not be able to accept this offer until these conditions
have been met. Any conditions are specified in Section 5 of this letter.
To accept this offer, you must sign a copy of this Agreement and pay the fee deposit outlined in Section 8. Please ensure that you
return the whole document. Once this has been done, the terms of this agreement will be a binding legal agreement between you
and Victoria University.
Victoria University will then issue you with an electronic Confirmation of Enrolment (eCoE). You will need this eCoE to apply for a
student visa to Australia. Do not apply for a student visa until you have received your eCoE.

Study periods at Victoria University are known as semesters. There are two compulsory semesters each year. Non-compulsory
study periods may be offered by the University in November/December. Semesters do not apply to ELICOS students.

To accept this offer you will need to sign the Student Acceptance Declaration at the end of this Agreement and return every page
of this document along with any information requested, including evidence that the Tuition Fee Deposit has been paid.

10. REFUND POLICY


The Refund Policy can be found in Appendix A of this Agreement and a copy can also be found at http://www.vu.edu.au/courses/feesassistance/refunds/international-refunds . It is important that you read the policy to ensure you are familiar with the circumstances that refunds will
or will not be processed.

11: GENERAL CONDITIONS AND STUDENT RESPONSIBILITIES


1.

As a Victoria University student, you are bound by the Universitys statutes, policies and rules, including the Student Charter:
http://www.vu.edu.au/about-us/vision-mission/student-charter. Breaches may result in your enrolment being suspended or cancelled and
this may affect your student visa.

2.

You must commence each course on the start date specified in this agreement and on your eCoE. Failure to start on this day will result
in your eCoE being cancelled in accordance with the ESOS legislative framework. This may result in your student visa being cancelled.

3.

You must comply with all student visa conditions. This includes maintaining satisfactory course progress and, for VU English students,
maintaining at least 80% projected attendance for the duration of your eCoE.

4.

You must advise the University of any change of address in Australia within 7 days.

5.

You must not work more than the 40 hours each fortnight when your course is in session, but may work unlimited hours during formal
holiday periods. Holders of a Postgraduate Research (subclass 574) visa who have started their course have unrestricted permission to
work. Work is not guaranteed and any work that you undertake must not impact on your studies.

6.

You must attend classes during compulsory study periods. Intermission can only be taken during study periods if approval has been
granted by Victoria University International. Approval is granted only for compassionate or compelling circumstances. Students who fail
to obtain approved intermission during compulsory study periods may be refused re-entry to Australia by the Department of Immigration
and Citizenship (DIAC).

7.

Your enrolment may be cancelled if you do not return to study following a holiday period or approved intermission; due to, misbehaviour
or failure to pay tuition fees by the specified due date. Further details about the Universitys procedures for deferment, suspension and
cancellation of studies are provided on our website at http://www.vu.edu.au/international-students/visa-and-enrolment-variations.

8.

You must maintain a full-time enrolment. A full-time enrolment for higher education students is at least 48 credit points. TAFE students
must average at least 20 hours per week over a semester with no less than 36 weeks in an academic year

9.

You are required to participate actively in all classes and any agreed additional English language or academic support in order to
improve your English language proficiency over the course of your studies.

10. You are liable for the payment of any units of study that must be repeated as a result of academic failure.
11. To avoid incurring a debt to the University, tuition fees must be paid by the due date specified on invoices issued by the University each
semester.
12. If you incur an outstanding debt (eg tuition fees or library fines), your enrolment will be encumbered until the debt has been paid in full.
The encumbrance will cause the following restrictions to apply:
i.
Loss of access to library borrowing and other library services;
ii.
Loss of access to Victoria Universitys computer systems, including internet and email;
iii.
Loss of access to enrolment records, examination results and academic transcripts, and
iv.
Inability to graduate or receive your award until the outstanding debt is cleared.
13. Changes to your study program after the Victoria University census date (31 March for Semester 1 and 31 August for Semester 2) will
incur financial penalty.
14. If you wish to defer your commence date or change your course preference form, please go

15. If you wish to transfer to another institution, you must obtain a letter of release from the University if you have not completed six months
of your principal course of study. Principal Course means the highest level qualification specified in this agreement, please go to

16. If you apply for a student visa under Streamlined Visa Processing (SVP) arrangements and seek to transfer to a course that is not
covered by these arrangements, you may be required to make a new visa application to continue to study in Australia.
17. If your student visa application has been refused, a new eCoE will not automatically be issued. Evidence of the reason for refusal needs
to be supplied to Victoria University International and your request for a new eCoE will be considered.
18. If you are under 18 years of age, you must maintain adequate arrangements for your accommodation, support and general welfare
during your stay in Australia. You must not change these arrangements without prior written approval from Victoria University
International.
19. In accepting this offer to study at Victoria University in Australia, you agree that you have the financial means to support yourself and
any dependents for the duration of your studies specified in this agreement, at a level no less than the total tuition fees stated in this

agreement and the minimum annual living costs recommended by the Australian Department of Immigration and Citizenship (DIAC)
which is currently $18,610 per annum.
20. As part of the Streamlined Visa Processing arrangements, the Australian Department of Immigration and Citizenship (DIAC) may
request evidence that you have sufficient financial means to support yourself and your studies for the duration of your stay in Australia.
You cannot rely on income earned from part-time employment to reduce the level of funds required for tuition fees and living costs.
21. Any school-aged dependants accompanying you to Australia must attend school and you are required to pay full fees for the course
whether they are enrolled in a government or private school, which involves a minimum cost of $8000 each year.

