I recently sent in a complaint on Judge Kurtis Loy, Judge Lori Fleming, Judge Oliver K.
Lynch, Judge Kyle Fleming - Pro Temp, late John GarigUeti, Robert Fleming, and Chief
Judge A.J.Wachter for hearing past law partners and past law co-workers cases which I feel
is a conflict of interest and violations of economic interest as well in certain cases. I have
included some pictures from the "private Crestwood Country Club's website" which shows
Crawford County Sheriff s Deputy Stu Hite in pictures with Crawford County attorney /protemp judge Kyle Fleming which appears to be them drinking alcohol "WHICH OTHER
MEMBERS OF CRESTWOOD SECRETLY REVEALED TO ME IT WAS ALCOHOL WHO DO
NOT WISH TO BE MENTIONED".
This to me looks like a conflict of interest because KyleFleming is a criminal defense
attorney and pro-temp judge and his wife is the criminal district judge Lori Fleming. Is this
how they plan there DUItraffic stops over a private party????? Stu Hite the Crawford
County Sheriff Deputy will arrest them, then the person charged for the crime will pay Kyle
Fleming to defend them. and then Michael Gayoso who Kyle Fleming was the campaign
manager for prosecutes them and Lori Fleming, Kyle's wife is the judge and ex-crawford
County assistant attorney in 2002 and she convicts the defendant and fines them. It makes
the community also wander how a Sheriffs Deputy can even afford on their salary to be a
private member of Crestwood or if he was a guest of Kyle and Lori Fleming that night. Did
Stu Hite check himself or anyone for DUl when they left the Country dub after their
drinking parties?
WOW!!!!!I can't believe the corruption in a small town!!!! A local search also revealed that
in 2008 attorney Kurtis Loy had several court cases in front of his golf buddy at "Crestwood
Country Club" ChiefJudge John Gariglietti and this was a conflict ofinterest as well.
As per attached evidence it seems that in 2008 that in the "AFlight" John Gariglietti was
playing and Kurt Loy was playing golf in the "B Flight". Perhaps the reason that Honorable
Kurtis Loy has made so many grotesque decisions as a judge in his first year that seem to be
extremely unethical falls back on the fact that he was being groomed to be a judge by John
Gariglietti who was also violating Rule 2.11{A) by allowing his private member of
Crestwood and golf partner Kurtis Loy to go in front of him. I also think it was a conflict of
interest for Eunice Gariglietti and Cindy Loy to be employees at "Coldwell Banker" and for
attorney Kurtis Loy to go in front of Judge Gariglietti as this is an economic interests of
their wives as well as a conflict for the private membership at Crestwood. So the
Gariglietti and Loy spend time in court pretending to observe ethics while the wives
work together during the week as realtors in the same company and the couples
then meet up on the weekends to play golf. I have included as evidence the tax return
for 2006 for Pittsburg Board of Realtors where both wives are directors and evidence that
they worked together!!!!!!
In 2008 alone here are some of the Crawford County cases that Judge John Gariglietti
heard that involved his 'golf weekend buddy (not to mention the wives were co-coworker
realtors in a small company) attorney Kurtis Loy; 2008DM138P, 2008DM173P,
2008DM184~2008PR016~2008PR034P,2008PR039~2008PR043~2008PR064P,
2008PR069P, 2008PR071P, 2008PR078P, 2008PR098P, 2008PR099P, 2008PR100P,
2008PR10SP, 2008PRll0P, and 2008PR125P.
IT HAS ALSO BEEN REVEALED TO ME BY SEVERAL PRIVATE MEMBERS OF THE
"KNIGHTS OF COLUMBUS" AND "CRESTWOOD COUNTRY CLUB" whose names wish to
remain secret that the judges of this county are also hearing local businessmen who are
also private members of these organizations with them. They have also revealed to me that
Honorable Robert Fleming and Honorable AJ. Wachter are members of "Crestwood
Country Club" and "The Knights of Columbus" I am currently waiting to receive a private
membership guest list of "Crestwood County Club" and "Knights of Columbus" to prove this
allegation as I don't have any proof that Robert Fleming and A.J.Wachter are members at
this point
I think it is a conflict of interest for private members of "The Knights of Columbus" and
"Crestwood Country Club" to get to go in front of Robert Fleming, A.J.Wachter, Kurt Loy,
and Lori Fleming because they are all private members of the country club with area
attorneys and police officers.
Kurtis Loy and his wife Cindy Loy are both members of Crestwood County Club and so is
Kyle Fleming and he is in front of Judge Loy in case numbers 2014CR191P, 2014233P,
2003DM433P, and 2014CR70P.
In case numbers 2012CV226P, 2012DM373P, 2013PR7P, and 2012LM259P the judge is
Kurtis Loy and these cases are all of his former law partner and current member ofthe L&T
Partnership pro-temp judge Robert Tomassi He also has case number 2014LMS5P with
Burton Harding of "Loy, Sagehorn, and Harding" and he has one current case with
Sagehorn. In case number 2007DM102 Kurt Loy is the judge and this is a divorce case
which "Loy, Sagehorn, and Harding" currently hear divorces and they did in 2007 and Loy
owns their building at 112 W. 4thstreet. He currently has these cases with past law partner
Mark Werner which should be a conflict of interest as well and they are 2013PR77P,
2013CV50P, 2009DM2P,2014CV20P, and 2012LM516P. Kurtis Loy is judge in case number
2012LM516P and the case of 2012LM516P is a landlord tenant and Loy has farm rental
according to his financial disclosure report and this should be an economic conflict of
interest as well.
