Logan Davidson murder trial.
For those of you that think he got
away with it, consider living the rest of
your life knowing that youd taken a life out of
anger this will haunt Meza in vastly different
ways throughout every stage of his life,
especially if he ever has kids of his own and
hes still facing jail time. As for the Davidson
family, no verdict can provide any relief for the
pain they endure every day nothing short of
Logan coming back can do that. Per TX Citizen
newsroom policy regarding tragic events, we
did not contact either family for comment. Nick
Rogers has the full story on page 4.

4-B Contracts Real Good
As yall know, we requested every contract
New Braunfels 4-A and 4-B Boards entered
into over the years. Heres the list of businesses
as provided to us by City Hall - were
not including parks, street and drainage
projects, arts and heritage projects and any
number of economic indicator payoffs to
consultants studies this time around. Please

short. Where are the contracts for Silver State
Helicopters? Grande Communications? New
Braunfels Smoker? And those are just the
ones we know are missing - we have no idea
how many others City Hall failed to get to
us after $500 and multiple delays. Plus we
only got one contract for The Scooter Store,
even though we know they had several. How
are we supposed to hold 4-B accountable for
its stewardship of taxpayer funds if we cant
inspect all the oh. We get it now.

2015 paper, regarding the tuition difference
for CTTC students based on whether one lives
in New Braunfels or San Antonio, the author
states that the tuition for New Braunfels students
is Nearly 60% more than the SA rate.

I'm not goOd at making plans. I like thinking of my freE time
like jazZ. There's a basic skeleton to give it some structure,
but mostly I just make it up on the spot. New Braunfels is the
perfect place to do that because there's always something
going on. Like this Saturday, we alL get to enjoy a smorgasbord
of craft beErs at the Craft BeEr Festival. Fortunately, I
live within walking distance, which is especialLy
convenient because that puts me within walking distance
of another event worth exploring that very same day:
Longshot Wine Bar's ribBon cutTing ceremony! Stop by
on your way in or out of the beEr fest and enjoy some of
our own craft wines, pitchers of sangria, shaved ice
for the kids, margaritas for the big kids, live
music, and delicious foOd from Teka Molino. There
wilL be an outdoOr stage set up and a lineup of musical
guests including GaretT Endres and the GaretT Endres
Band. I'lL even be playing a few tunes myself. We're

Decision Reached in
Canyon High Murder Case

The jury in the Canyon High School punching


death trial settled for convicting the defendant
with misdemeanor assault, rejecting prosecutors
calls for either murder or manslaughter.
They thought murder was a reach, said
the defendants attorney, Joseph Garcia, who
spoke with the jury after the verdict. They
asked why there wasnt some other charge,
such as aggravated assault.
Aggravated assault, which is a felony,
wasnt included in the States charges.
Garcia had requested that Judge Charles
Stephens add a misdemeanor assault charge.
Stephens agreed, prompting an appeal from
prosecutors. The Third Court of Appeals ruled
that Stephens acted properly.
When asked if he thought the jury
would have chosen aggravated assault if that
option been available, Garcia said the jury
indicated that they would have seriously
looked at that charge.
In November, 2013, the defendant
punched 15-year-old Logan Davidson twice
in the face as Logan exited a classroom,
causing his classmate to die from a lacerated
vertebral artery in the neck. The defendant
said he did so to get Logan to back off.
Witnesses testified that the day before the
incident, Logan hit the defendant in the crotch,
leading the teen to shove Logan. On the day of
the attack, witnesses testified that the defendant
had told Logan to stop your shit, after which,
Logan threw an eraser at the defendants face.
Video of the incident shows the defendant
ambushing Logan outside the classroom.
After a brutal first punch, Logan turned to
the wall, whereupon the defendant grabbed
Logans backpack, spun the victim around in
order to land an equally-brutal second punch.
After the second punch, Logans head hit the
wall and he collapsed, unresponsive. He
died the next day.
During closing arguments, Garcia said
that his client reacted as many others would
to such harassment, and that Logans death
was a tragic accident.
What do you tell your children or
grandchildren to do when someone doesnt

