Dear Sir,
The above captioned work amounting to Rs.837,875,050/- with a completion time of 24
Months, reckoned from 01-02-2009 was awarded to us vide your Acceptance Letter No.
379/DE/MDA dated 26-01-2009.
According to the stipulation of contract, we have mobilized with our full fledge workforce
along with allied equipment at site w.e.f 01-02-2009, with the aim to start the work with full
zeal and zests.
It is worth mentionable that still process of the acquisition of land proposed for scheme has
yet not been taken up and the same could not be handed over to us to start the work. With the
result, our workforce and equipment have to stand idle at site of work. The detail of our
machinery and staff will be submitted latter on.
However, the keen interest and sincere interaction of MDA with the land owners regarding
taking over possession of land is regarded with great appreciation. Nevertheless we would
like to submit further that the arrangement of possession, free of any encumbrance, of the
entire land required for the said scheme may be made without breaking stride at the earliest
so that the work could be started at site and financial burden impact due to the idleness of the
firms sources may be avoided/minimized please.

REQUEST FOR REMOVAL OF HINDRANCES AT SITE

Dear Sir,
With reference to our letter No. SARCO/MDA/966 dated 24-02-2009, we have since stand
mobilized at site to take up to stipulated work. Even on lapse of one month, still we have not
been handed over a considerable space except only 18 acres land to start the work physically
at site. That very area of 18 acres is consisted of an old and thick mango garden through
which it is not possible even to take up precise survey what to say of execution of work. The
big tall trees of mango are the hindrance in the work.
It is further pointed out that in the said construction area of scheme, there exists a high level
water course full of running water being a root cause of stagnant water received from
perculation or deliberately cut over the land to be surveyed, hence is also a hindrance in the
working area.
Due to the reasons as mentioned above, we are facing physical hindrances in the execution of
work. It is therefore requested that pursuant to the contractual obligations, the necessary
effective arrangements for removal of mango trees of heavy girth, demolishing and shifting
of water course may kindly be made at the earliest so that we may proceed further without let
or hindrance.

In response of your letter No. 301/EE-II/MDA dated 06-03-2009, we submit that it is well
known to your goodself and your field staff that we stand mobilized since 01-02-2009 and we
also acknowledge the possession of a parcel of land of 18 acres out of 360 acres which comes
only to 05% of the required land.
In this regard, your kind attention is invited to our Letter No. SARCO/MDA/ dated
04-03-2009 wherein we informed your good office about the physical obstructions being
faced in commencement of work in the area acquired so far.
We once again state that the even the survey work is impossible to be carried out at site what
to speak of start of earth work etc.
At present the major obstructions are:

Trees of heavy girth of mango garden.


Marshy area because of overflow / cut of water courses running in the area.

It is therefore, repeatedly requested that pursuant to the contractual obligations, the above

that the procurement of NOCs from the concerned department are the legal obligations.
It is therefore requested that the concerned departments like Irrigation, Forest and Local
Govt. etc. may be approached to obtain the NOCs so that the works of different nature,
which are just going to be started in such areas may not be interrupted during the
construction.
We hope that in this regard, a prompt action would be initiated well-on-time to avoid any
complicacy arisen later on please.

The above referred work amounting to Rs. 837,875,050/- with 24 months of completion time
reckoned from 01-02-2009 was allotted to us vide letter No. 379/DE/MDA dated 26-01-2009
issued from office of Director Engineering MDA Multan..
Your attention is invited to a major item i.e. Earth work for making embankment. Originally
cost of this item is estimated based on the lead of 5 miles. But on contrary to provision of
estimate, no borrow area is available within this lead. As per our findings, the borrow areas for
suitable soil are available a distance of 12~16 miles from site of construction.
At the prevailing circumstances, the cost impact of this very heavy item on account of
incorrect lead would arise as worked out on MRS-IV 2008 under here:Haulage cost for 5-miles lead:

We, very regretfully, express here that uptill now neither we have been responded for our
grievances detailed in the above mentioned letters nor any of the site problems is resolved at
yet. We once again submit that for expeditious acquisition of construction area, the process
may be accelerated. It is also learnt from reliable sources that the compensation of property of
locals has yet not been paid to the concerned persons. If the information is correct, then it is
quite evident that possession of land will be abnormally delayed and the work could not be
started physically at site for a long span in future.
For supply of Construction Drawings which is within the purview of your good office,
preferably a serious consideration is solicited.
In view of facts stated above, we once again submit that all the grievances we are facing since
the day-one are standing unresolved. The same may kindly be got resolved at an early date so
that we may come in a position to take-up an encumbrance-free start and proceed onwards
without further loss of time and money in the best interest of project please.

Dear Sir,
In response of your above letter, we like to submit as under:1. Our survey team and MDA field staff could have jointly executed the following survey
item since the last 2 months time:a. Southern boundary of scheme was demarcated with help of square stone located
in area near Phase-I of the scheme.
b. RL value of Bench Mark already established in Phase-I, was carried to the
southern side of the scheme.
Except the minor operations of survey work as mentioned above, no any significant survey
work could has been carried-out at site because of physical obstructions yet prevailing at site.
The same are once again briefly explained hereunder:i)

Due to existence of mango trees sighting of objects is impossible.


