Reference to our subsequent discussion and the Architectural drawings
provided by us on the aforesaid project.
2.
We have prepared this proposal considering the complete fabrication and
erection at your site, only the raw materials will be transported by road from
Guwahati to your site at Doimukh , Arunachal Pradesh for fabrication.
3.
We sincerely hope that you would find our offer suitable and most

BUILDING SPECIFICATIONS. The entire work shall be carried out
all as per the architectural drawings provided by us and structural drawings
and details provided by us in this proposal duly approved by you.
2.
SCHEDULE OF WORK. The following Items form part of this
proposal. The Quantity and dimension given here shall be measured once
work is done and there may be some variation. The total amount shall be
worked out on material actually executed on ground.

PARTICULAR SPECIFICATIONS. The work shall be carried out as
per the working drawings prepared by us . However for certain details if not
included in drawings, the sound engineering practice shall be followed.
3.1.
Type of Contract. The rates are quoted for the main structure, and
miscellaneous works. They are as under:3.2.
Main Structure. This is a weight measured contract where the
rates are quoted per unit kg. of the construction. Fabrication of all the
steel structure as per approved structural drawings supplied by us.
Fabrication will be done by using arc welding. The total fabrication shall be
carried out at your site and only the raw material shall be supplied to the
site for fabrication and erection purposes. However some fabrication and
joining shall be done at site. Supply of the Painting Material of the
structural items will be at o u r scope. However the painting work will be
carried out by RDMPL as per the clients requirement.

3.3.
Miscellaneous Work. The weight measured contract is covered
for all additional and miscellaneous items such as staircases, all additional
members for fixing wall panels, glass panels, false ceilings, sign boards,
valley gutters, rain water drop pipe from valley gutter etc not shown in
drawings.
3.4.
Any change made at later stage in architectural drawings that is affecting the
structural design, the rates per kg. duly quoted are deemed to be changed. Any
additional work projected during currency of the contract shall be measured and paid
extra as per rates mutually agreed upon.
4.
GENERAL CONDITIONS OF CONTRACT. This Proposal, once signed by
the Client, will be considered as contract between the two parties. They are the
Client and RDMPL.
4.1.
Mode of communication: The concerned Engineer in charge of RDMPL will
directly communicate with the client for all the issues related with the Project. However,
if required, the signatories of this proposal will communicate with the client or viceversa. Client to confirm his consultant( if any) for proper communication with RDMPL
as and when required for smooth functioning.
4.2.
Schedule of Stores. Stores to be supplied for the work shall be as per the
drawings and specification of each work. The store and the storage space will be at
clients scope for all items required in executing the entire work till the completion of the
project. For cement and other perishable items store shall be arranged separately
which is not part of this proposal.
4.3.
Schedule of Tools and Plants. The schedule of tentative T&P shall be as

4.4.
Schedule of Transport. All the material, labours and T&P shall be
transported by R D M P L to the working site. The fabrication site shall be
located From site of erection of the building as mutually agreed.
4.5.
Working Period. The labour working hours are from 0900 hrs to 1700 hrs.
Sunday and other holidays will remain off days from working. However, in order to
progress the work and meet the time schedule, RDMPL may work extra hours
including at night and on holidays. The electricity arrangement in such cases shall be
made by the Client.

4.6. Water & Electricity. W a t e r & Electricity for the F a b r i c a t i o n , E r e c t i o n ,


a n d o t h e r r e l a t e d work at site a n d a t t h e l a b o u r s h e d f o r d r i n k i n g a s
w e l l a s f o r w a s h i n g p u r p o s e s shall be provided by the Client. The electricity
shall be required for operating of T&P such as the welding machines, cutting
machines, water pump etc.
4.7.
Platform for Truss Layout. There is a requirement of suitable hard leveled
surface preferably concrete flooring for the purpose of centering the truss layout. The
same shall be provided by the Client.
4.8.
Erecting of Trusses. For the purpose of erection of truss, the clear
area below is required. The same shall be kept free from stores/material etc.
4.9.
Cooperation with Other Agency. Invariably there will be a need of
coordinating with the other working agency at site. In such cases, the nodal
in- charge shall be appointed by the Client for liaison and smooth progress of the
work.
4.10.
Accommodation for Labour. Accommodation a n d a r e a for the
labour shall be provided by the Client. The security of the material, machineries
and manpower will be joint responsiblity of Cli.ent and RDMPL ( The security for
materials,machineries and manpower will at client scope at site.)
4.11.
FORCE MAJEURE. Neither party shall be considered in default in the
performance of their contractual obligations under this agreement, as long as such
performance or delay for reasons by such act of God, as Severe
earthquake, Cyclone (except monsoon), Floods, Lighting, Landslide, Fire,
Explosions, Plaque or epidemics, Wars, Riots, Invasions, Act of foreign enemies,
Hostilities, Rebellion, Revolution, Insurrection or military usurped power,
Confiscation or trade embargoes, Destruction or Requisition by order of any
Government or public authority.
4.11.1. All other circumstances beyond control of the parties. All contractual
obligations of the parties hereto shall remain suspended during the period of Force
Majeure
4.11.2. It is agreed that in case both the parties are prevented from fulfilling the
contractual obligations by a state of force majeure lasting continuously for period of
2 weeks, the two parties shall consult each other regarding the future
implementation of the agreement. The mere shortage of labour, materials or
utilities shall not constitute force majeure unless caused by circumstances,
which are themselves force majeure.
4.11.3. Both parties shall endeavor to prevent, overcome or remove the cause
force majeure.
4.11.4. The potential risks to the project also arise from electricity failure at
the Client site, Social unrest at the regional level or Heavy rainfall affecting the
progress of the work at site

4.13. Cancellations. Both The Parties cannot cancel the order without first reaching
an agreement in writing. If cancellations or modifications are agreed by both the
Parties, a mutually agreed expenses to be paid.
4.14.

Site Facilities. The Client shall arrange to provide all basic amenities like

accommodation, water, toilet and lighting at site for the contract team. Moreover, all
basic infrastructures like power and lighting should be provided from source till the
erection area without any charge. Power at site has to be provided by the Client.
Security of workers & materials has to be provided by the Client. The supplier shall
not be responsible for arranging any of these necessities and the responsibility for
arranging for these shall be of the Client alone.
4.15.
Governing Laws. This agreement shall be construed and enforced in
accordance with and under the laws of the Government of India. Both parties agree
that in any case of any difference or dispute between the Client and RDMPL will be
resolved by mutual discussion. However, unresolved issues, if any, will be settled by
arbitration as per the Indian Arbitration and Conciliation act, and the venue of the
arbitration will be Guwahati, Assam.
5.
EXCLUSION: The following are not considered in this proposal. However,
the quotation for such work can be given on demand.
5.1.
Floor finish on ground floor.
5.2.
Wall finishing paints etc.
5.3.
All partition work.
5.4.
All false ceiling, paneling, partition wall and glass work.
5.5.
Mechanical and electrical appliances and fixtures.
5.6.
Architectural services.
5.7.
All civil work.
5.8.
Painting of extra work.
6.
PRICING AND VALIDITY. The prices are quoted as in Para 2 for the various

Running/Progressive Bill: The payment should be released after


verification from client Engineer after
submission of running bill.

8.
