This MORTGAGE is made and executed by:

___________________, of Legal age, Filipino, married, with Residence and


postal address at ______________________________ herein after called the
MORTGAGOR,
- in favor of ___________________, of Legal age, Filipino, married, with Residence and
postal address at ______________________________, hereinafter called the
MORTGAGEE,
WITNESSETH:
1.
That as security for the payment of the loans or advances in the
principal sum _______________________ and other loans or advances already
obtained or still to be obtained by the MORTGAGOR/S,CO-MAKER/S or
GUARANTOR/S from MORTGAGEE plus interest at the rate of ______ per
annum, payable on the dates mentioned in the corresponding Promissory
Notes, the MORTGAGOR/S, hereby transfer/s and convey/s to MORTGAGEE
by way of first mortgage the parcel/s of land described hereunder together
with the improvements now existing or which may hereafter be made is/are
free from liens and encumbrances:

That in case the MORTGAGOR/S executes subsequent promissory note
or notes either as a renewal of the former note, as an extension thereof or
new loan, or is given any other kind of accommodation, this mortgage shall
also stand as security for the said promissory note and/or accommodations
without the necessity of executing a new contract and this mortgage shall
have the same force and effects as if the promissory note or notes and any
and all other obligations of the MORTGAGOR to the MORTGAGEE, of whatever
kind and nature, whether such obligations have been contracted before,
during or after the constitution of this mortgage.

That incase of non-payment or violation of the terms of this mortgage
or any of the provisions of Republic Act Nos. 720 and 7353, as amended, this
Mortgage shall immediately be foreclosed judicially or extra judicially as
provided by law, and in case of the latter, the MORTGAGEE is hereby
appointed Attorney-in-fact of the MORTGAGOR with full powers and authority
to take possession of the mortgaged properties, without taking the necessity
of any judicial order or any other permission or power, and to take any other
legal action that may be necessary to satisfy the mortgaged debt; but if the

mortgagor shall well and truly fulfill the obligation above stated according to
the terms.

The MORTGAGOR/s hereby agree/s that the interest, penalties,
attorneys fee stipulated upon in the Promissory Note. Sheriffs fee,
publication expenses and other expenses incidental to the foreclosure,
judicial or extrajudicial, are guaranteed included in this mortgage.
MORTGAGOR/S further agrees/s that the same rate of interest stipulated
upon in the Promissory Note secured by this mortgaged, shall be the same
rate to be applied during the redemption period. Moreover, the
MORTGAGOR/S also agree/s that any additional loan extended by the
MORTGAGEE to the MORTGAGOR/S after the signing of the mortgage shall
also be guaranteed by this mortgage without the need of executing another
mortgage or documents.
5.
And that in case of judicial execution of the obligation hereby secured
or any part of it, the MORTGAGOR/S waive/s all rights under the provisions of
Rule 39; Section 13 of the 1997 Rules of Civil Procedures. And in case of
deficiency, the MORTGAGOR/S undertake to pay for the same without need
of demand.
6.
That if reason of incurable defects, this Mortgage cannot be recorded
in the registry of Deeds the obligation herein secured shall immediately
become due, payable and defaulted;

That it is further agreed that when the properties mortgaged are not
registered under the Torrens system nor the Spanish Mortgage Law, This
Mortgage shall be registered under Act No. 3344;
8.
That there is no other deed or instrument affecting the property
described above pending registration in the Registry of Deed;
With full knowledge of the above stipulations and the penal provisions of
Republic Act Nos.720 and 7353, as amended, the MORTGAGOR