Due to non-permission to enter upon in the most of areas of scheme all kinds
of work are held-up.

Contrary to informational contents of your letter as referred above, no possession except only
5% of area exists at site. Your information imparted in the said letter, seems based on some
wrong speculations/misunderstandings, thus it is not possible to take over any kind of work at
site until and unless obstruction-free construction area is acquired.
Under the circumstantial conditions prevailing at site, we like to suggest your good office that
an urgent meeting may kindly be called for resolution of the impedimenta being faced in
physical start of work at site so that the wastage of further time and money be avoided.

Dear Sir,
In context with the above cited references, we like to submit as under:1-

Removal of Mango Trees in the available area has recently been under taken by the
auction holder, employing insufficient labour, thus the progress of site clearing is very
slow. Anyhow our work-force is covering the site immediately by making
embankment for road network in Block-J of the scheme. The work is expending
accordingly as soon as the working areas are being made available to us.

According to the verbal instruction of worthy Director Engineering MDA, on 21-04-2009, we


intended to take possession of surrounding/adjacent land by entering upon by means of heavy
machinery. In reaction, the land owners are adopting the tactics of letting their areas to be
flooded daily as a barrier to enter-upon.
The re-location of the water-course running through the construction area as earlier solicited vide
our letter No. Nil dated 04-03-2009 is the best solution of such nuisance created by the locals.
The latest circumstantial conditions prevailing at site are hereby brought in your kind notice
for timely redress of the inconvenience being faced by the company since the day one of our
mobilization.

Dear Sir,
In context with the above cited reference, we state that in view of the verbal instruction of
worthy Director Engineering MDA, on 20-04-2009, to take possession of surrounding/ adjacent
land by entering upon by means of heavy machinery. Yesterday we succeeded in entering upon
in a land strip situated near the land already acquired. Some mischievous persons claiming
themselves yet uncompensated, interrupted with violent attitude and misbehaved with our
working staff. They threatened the worker and warned for serious consequences if the
machinery is not withdrawn from their land forthwith. Our crew was enforced to turn back.
Today, too, the same action and reaction was revealed as happened on yesterday. The most of
the land owners were alleging for payment of compensation of their properties. The affectees
were adamant not to allow any entry till their dues are not cleared.
The incidents happened in presence of field staff of MDA who was also helpless to tackle the
situation.
In addition, it is further stated that removal of auctioned mango trees is very slow, thus
hindering the work badly.
In the light of the latest circumstantial conditions prevailing at site, we once again request for
timely and effective remedial measures to be taken against the obstructions, so that the work
could be taken up with full swing progress for timely completion and to avoid financial loss
being born by the firm regarding idleness of staff and machinery etc.

IMPACT OF LOAD CONTROL ON MATERIAL PRICES

Dear Sir,
Above referred contract was awarded to us vide letter No. 379/DE/MDA dated 26-01-2009
issued from office of Director Engineering MDA Multan. While bidding for this project, we
quoted our price based on the input material prices prevailing in the market.
Now in previous week, NH&MP (National Highways & Motorway Police) has implemented
axle load limits for trucks plying on roads. This restriction has forced the trucks to lower the
load what they carry in daily routine. In consequence, this has led to hike in prices of
transportation especially for quarry materials to the extent of Rs. 600/- per %Cft, thus causing
a substantial increase of Rs. 6000/- per truck-load.
Since this situation has resulted into an unpredicted financial burden to us, we hereby request
to your good office for compensation of this cost impact.

Please recall that above referenced project was allotted to us vide your office letter No.
379/DE/MDA dated 26-01-2009.
Now in this respect for issuance of cheques from MDA against our due payments, we hereby
submit that:
1- All payments should be made by issuing cheques in favour of M/s Sh. Abdur Razzaq
& Co. (Pvt) Ltd. like Mobilization Advance payment (Bill # 1 & 2), Bill # 03 and Bill
# 04 payments (copy of 4 No. cheques enclosed). OR
2- For payments against workdone for sewerage work items 100 to 117 & 121, cheques
may be issued in favour of N.A. Builders as we have already agreed mutually on date
08-12-2009 (copy enclosed).
OR
3- All future payments be made by issuing cheques for 75% amount in favour of
M/s Sh. Abdur Razzaq & Co. (Pvt) Ltd. and for 25% amount in favour of M/s N.A.
Builders as per respective share in joint venture (copy enclosed).
In view of the best interest of the project and to keep good relationships with all stake holders
we hereby submit our agreement to accept any of the above mentioned three options. This is

Dear Sir,
It is submitted that for above cited scheme, we since the date of commencement to date have
been handed over 65 % of entire working area. In this working area, the earth work of roads
net work has almost been completed by us. Our unit of labour and equipment deployed on
earth work of roads is going to be idle within a weeks time or so.
Now it is requested that we may kindly be informed about handing over of the
remaining 35% areas or otherwise should we demobilize our said unit from the site of work
as we cant afford it sitting idle.
Your are requested for an early response in this regard so that we may proceed further
accordingly please.