12: STUDENT RIGHTS AND BENEFITS


1.

As an international student studying at an Australian campus of Victoria University, your interests are protected by the Education
Services for Overseas Students Act 2000 (ESOS Act). Details of the ESOS Act are available on our website at
https://aei.gov.au/regulatory-information/pages/regulatoryinformation.aspx .

2.

Victoria University offers guaranteed accommodation to international students who accept their offer within 3 weeks of the date on this
letter. The Student Village and Victoria Place are the options available as part of this guarantee. For detailed information, including
associated costs and application procedures, please visit http://www.vu.edu.au/campuses-services/student-support/housing-finance/vuresidences.

3.

If you experience academic, English language or personal difficulties at any time during your enrolment, you are able to access Victoria
Universitys full range of academic, English language and/or welfare services at no additional charge.

4.

This Agreement and Victoria Universitys complaints and appeals processes do not preclude a student from taking other legal action to
recover any fees paid, including a debt action in a court of law, nor do they remove the right to take further action under Australias
consumer protection laws. Victoria Universitys complaints and appeals processes can be found at http://www.vu.edu.au/studentlife/getting-help/student-complaints-resolution.

13: PRIVACY STATEMENT


Victoria University is committed to the responsible collection and handling of your personal information in accordance with all relevant legislation,
including the Information Privacy Act 2000 (Vic) and the Health Records Act 2001 (Vic). The personal information collected on this form will be used
for the purposes of assessing and processing your application and managing your enrolment.
Your personal information may be disclosed to Commonwealth and State Government Agencies pursuant to reporting obligations under applicable
Australian legislation. Your personal information will also be disclosed to your overseas student health care provider and, if you are under 18 years
of age, to the carer appointed for you under the National Code made under the Education Services for Overseas Students Act 2000. Your
information will not be disclosed to other third parties without your consent.
You have a right to access personal information that Victoria University holds about you. See Victoria Universitys Privacy Policy for details, which
can be accessed at http://www.vu.edu.au/privacy. Details of course progress will be shared with parents or guardians where the student is under 18
years of age, and with any sponsors of a student.
In the event that Victoria University requires information regarding your student visa entitlements, you agree to Victoria University accessing your
student visa information through the Australian Department of Immigration Citizenships online Visa Entitlement Verification Online (VEVO) system.

Appendix A
INTERNATIONAL STUDENT REFUND POLICY
6.0

POLICY

6.1

FULL REFUNDS

6.1.1

A Student will be entitled to a full refund of Tuition Fees paid for a semester at VU in the following circumstances:
(a) In the event that an offer is withdrawn by the University;
(b) In the event that the University is unable to provide the course. In this situation, new commencing Students will also be
eligible for a refund of the application processing fee;
(c) Where a Student was unable to meet a condition required by the University in its letter of offer, and is able to prove that
they did not actively fail to meet that condition;
(d) Where a Student has been excluded by the University for failure to meet course progression rules and where tuition fees
were paid in advance of notification of exclusion (the refund in this subclause will be only for those periods of study not
yet started);
(e) Where there is a refusal by the Australian Government authorities to grant a Student visa or the Student visa is not
granted in time for the Student to commence the course;
(f) When illness or disability prevents the Student from enrolling in the course;
(g) When the death of a close family member (parent, sibling, spouse or child) occurs, and the Student withdraws from their
course;
(h) When Political, Civil or Natural Event prevents the acquittal of a fee; or
(i) Other special or exceptional circumstances preventing a Student from continuing with their enrolment may allow for a full
or partial refund at the discretion of the Director (VUI), VU International, or their nominee, provided the request is made
prior to the commencement of the course.

6.1.2

Documentary evidence must be provided in support of an application for a refund under any of the above provisions

6.1.3

Where a condition of 6.1.1 applies and a Student has paid Tuition Fees to study a single unit (or units) of study with VU, that will
not credit towards an award from VU, full refund of Tuition Fees will be issued for such unit(s).

6.2

PARTIAL REFUNDS

6.2.1

A Student who has paid Tuition Fees for a semester, and gives written notice of withdrawal or an inability to study:
(a) Where notice is given at least four (4) weeks before commencement of teaching in that semester, or
(b) Where notice is given at least four (4) weeks before the specified date for commencement of a research program.
will be entitled to a refund of Tuition Fees paid for the semester, less an administrative fee of ten percent (10%) of the prescribed
semester fee
(c) Where notice is given less than four (4) weeks prior to the commencement of teaching in that semester, or
(d) Where notice is given after the commencement of teaching and before census date in that semester.
will be entitled to a refund of Tuition Fees paid for the semester, less an administrative fee of fifty percent (50%) of the prescribed
semester fee

6.2.2

Where a Student has paid Tuition Fees to study one or more units, which will not credit towards an award from VU, a partial
refund will be issued as according to 6.2.1(a) and (b) above, for the prescribed unit fee(s).