know when to stop? Where do you draw


that line? Garcia argued. Everyone in that
classroom who testified said that Logan didnt
know when to stop. How many times does
someone need to be told to stop? You can only
run so far before youre backed into a corner.
Garcia the jury concurred with his argument
that his client had no intention of killing Logan.
The State is throwing the book at him
and saying, Lets see what sticks, Garcia
said during closing arguments. What would
a teenager know? Would a teenager know
that hitting someone would cause a tear in
a vertebral artery? Would a teenager even
know what a vertebral artery is?
Murder seems so far over the top that
its almost a joke, he said.
The State, however, took exception to
Garcias comments.
The Defense says its everybody elses
fault. It was Logans fault. It was (the teachers)
fault. The only person at fault is sitting in that
chair, lead prosecutor Tiffany Leal said,
pointing to the defendant.
During her closing arguments, Leal laid
out her reasons why the defendant committed
murder, saying that the motive was retaliation;
that intent was shown when the defendant
said he was going to get Logan; and that
the incident was pre-planned because the
defendant took off his backpack as he waited
for Logan, and that others knew the attack was
coming because their cell phones were out.
The respondent is aggressive and
doesnt stop until Logan is on the ground,
she said. He grabs Logans backpack to
pull him around to square Logan up for the
second punch. He had to have known that
hitting someone repeatedly in the head would
cause serious bodily injury. That second hit
was beyond sending a message.
This case is about the murder of
Logan Davidson, she said during closing
arguments. This is not an assault because an
assault ignores the fact that Logan is dead.
Because it is a juvenile case, Judge
Stephens will assess the punishment on July
2. The defendant could be released on
probation, or serve time in jail.

calculation came about (knowing that you

things up) and concluded that somebody
divided 480 by 1172 and came up with
.409556..... However, although this method
of ciphering is a way of figuring what
percentage the SA rate is as a proportion of
the NB rate (presumably, the Nearly 60%
more statement assumes that the .409556
number - the SA proportion of the NB rate
- is a little more than 40%, so the NB rate is
nearly 60%), it does not express the NB rate
as a percentage of the SA rate. ]]]
If NB rate was $480 then it would be
100% of the SA rate; but the $1,172 amount
is more than 244% of the SA rate.
Not only is this more accurate, it
is also more in line with the point of the
ridiculousness of the disparity based on the
amount of money that locals are contributing
to Alamo Colleges.

of experience. Not publishing experience,
though - according to his HZ bio hes got

Sarcoidosis Awareness Day! Keith Pevoto dyed his beard and

We celebrated Cinco de Mayo with a


fundraiser for NB Puppy Playland and
Callens Castle - the new park designed for
special needs kids. The Prickly Pear Bar and
Taco Palenque stepped up to host a pair of
competitions: The Texas National Taco Eating
Championships and the Texas National
Margarita Mixing Championships. Much cash
was raised for the parks, a veritable ton of
prizes were raffled off, hundreds of free
Taco Palenque tacos were consumed, and
two new Texas National Champions were
named. All in all, a great night. A big thanks
to everyone who came, participated, and
sponsored, especially Dan at the Pear and

Is it over?

