the petitioner despite such orders.
It is noted that this application for condonation of delay in
filing the process fee has been titled wrongly as delay in filing complaint
case.

Ans. There is no written procedure earlier. I do not recall since when


was the written procedure applied. In the relevant time in respect of

the present suit, no written letter for appointment was issued to the
employee as the plaintiff organization was a very small one.

Mrs. Bina Jain, when is associated with this AIWC?

Ans. I had been associated with this organization since early of 1960.
Q.

Do you know Mr. Ram Surat Tiwari when joined this

organization?
Ans. I do not remember when Ram Surat Tiwari joined our
organization.

As a licence fees, how much amount have you been charging

from your employee since 2004?


Ans. I do not remember.

Do you have ever inquired that late Sh. Ram Surat Tiwari what

are doing in the day time?


Ans. I do not know.

Why you stopped the services of Mr. Ganga Prasad Tiwari

(defendant no.1) in 2004?


Ans. We had information that defendant no.1 used to bring outsiders
in the hostel and also indulge in nefarious activities such as drinking
liquor etc. which was bad for security of the hostel. Therefore, his
services were stopped in the year 2004.

respondent has, therefore, prayed for waiver of the cost imposed on
the NDMC.
On 03.01.2015, it was observed by the Court that despite
specific direction the respondent did not appoint any responsible
officer to make categoric submissions on appeal on behalf of the
NDMC. A cost of Rs. 1,000/- was, therefore, imposed on the NDMC
and it was further directed that this cost be deducted from the salary of
the person/official responsible for the non compliance of the Court's
order dated 28.08.2014.
In view of the submissions of the respondent in the
application as well as in view of the fact that the appeal is being

opportunity to the plaintiff for this purpose. I shall dispose of this
application on the basis of the record. I have heard the arguments of
Ld counsel for the defendant and have perused the records carefully.
The case of the defendant is that talks of settlement were
going on between the parties and the plaintiff assured the defendant
that he need not appear before the Court and also need not worry
about the next dates and hearing or any adverse order that may be
passed. The plaintiff has denied these averments in its reply wherein it
is mentioned for all talks of compromise took place between the
parties prior to filing of the suit.
No doubt, the Court agrees with the contention of the
plaintiff that it was the duty of the defendant to be careful and find out

what is going on in the case, the Court is convinced that for the just
and proper adjudication of the present suit, an opportunity should be
granted to the defendant to put its defence forth.
In these circumstances, the ex parte order dated
16.04.2014 is set aside subject to cost of Rs. 1,000/- to be paid to
the plaintiff. The application u/O 9 rule 7 CPC of the defendant is,
thus, disposed of.
Let WS be filed within 30 days from today with copy to
the opposite counsel.