6.2.3

Where a Student's enrolment has been cancelled for non-payment of course fees, any partial payment made by that Student will
be refunded, less an administrative fee of ten percent (10%) of the prescribed semester fee.

6.3

NO REFUNDS

6.3.1

Subject to Clause Section 6.1


(a)

Any Student who withdraws from their course after the Census Date in a semester shall not be eligible for any refund of
Tuition Fees paid for that semester.

(b)

A Student who gives notice in writing of an inability to undertake a course, or withdraws from the course at any time,
will not be eligible for refund of the Application Processing Fee.

(c)

A Student, who accepts an offer for a VU course as part of an agreed Pathway between VU and another education
provider, will not be entitled to a refund of the deposit paid for the VU course.

6.4

INTERMISSION

6.4.1

A Student who is granted an intermission will be subject to the conditions set out in the Clauses 6.2 and 6.3. If requested by the
Student, the balance of non-refunded monies will be retained and offset against the commencing Student fee in the appropriate
semester.

6.5

(a)

The retained balance will be forfeited if the Student does not return to study with VU in accordance with the terms of
their approved intermission.

(b)

The retained balance will be forfeited if the Student does not give notice in writing to VU International, at least four (4)
weeks prior to the commencement of the semester, of his or her inability to recommence the course.

VU ENGLISH
Refund before VU English course start date

6.5.1

Where a Student gives notice of withdrawal no less than four (4) weeks before their VU English course start date, all Tuition Fees
actually paid are refundable upon application.

6.5.2

Where Student gives notice of withdrawal less than four (4) weeks before their VU English course start date, all Tuition Fees
actually paid are refundable, less ten percent (10%) of the total course fee outlined on the Student's offer letter.
Refund after VU English course start date

6.5.3

Where a Student gives written notice of their withdrawal any time after the VU English course start date, this being the start date
on the Confirmation of Enrolment (COE), no tuition fee refund will be given.

6.5.4

A closure of VU English will be regarded as a University default under Clause 3.4 of this policy.

6.5.5

Any notice not given in writing will not be accepted.

6.6

INTERNATIONAL STUDENTS WHO OBTAIN A PERMANENT RESIDENT STATUS

6.6.1

A Student who is granted Permanent Resident status will be eligible for refund of Tuition Fees paid for the semester, less a five
hundred dollar ($500) service charge for the current semester, only if
(a)

The Permanent Resident status is granted on or before the census date for that semester, and

(b)

The Student presents evidence of their Permanent Resident status to VU International (e.g. valid passport containing
visa label).

Permanent resident status is recognised from the date officially recognised by the Australian Department of Immigration and
Citizenship, not the date on which the application for status is made.
6.6.2

A Student who is granted Permanent Resident status after the census date for a semester will not be eligible for refund of Tuition
Fees paid for that semester. The Student will be classified as an international Student for the remainder of that semester.

6.6.3

A Student who is granted Permanent Resident status prior the census date in a semester will lose their full-fee Student place and
must re-apply for course entry in competition with other course applicants for government-funded places.

6.6.4

A continuing Student who seeks to become local fee-paying domestic Student following a grant of Permanent Resident status,
may have their pre-paid Tuition Fees carried over in the appropriate semester.

6.7

OVERPAYMENTS

6.7.1

Where Student makes an overpayment of Tuition Fees, the overpaid amount will be refunded upon application without financial
penalty. The amount will be returned to the Student as a cheque to the Student's address in Australia. A memo is required from
VU English to support English Language overpayments.

6.8

REVIEW PROCESS RELATED TO FEES REFUND

6.8.1

A Student who is dissatisfied with a decision relating to a refund application is entitled to request an appeal through VU
International, by submitting a written request. The Student must submit the request within twenty (20) working days of written
notification of the decision.

6.8.2

VU's complaints and appeals processes do not preclude the Student from taking other legal action to recover any fees paid,
including debt action in a court of law. Furthermore, it does not remove the right to take further action under Australia's consumer
protection laws.

6.9

PAYMENT OF REFUNDS

6.9.1

Refunds will be processed by VU International within four (4) weeks of receiving a completed Refund of International Student
Fees Application Form and any other required supporting documentation.

6.9.2

Approved refunds will be paid in accordance with the following circumstances:


(a)

Refunds will be made payable to the Student (unless otherwise requested in writing). The refund draft will be made
payable in Australian dollars and sent to the Student's permanent home country address. The refund will only be made
available to the Student in Australia if the Student provides evidence that they are able to remain in the country without
studying.

(b)

Where the tuition fee has been paid by a sponsoring body or scholarship agency, any refund payable will be made to
the sponsoring body or scholarship agency.

(c)

Where a Student is transferring to another institution, the refund will be paid directly to the new institution, unless the
Student can provide evidence of having paid the tuition fee to that institution (e.g. COE from the new institution).
Where a Student requests that the refund is made payable to a relative or other person in Australia, this will only be granted if
documentary evidence proves that the relative or other person paid the Tuition Fees
