FOREIGN RIGHTS
SAMPLE TRANSLATION RIGHTS LICENSING AGREEMENT
A BENEFIT OF MEMBERSHIP
The Benefit:
IBPA members can download a sample form for help developing a contract for licensing foreign
and translation rights by a U.S. publisher to a foreign publisher when the U.S. publisher controls
foreign and translation rights in a work.
About the Form:
The form has several blanks for various key terms (including advance, royalty rate, first printing,
term, and territory) that will need to be negotiated by the parties, agreed upon, and filled in
appropriately BEFORE signing.
All blanks must be filled in or crossed out.
Although many of the terms and conditions in the sample contract are fairly standard, every
contract is subject to negotiation. In any case, you should satisfy yourself that the contract is
suitable for your purposes before using it. Please be aware that IBPA is not in a position to offer
legal advice, and you should consult with a publishing attorney of your choice to make sure that
the contract is suitable.
This sample form has been prepared for use by IBPA as a sample form for foreign rights deals.
You will see that it is set up as a blank form. It will need to be filled in and initialed on page 1 and
page 7. Thus, for example, the language, territory, term, advance, and royalty rate(s) need to be
negotiated and filled in. It is recommended that the contract be sent to the foreign publisher for
signing and then returned to the U.S. publisher for counter-signing.

The Benefit:
IBPA members can authorize their titles with Copyright Clearance Center free-of-charge.
About Copyright Clearance Center:
In 2008, Copyright Clearance Center (CCC) helped publishers and authors realize more than $120
million worth of royalties from the making of re-use copies in academic, corporate, and research
environments. Now more than ever, leveraging the Internet needs to be a core strategy for
publishers when it comes to earning fees from such re-uses.
CCCs online services for publishers includes:
RightsConnect linking from a publishers website to their work(s) listed in CCCs catalog.
Grant Permission Online allowing rightsholders to approve special permission requests.
Pay-per-use permission services, including Rightslink providing instant permission to use

REVIEWS
ABAS ADVANCE ACCESS PROGRAM
50% DISCOUNT
The Benefit:
IBPA members receive a 50% discount off the American Bookseller Associations
(ABAs) Advance Access Program.
About the Advance Access Program:
Advance Access is a twice-monthly email sent by ABA to member bookstores containing offers to
receive galleys, reading copies, or finished books for review. After receiving the title from a
publisher, a store can decide whether to carry it. They could also decide to nominate the title for
the Indie Next List. ABA makes no promises, but the Advance Access Program has proved to be a
very effective way to get the word out about titles.
Fees:
Due to the volume of offers and the staff time it takes to process and aggregate them, ABA
charges $150 per title. IBPA members pay only $75 a savings of 50%.
After emailing information to Peter Reynolds (see How to Participate below), IBPA members
should send a check for $75, payable to American Booksellers Association, to:
American Booksellers Association
200 White Plains Rd. Tarrytown, NY 10591
ATTN: Ana Gonzalez
To pay by credit card, IBPA members should call Ana Gonzalez at (914) 591-2665 ext 6622 or
email her at ana@bookweb.org to make arrangements.
How It Works:
IBPA members should send a detailed book description to Peter Reynolds at
peter@bookweb.org. The description should include: title, author, publisher, ISBN, subject
category, publication date, the number of free copies to be offered, a maximum three-sentence
description, and an email address to which the booksellers can write to directly request a copy.
An example follows:
TITLE XYZ by David Smith, (Publisher, ISBN: 0-000-00000-0, $23.95, hardcover,
September 2008, Mystery/Thriller). A three-sentence description of the title here.
No more than 70 words, please. Number of galleys available.
mailto:yournamehere@emailaddress.com
Please do NOT include website information or attach press releases or jacket images. Due to high
volume, it may take 2-3 weeks until word of your book offer is emailed to the bookstores.
IBPA Membership Benefits Handbook | Last Updated July 25, 2014 | Page 50 of 57
The Benefit:
Through the NetGalley Book Review Program, IBPA members can
share galleys electronically and securely with 175,000+ reviewers, media professionals,
booksellers, librarians, bloggers, and other contacts.
To participate in this program, all you have to do is provide your digital files to IBPA. This is
especially helpful and convenient if you have neither the time nor the inclination to deal with the
technological aspects of adding your own title to NetGalley. IBPA members save the expense of
processing, shipping, and mailing galleys; IBPA does all the work!
Options:
There are two options available:
1. Six-Month Title Listing = $349
2. Six-Month Title Listing, Plus IBPA Round-Up Email = $499
Six-Month Title Listing:
Efficient, effective, and affordable electronic galley distribution.
Galleys will be available to all NetGalley readers for 6 months.
IBPA will:
o Process your title set-up
o Approve requests to view your galley
o Provide you a widget you can use to invite your contacts to view your galley online
o Provide reports related to galley downloads when requested
When your title page is added it will be featured in NetGalleys recently added titles
section, in addition to being listed under IBPAs members titles.
All titles listed on NetGalley via IBPA are automatically approved for all readers, this is found
on the site under READ NOW. This section is one of the NetGalleys most popular because the
titles can be immediately accessed without waiting for manual approval from the publisher or
author.
You will receive a widget that leads directly to your galley in the NetGalley system. The
widget is a hyperlink that allows the recipient quick access to the galley. The widget can be
included in all communications developed to announce that your title is available for
electronic review on NetGalley.
You can register on NetGalley as a reader to view your title page, but your access as a
publisher is through the IBPA office.
Six-Month Title Listing, Plus IBPA Round-Up Email:
Includes all the benefits above, plus:
1. Your title will be featured in one dedicated IBPA-branded mailing, targeted to NetGalley
members. These are branded as IBPA Round-Up emails, and will feature titles from IBPA
members only. Upon your request, you can receive click-through and open rate reporting.
NetGalleys open rate for these emails averages 25-30%, which is above the industry

IBPA Membership Benefits Handbook | Last Updated July 25, 2014 | Page 52 of 57

online and print editions of PW Select. In addition, listed books are eligible for editorial review
consideration in the online and print editions of PW Select. The author will also receive a sixmonth digital subscription to Publishers Weekly at no additional cost.

Publishers Weekly gain an excellent reputation among librarians, booksellers, and industry
members are applied to self-published titles.