After seven grueling games in the first round


against a championship-caliber Los Angeles
Clippers team, the San Antonio Spurs are
now at home, an unfamiliar place in early
May. A Tim Duncan-led Spurs team has failed
to advance past the first round just twice in
seventeen tries and the last time it happened,
in 2011 as a #1 seed against the 8th seeded
Memphis Grizzlies, fans asked the same
question theyre asking now:
Is it over?
That 2011 Spurs team won 61 games,
earned its first #1 seed in 5 years and wasnt
good enough to get out of the first round?
The franchise was 4 years removed from
its last NBA Championship, and the rest of
the league was getting younger and more
athletic. The Oklahoma City Thunder, led by
Kevin Durant and Russell Westbrook were
just getting started. LeBron James hadnt won
his first NBA title yet (he has since won 3).
Stephen Curry was just coming off of his
rookie season in Golden State, Chris Paul
was still playing in New Orleans for what
was known as the Hornets then.
Was it over?
As we came to find out years later: no it
wasnt. Instead, San Antonio made the changes
needed to contend again. But four years ago
it was easier. Duncan was only 35, Manu
Ginobili was 33-years-old, Tony Parker still in his
20s. The Spurs had time to mold to some of their
younger players, namely Danny Green and
Tiago Splitter who were in their sophomore and
freshman NBA seasons at the time, playing a
combined 57 minutes in San Antonios 6-game
loss to the Grizzlies. The Spurs also figured
out that 2 years into the Richard Jefferson
experiment, it just wasnt going to work. Two
players had also played their final NBA games
in Game 6 from Memphis Grindhouse:
Antonio McDyess and Ime Udoka whos now an
assistant under Head Coach Gregg Popovich.
Instead of wholesale changes, the Spurs
made a few tweaks, none bigger than the
trade of the popular George Hill to move up
in the draft in order to take Kawhi Leonard,
who was then perceived to have a bright
future but needed a lot of work on his shot.
They would also later take Cory Joseph late
in the first round of that draft. They added an

unknown point guard from Australia named


Patrick Mills. In the middle of the season, the
Spurs scooped up an overweight, thought to
be uninterested Boris Diaw who played his
way out of Charlotte, a team that would later
set the NBA record for futility in that strikeshortened 2012 season. The Spurs also later
brought back a fan favorite, Stephen Jackson,
whose return to San Antonio was short-lived
(he was cut by Pop right before the end of
the 2012-2013 regular season a year later).
So, in summary: The Spurs drafted two
rookies, signed two pudgy foreign players
who were NBA afterthoughts, and traded
away one of their best young players while
holding on to the underwhelming Jefferson.
The fans perception was one of confusion:
Thats it?
Why didnt they trade Tony Parker
instead of George Hill?
Why in the hell is RJ still here?
Maybe this thing really is over.
The answers: Yes, Yes, It worked out
beautifully for both parties, He was gone
after the following seasons, and It wasnt.
It is now just as it was then: not a time of
panic. The Spurs most recent 1st round loss
came in a series, by the way, for the ages. The
LA Clippers are just as capable of winning the
NBA title as the Spurs were, a rarity for the first
round. The series was so evenly matched, that
after seven games, the finally tally in points
was San Antonio 724, Los Angeles 721. In
the 7th game of the series, the game was tied
with 10 seconds left to play. The LA Clippers
finished literally one made basket better than
the San Antonio Spurs.
The Spurs have money to spend, players
to re-sign (Leonard & Green), possible
retirements to consider (Duncan & Ginobili)
and the draft to look forward to. Theres
certainly a lot of questions now that the
season is over a round or two early, but I can
answer one of them now:
Is it over?
No, it isnt.

young, progressive, educated white
folks at an institution of higher
education in Southern California. The
other day, I mentioned buying a shirt
that reads Illegal immigration started
in 1492. We had a good laugh and
my co-worker, whom I like a lot, said
that it actually began in the Ice Age,
suggesting that no one kind of human
has claim over land or geography.
While I get her argument, I was
stunned. A flippant response like that
diminishes the struggles of people
trying to make a life here, under
adverse conditions, having fled other
adverse conditions, and the systematic
historical exceptionalism mythology,
jingoism, xenophobia and racism that
has created the current state of affairs.

On the Garland Attack


The attack on the art exhibit in Garland,
Texas, sponsored by Pamela Geller really
should have been something that provided
a wake-up call to America and brought
us all together. Instead I see it inspiring a
disturbing trend. More than just a willingness
to capitulate to those who hate us, the trend
seems to be toward an insistence that we
do so. I have a hard time understanding the
mindset behind suggesting that somehow
Pamela Geller is responsible for the actions in
Garland, but the two driving forces involved
seem to be a complete misunderstanding (or
outright dismissal) of our constitution and
history and an ingrained habit of branding
people bigots in hope of marginalizing them.
Im flabbergasted at the speed with
which people jettison freedom of speech
when they dont care for the message. This
is probably my own failing; that people are
hypocrites should come as little surprise at my
age. Still, I had expected more of my fellow
countrymen (even the dumb ones). Though it
shouldnt be necessary that I remind anyone,
let me point out that freedom of speech
is absolutely worthless if it only protects
uncontroversial speech.
Its true that there are some limits to
free speech, but those limits are remarkably
narrow and only apply to the consequences
of the speech in question. No limit is placed
on expression as a preventative. One may
not libel or yell fire in a crowded movie
theater without consequences, but there is
no mechanism for preventing the action
beforehand. (I note this to counter those
who suggest events such as Gellers simply
shouldnt be allowed.) Likewise, one may not
call for violence (though they can support it)
without facing some consequence.
The most common argument against
Gellers actions is that they somehow represent
fighting words. This is language restricted
because it is designed only to provoke and
offers no other value. The fighting words
exemption is based on a single Supreme

