AFFIDAVIT FILED UNDER SECTION 139 C.P.C.

I, Daggubati Pavan Kumar S/o Partha Sarathi (Late), aged 26 years,
resident of Vetapalem Village & Mandal, Prakasam District, do hereby
solemnly affirm and sincerely state as follows:I am the deponent herein and 3 rd petitioner in the main O.P. The O.P. is
filed for compensation for the death of my Father, who died in a motor accident.
Later the same was decreed in our favour for a sum of Rs.4,80,000/- with
interest and costs on 01-11-2011. The 5th respondent deposited an amount of
Rs.6,09,828/- into the Court, dt.23-02-2012. I am entitled to an amount of
Rs.75,000/- with interest and costs of Rs.95,286/- towards my share of
compensation amount. The Honble Court permitted me to withdraw 50% on
my share of compensation amount of Rs.48,095-50 with interest and costs as
per decree direction, dt.01-11-2011 and I withdrew the same and the remaining
balance amount of Rs.47,190-50 was kept under fixed deposit for 3 years. Later
I filed a petition to withdraw my entire share of compensation balance amount
with accrued interest thereon and this Honble Court was pleased to permit me
to withdraw the same on 18-12-14. The above said amount of Rs.59,057/- was
lying in C.C.D.
I am entitled to withdraw the same and there are no
attachments or stay or appeal on the said amount. I, under take that if the
Honble Court directs me to re-deposit the amount, I will deposit the same. I am
herewith filing my Bank Pass-Book.
Hence I pray that this Honble Court may be pleased to issue a cheque for
Rs.59,057/- (Rupees Fifty nine thousand fifty seven Only) in favour of the
Branch Manager, State Bank of India, Vetapalem Branch, Prakasam District,
and he may be directed her to credit the same to the S.B.A/c No.32049179201
of the petitioner in the interests of justice.

over and explained in Telugu to the deponent and admitted him to be correct on
this the
