COUNT 2 That the Defendant, SADIE GWENDOLYN REDBEAR, in Minnehaha County, State of South Dakota, on or about the 19" day of AUGUST, 2011, then and there did commit the offense of Manslaughter in the First Degree in that the Defendant did without design to effect death, and in the heat of passion, but ina cruel and unusual manner, kill a human being, DANIEL TUCKER EASTMAN, in violation of SDCL 22-16-15(2), contrary to the form of the statute in such case made and provided and against the peace and dignity of the State of South Dakota, and prays that the said Defendant may be arrested and dealt with according to law. AFFIDAVIT IN SUPPORT vs. . OF ARREST WARRANT Sadie Gwendolyn Redbear “Ea C5 DOB 8-31-1981 (Li [Ss o> Defendant. Michael Webb, being first duly sworn on oath, deposes and states that he is a Detective of the Sioux Falls Police Department and states that he is one of the officers in charge of the investigation of the above-styled matter. That your Affiant makes this Affidavit in support of the State's Attorney's request for a warrant for the arrest of the above-named Defendant(s), and in compliance with SDCL 23A-2-2, and states as follows: 4. On 8-19-2011 at 0710 hours Officers were dispatched to the alleyway behind 633 S Main Avenue for a subject who appeared to be stabbed. While the caller was on 911 they advised the subject went unresponsive. When Officers arrived they found blood in the alleyway and a victim who was identified as Daniel Tucker Eastman DOB 9-5-1953 with stab wounds to his abdomen. He was transported to the hospital by ambulance. Sioux Falls Police Department case number 11-54681 was filed in this incident. 2. Doctor Garrett Taylor at Avera Hospital told Officer Burtis #835 that the victim had stab wounds to his chest and abdomen. Officer Burtis was able to speak with the victim before he was taken to surgery and the victim stated he did not know who stabbed him or would not answer. It was noted the victim appeared intoxicated and was not communicating. 3. Responding Officers found blood on the alleyway, on driveways, and against fences and posts behind 628 and 634 South Dakota Avenue. Officers were speaking with neighboring residents who advised that around 0200 hours there were some Native Americans in that area that were drinking and being ‘netapp2usersSuhensleyMCSAO\Crim Cases\Potetial Charge Cates\Redbear, Sadle\Sacie Redbear Aves! Mtiavit docloud. One witness, Terrance Flaggs, identified the victim as one of the males. He also identified another subject as Timothy Brandt. 4. Another neighbor Maynard Hart stated around 0200 he heard a male and female arguing in the alleyway. 5. Detective Schaefer #618 spoke with a subject who identified Sadie Redbear, the defendant, as a person who hung out with the victim, A female named Jodeen Rebird contacted Police to say that the night this occurred, the victim Daniel Eastman was with Sadie Redbear and a male named Dakotah. She stated they all got into a van and left the area together. 6. The victim's ex-wife, Patricia Eastman, was spoken to and immediately stated that “Sadie” must have done it. She told Detective Gearman #748 that Sadie beats the victim up all the time. She advised that the victim and defendant have been in an on/off relationship for the past two years and it has a history of being violent. 7. The defendant was located on 8-20-11 and when approached by Officer Stevens #801, she put her head down and started crying and said | think that you're looking for me. Detective Carda #609 spoke with the defendant at the Law Enforcement Center, She stated she last saw the victim on Friday, August 19, 2011, and she was in an alley drinking with him, She stated she then left him, Detective Carda noted that the defendant was very intoxicated when he was speaking with her. 8. Detective Gearman had been checking on the vicitm’s status over the next few weeks. On 9-8-2011 the doctors advised that the victim was able to speak and Detective Gearman spoke with him on that day. He stated he had been drinking heavily and did not remember what happened. He did state he was with Sadie Redbear that night. He advised he did not remember where he was that night, and does not remember being stabbed or going to the, hospital. 