REQUEST FOR LEGISLATIVE AUTHORITY FOR THE CITY MAYOR TO
ENTER INTO AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT
OF DAVAO THE MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN
ALSONS DEVELOPMENT & INVESTMENT CORPORATION (ALSON DEV)
AND THE CITY GOVERNMENT OF DAVAO RELATIVE TO THE
ESTABLISHMENT OF 911 SATELLITE OFFICE IN CABANTIAN, DAVAO
Background
1.
This pertains to the memorandum of understanding between Alsons Development &
Investment Corporation (ALSONS DEV, for brevity) and the CITY GOVERNMENT OF DAVAO (CGD,
for brevity) relative to the establishment of 911 satellite office in Cabantian, Davao City.

Highlights
2. This is a preparatory contract to be entered into between ALSONS DEV and the CGD.
Essentially, the parties agree to establish a 911 satellite office in the Cabantian area.
After this
Memorandum of Understanding is signed, the parties will enter into a Memorandum of Agreement
to iron out the details and, eventually, a Deed of Donation will be executed by ALSONS DEV in
favor of the CGD.
3. Barangay Cabantian is located in the inner suburb of Buhangin District, Davao City. It is far
from existing government community support facilities.
4. ALSONS Dev agrees to work in partnership with government agencies in establishing such
facilities in the said area to provide better accessibility and extend quick response to the needs of
the Cabantian community and the neighboring barangays.

5. ALSONS DEV shall donate a lot containing 500 square meters, more or less, adjacent
to its Northtown Project for a satellite 911 station.
6. ALSONS DEV, according to its allotted budget, shall construct the structures in
accordance with the specifications. The plans are to be prepared by the CGD through its
City Engineers Office. It will secure the necessary permits before construction thereof.
7. ALSONS DEV will likewise donate one (1) unit ambulance for the use of the 911.
8. The CGD shall provide the required equipment and manpower to operate the satellite
station. It shall also operate the satellite station and take charge of its maintenance.
9. Any land and building taxes and other fees associated with usage and operation shall
be for the account of the CGD.
Recommendations
11. This Committee recommends the approval of this legislative item. The Committee
further recommends the passage of a resolution entitled A Resolution To Enact An
Ordinance Granting Legislative Authority To City Mayor Rodrigo R. Duterte To Sign For And
In Behalf Of The City Government Of Davao the Memorandum of Understanding (MOU)
Between Alsons Development & Investment Corporation (ALSONS DEV) and the City
Government Of Davao relative to the establishment of a 911 satellite office in Cabantian,
Davao City.

A RESOLUTION TO ENACT AN ORDINANCE GRANTING LEGISLATIVE AUTHORITY TO CITY

GOVERNMENT OF DAVAO RELATIVE TO THE ESTABLISHMENT OF A 911 SATELLITE OFFICE
IN CABANTIAN, DAVAO CITY.

emergency resources of the government on a 24-hour basis anywhere within the territorial
jurisdiction of the local government unit of Davao City;

NOW THEREFORE, be it resolved as it is hereby resolved to enact an ordinance granting

legislative authority to City Mayor Rodrigo R. Duterte to sign for and in behalf of the City
Government of Davao the Memorandum of Understanding (MOU) Between Alsons
Development & Investment Corporation (ALSONS DEV) and the City Government Of
Davao relative to the establishment of a 911 satellite office in Cabantian, Davao City.
RESOLVED FURTHER, that copies of these resolutions to be enacted be furnished to the
Office of the Secretary to the Sangguniang Panlungsod, City Mayors Office, Alsons
Development & Investment Corporation and all other offices/departments concerned, for
their information and guidance.

AN ORDINANCE GRANTING LEGISLATIVE AUTHORITY TO CITY MAYOR RODRIGO R.
DUTERTE TO SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF DAVAO THE
MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN ALSONS DEVELOPMENT &
INVESTMENT CORPORATION (ALSONS DEV) AND THE CITY GOVERNMENT OF DAVAO
RELATIVE TO THE ESTABLISHMENT OF A 911 SATELLITE OFFICE IN CABANTIAN, DAVAO
CITY.

Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled

that:
SECTION 1. TITLE This ordinance shall be known as AN ORDINANCE GRANTING
LEGISLATIVE AUTHORITY TO CITY MAYOR RODRIGO R. DUTERTE TO SIGN FOR AND IN
BEHALF OF THE CITY GOVERNMENT OF DAVAO THE MEMORANDUM OF UNDERSTANDING
(MOU) BETWEEN ALSONS DEVELOPMENT & INVESTMENT CORPORATION (ALSONS DEV)
AND THE CITY GOVERNMENT OF DAVAO RELATIVE TO THE ESTABLISHMENT OF A 911
SATELLITE OFFICE IN CABANTIAN, DAVAO CITY.
SECTION 2. DECLARATION OF POLICY - Section 455, (b) (1) (vi) of the Local
Government Code provides, to wit:
For efficient, effective and economical governance the purpose of
which
is the general welfare of the city and its inhabitants pursuant to Section 16
of this Code, the city mayor shall represent the city in all its
business
transactions and sign in its behalf all bonds, contracts, and
obligations,
and such other documents upon authority of the
Sangguniang Panlungsod
or pursuant to law or ordinance;
SECTION 3. MEMORANDUM OF UNDERSTANDING The Memorandum of
Understanding is a preparatory contract to be entered into between ALSONS DEV and the
CGD. The parties agree to establish a 911 satellite office in the Cabantian area.
After
this Memorandum of Understanding is signed, the parties will enter into a Memorandum
of Agreement to iron out the details and, eventually, a Deed of Donation will be executed
by ALSONS DEV in favor of the CGD covering the a lot containing 500 square meters,
more or less, adjacent to its Northtown Project for a satellite 911 station, the building,
and one (1) unit ambulance for the use of 911.
SECTION 4. AUTHORITY The City Mayor Rodrigo R. Duterte is hereby granted
legislative authority to sign, for and in behalf of the City Government of Davao
memorandum of understanding between Alsons Development & Investment Corporation
(ALSONS DEV) and the City Government of Davao relative to the establishment of a 911
satellite office in Cabantian, Davao City.
SECTION 5. SEPARABILITY CLAUSE If for any reason, any section or provision
of this ordinance is declared unconstitutional or invalid, other sections or provisions
hereof not affected by such declaration shall continue to be in full force and effect.
SECTION 6. EFFECTIVITY
immediately upon approval.