Court case (Chaplinsky v. New Hampshire,


1942) and courts across the country have
been backing away from it ever since. It is not
forbidden to burn the flag, use obscenity in
political speech or use racial epitaphs. Even
the actions of the Westboro Baptist Church
have been found to be protected.
What was done at Gellers event was
no different. There is no question that the
language would be objectionable to some,
but to suggest that it should somehow not
be protected because it is offensive is akin
to calling out a rape victim for the clothes
that she was wearing. And, to suggest that
language should need to be approved
beforehand to ensure it does not provoke is
disturbingly totalitarian.
The act of drawing Mohammed is
near perfect in its potential for protest to the
threat we face from Islamic extremists. Yes,
it is insulting and hurtful to any number of
Muslims, but only a maniac completely cut off
from modern culture would see murder as an
acceptable reaction to it. That two Muslims
from Arizona came to Garland with murder in
their hearts is exactly the threat that Geller has
been warning of all along (and why she had
security). That there are some in our media
who seem ready to make excuses for these
two extremists makes me sick to my stomach.
The second thing pushing this sort of
appeasement appears to be the glee with
which the Left in this country have attempted
to brand their political opponents as bigots.
Geller is unquestionably conservative in
her ideals, and she, therefore, makes an
acceptable target (even though, or perhaps
because, she is a Jew). The tactic has proven
so effective at stifling debate that the Left turns
to it reflexively, even in the most ridiculous
of situations: Want to cut taxes? Racist. Think
we should tackle fraud in entitlements? Racist.
Question the Presidents latest hare-brained
scheme? Racist. Use the word thug? Racist.
Thinking about retaliating for 9/11? Racist.
The Left in this country have even gone
as far as to develop their own organization

specifically designed to call out anyone to


the right of Karl Marx: The Southern Poverty
Law Center. When you hear that Gellers
organization has been called a hate group
by some, this is the source.
The Southern Poverty Law Center (SPLC)
is so disingenuous that they have called out
mainstream Republicans and the Tea Party
Movement as hate groups as well. When
your local Republican coffee klatch ends up
on the terror watch list, you can be sure the
SPLC was involved. In fact, if youre looking
for someone likely to rev up the tinfoil hat
brigade, the SPLC would be a good place to
start. Floyd Lee Corkins, the crazy who shot up
the Family Research Council, did so because
the SPLC had them on their list of homosexual
hate groups. Strangely, I cant remember
and suggestion from the Left that the SPLC
should shoulder some of the responsibility.
The Lefts use of the bigotry smear has
become so prevalent that many mainstream
Republicans

find

themselves

calling

out

groups like Gellers as opposed to supporting


them. Even Bill OReilly, chew toy for the left,
distanced himself from Geller after the shooting
in Garland. (Though theres some evidence
that OReilly falls into the first group that
has no appreciation for our constitution too.)
For pundits on the Left the reaction is purely
Pavlovian: they find themselves screaming at
the teleprompter and drooling on their desks
without even considering that they have
aligned themselves with a group that would
slit their throats without a second thought.
America really better start waking up to
the danger it faces from Islamic extremism.
ISIS and its ilk intend to see us all dead. We
are all infidels in their mind (even most western
Muslims). Their rhetoric includes beheading
innocents for propaganda purposes. It might
be worth paying some attention. To them and
to people like Geller.