9. Detective Carda spoke to the defendant again on 11-9-2011. She stated she was with the victim the night he was stabbed. She described her relationship with the victim as “friends” but they have had sexual relationships at times. She also said she was with a male named Dakotah. She said they got some alchohol at Get n Go at 14" Street and Minnesota Avenue and eventually she parted ways with these subjects and left the area. 10.Detective Gearman spoke again with the victim on 10-13-2011. He stated again that he was with Sadie that night but doesn't remember getting into an argument with her. He also stated that she wasn't with him when he got stabbed. He then stated Sadie had something to do with it, but didn't elaborate why he would say this. 11.On 11-16-2011 Detective Gearman was advised that the victim's condition had worsened and there was a chance that he may die from his injuries. 12.0n 11-18-2011 Detective Gearman was notifed that the victim had died from his injuries. That same day a autopsy was performed by Dr. Kenneth Snell. He concluded that the cause of death on Daniel Eastman would be complications as a result of the stab wounds and the manner is Homicide, 43.On 11-27-2011 Officer Krahn #832 was approached by an individual who had information regarding the stabbing. This information led to Travis Dustin Wainright DOB 1-28-1972. Wainright stated that approximately four weeks prior, he spoke with Sadie Redbear and she told Wainright that she had stabbed Daniel Eastman. 14. Detective Gearman also identified the male named Dakotah as Dakotah Dillon Jeunesse DOB 6-21-1993. She spoke with him on 2-9-2012. Dakotah stated he was with Sadie Redbear and Daniel Eastman and described being in the aforementioned van with them. He also spoke of being in the alley by 14" Street and Dakota Avenue. Dakotah stated that there “could have been” an argument between the defendant and victim. Dakotah told Detective Gearman that he did not murder anyone. 15.On 2-10-2011 Dakotah Jeunesse was interviewed again and while Detective Gearman was out of the room, Dakotah is heard on camera saying “there goes my life thanks to some drunken §§88 who wanted to beat up her old man”, and for something that he “didn’t do". He then told Detective Gearman “she killed him not me, I'm going to tell you that right now, I'm not \netape usersSuhersieyMICSAOICrin Cases\Poteria Charge Cases\Recbear, SadelSacie Redbeat Arrest Aida docgoing to sit here when she is the one who killed him or beat him I'm not going to sit here and get my future destroyed”, 16.On 2-15-2012 Detective Gearman again spoke with the defendant. She again stated she was with the victim and Dakotah that night, but stated she left by herself. 17.On 3-14-2015 Detective Pat Mertes #822 was approached by Robert Gene Stover DOB 10-5-1967. Stover stated he was there that night and witnessed what happened, He told Detective Mertes he was intoxicated that night but, witnessed what occurred and it was a “rage thing’. He stated that he was drinking in the alley with these subjects and the defendant stabbed the victim in what he described as a “bum rush’, He demonstrated that the defendant had the knife in her right hand and made an underhand motion as to how she ‘stabbed him. Stover did note numerous times that he was very intoxicated and this is what he believes he saw. 18.On 3-24-2015 Detective Mertes interviewed Dakotah Jeunesse again, Dakotah stated he was concerned because he witnessed what happened and believes he will be in trouble also. At one point he told Detective Mertes what do you want to know. Dakotah stated he was hanging around Sadie during this time period. That night they were drinking in the alley. Dakotah states he had very litle to drink and was able to give specific details. He said an argument started between Daniel Eastman and Sadie Redbear about having more to drink. At one point Dakotah stated he got between them to break them up. 18, Dakotah stated they continued to argue and Sadie had a knife in her right hand and started to stab the victim. He stated that the victim was not attacking or provoking the incident at that point he had his hands up by his sides and the defendant stabbed him 4 times with both an underhand and overhand motion. He stated he and the defendant left the area and ended up spending the night in a garage where Dakotah had been sleeping in the area of the stabbing. The next day he and Redbear went to different locations and eventually parted ways. He was able to draw a map of the location prior to arriving, and both the map and his account of the incident at the location did match the case facts 21.On 3/26/15 Detective Mertes met with Defendant Redbear at the Law Enforcement Center in interview room #1. He advised that she would be able to leave after the interview. At 0907 hours Detective Mertes read Miranda Warning which she advised that she was going to talk to her attorney Kenny Jacobs first. The defendant was then allowed to leave the Law Enforcement Center. 22.Allof the above events did occur in Sioux Falls, Minnehaha County, South Dakota.
