Submitting a list of employees working overseas and a list of employees returning home or
contract termination9
Notice on employment status (from the 20th day of the preceding month to the 20th day of the
month of notice)12
1 According to Article 115 of the Labour Code No. 10/2012/QH13, Foreign employees are also entitled to (*) 01 additional day for their countries traditional public holiday; and (**) 01 additional day for their countries national day
2 According to Article 14 of Circular No. 03/2014/TT-BLDTBXH, the report must be submitted to DOLISA
3 According to Article 20 of Circular No. 32/2013/TT-BLDTBXH, the report must be submitted to DOLISA
4 According to Article 15 of Joint Circular No. 12/2012/TTLT-BLDTBXH-BYT, the report must be submitted to DOLISA
5 According to Article 18 of Joint Circular No. 01/2011/TTLT-BLDTBXH-BYT, the report must be submitted to DOLISA, provincial Health Department and Labour Federation
6 According to Article 20 of Circular No. 27/2013/TT-BLDTBXH, applicable to enterprises providing labour safety and hygiene training services only and the report must be submitted to DOLISA and Ministry of Labour War Invalids and Social Affairs (MOLISA)
7 According to Article 16 of Circular No. 06/2014/TT-BLDTBXH, applicable to enterprises providing occupational safety inspection services only and the report must be submitted to MOLISA
8 According to Article 6 of Circular No 23/2014/TT-BLDTBXH, the report must be submitted to Labour War Invalids and Social Affairs Office at district level or DOLISA (for enterprises in industrial zones)
9 According to Section VI of Circular No. 21/2007/TT-BLDTBXH, applicable to enterprises providing workforce overseas and the report must be submitted to MOLISA. Specially, (***) applicable to enterprises winning or receiving contracts, and organizations or individuals making offshore investment
10 According to Article 17 of Circular No. 01/2014/TT-BLDTBXH, applicable to enterprises providing outsourcing services only and report must be additionally submitted to DOLISA and MOLISA
11 According to Article 60.2 of the Labour Code No. 10/2012/QH13, the report must be submitted to DOLISA
12 According to Section 9 of Circular No. 04/2013/TT-BLDTBXH, the notice must be submitted to the local Labour Introduction Centres
In addition, employers must note the following timelines:
- According to Article 6 of Circular No. 23/2014/TT-BLDTBXH, employers must report the usage of workforce to the Labour War Invalids and Social Affairs Office at district level or DOLISA (for enterprises in industrial zones) within 30 days from the day of operation
- According to Article 20 of Circular No. 32/2014/TT-BLDTBXH (amended by Circular 03/2014/TT-BLDTBXH), employers must notice their quantity of employees to the local Labour Introduction Centres within 30 days from the day of operation
- According to Article 7 of Circular No. 23/2014/TT-BLDTBXH, employers must keep the employment logbook at their main office, branches or representative offices and must show it to Labour War Invalids and Social Affairs Office at district level or DOLISA or inspector of MOLISA or other agencies while it
requested by them