Honorable Lori Fleming heard case number 2013CV93P and Geoffrey Clark from Wilbert
and Towner was the attorney in this case who previously worked with her at "Wilbert and
Towner" and this is not the five (5) year waiting period according to Judge Lynch. She is
also currently hearing a case of William Wachter of "Wilbert and Towner" who also is a
member with her at Crestwood Country Club, and Knights of Columbus as well and was the
former partner of Chief Judge AJ. Wachter, Kyle Fleming, and Honorable Robert Fleming at
"Wilbert and Towner" when they all 3 owned "Wilbert and Towner". She also fails to list
her mortgage on College Street in Pittsburg Kansas as a debt on her financial disclosure
report form which is a violation as well. She also was a Pro-Temp judge in case number
2011SCl13P where she heard a contract dispute case which her law firm 'Wilbert and
Towner" also litigates contract disputes which should have been a conflict of interest for
her to hear as well.
Honorable AJ. Wachter is currently hearing these cases of former law partner Kyle Fleming
and they are 2014DM62P, 2014DM404P 2014DM278P, 2014CR149P and 2014CR233P
where prosecutor is Mike Gayoso and Defense attorney is Kyle Fleming and he was his
Gayoso's campaign manager. The Fleming's and the Wachter's have known each other for
several years as they lived right down the road from each other while their children went
to St. Mary's and Colgan High School and Robert Flemng's wife Peggy taught all ofJudge
Wachter's children at St. Mary's. Brian Wachter and Michael Fleming were also on state
championship baseball teams from 1990 to 1993 together and played other sports together
at Colgan at that time period. In case number 2012373P AJ. Wachter is judge and pro
temp judge/attorney is Robert Tomassi but Wachter had previously recused himself from a
case of Robert Tomassi in 2012CV226P. He previously was the judge in case number
2006CV159 with J. Gordon Gregory from 'Wilbert and Towner" which is not past five years
according to Judge Lynch and J. Gordon Gregory still frequents AJ. Wachter's residence at
3204 Grand Oaks Drive and I have pictures to prove this as Judge Wachter is in a "straw
hat" with his wife and they are working in the yard and talking to J. Gordon Gregory on
their property and that picture and several others of J. Gordon Gregory at Wachter's
resident are currently being sorted through to add to this complaint for further evidence.
Judge AJ. Wachter was also a long time pro-temp judge before he became a district judge in
2003 and when he was a pro temp judge he heard cases that his law firm litigates which is
a violation. Judge Wachter was also still receiving money from Wilbert and Towner in 2002
and he heard the court case of 2002CR295 which is a criminal case and the attorney is City
Judge Frederic Smith who makes judicial decisions on criminal matters as well in the City of
Pittsburg and that is a conflict of interest. In case number 2006CV184 with J. Gordon
Gregory as attorney, Judge AJ. Wachter was recused so he should have known to recuse
himself from 2006CV159 with attorney J. Gordon Gregory as he had previously done before
in his cases. According to Judge Lynch you are suppose to wait five (5) years to hear your
past law firms cases.
Judge A.J.Wachter had previously recused himself from cases with Kyle Fleming and J.
Gordon Gregory and they are the following 2003LM686P, 2004CV84P, 2004CV92P, and
2013CV72P. He also recused himself from case number 2013CV50P with attorney Mark
Werner and the current judge in that case is Loy who should recuse as well. It also disturbs
me that Judge Wachter does not list his mortgage as a debt on his financial disclosure
report form because according to Crawford County Register of Deeds he currently owes on
a mortgage on his Grand Oaks property.
Honorable John Gariglietti was recused in case number 2012CV60P perhaps because he
was private members at Crestwood with the attorneys in this case. The current judge is
Bob Fleming in case number 2012CV60P and the attorneys are Mark Werner and J. Gordon
Gregory. Mark Werner is on City economic Board with Robert Fleming's son Kyle Fleming
and Robert Fleming worked with J. Gordon Gregory who Robert Fleming, Kyle Fleming,
Lori Fleming, and A.J.Wachter know as "Gordy" and he should be recused from this case
for the appearance of impartiality and a conflict of interest from 'Wilbert and Towner".
Robert Fleming is currently hearing the cases of J. Gordon Gregory from "Wilbert and
Towner" in 1994DM326, 2005CV99, 2006CV22, 2013DM73, 2011CV40, 2009LM532,
2009CV87, and 2008DM5. The cases of 200SCV99 2006CV22 are serious violations of
a financial economic interest since Kyle Fleming owned 'Wilbert and Towner" from
March of 2003 to June of2007!!!!!!!!! He also was previously recused himself in case
number 2007LM500 with attorney J. Gordon Gregory and Honorable Robert Fleming
should not being hearing the current cases of his ex-co worker J. Gordon Gregory he knows
as GORDY".He actually still had an economic interest in the case of 1994DM326 as he was
still receiving money from "Wilbert and Towner" at this time. He is also listed as the judge
in the famous 11thjudicial district on going case since 2006 of "State vs. John Zappa" where
the majority of the people in the 11thjudicial district think it was Judge Lyerla who was
drunk and driving the vehicle that struck the horse. Also how can Fleming hear a case that
is over a drunk driving charge that happened out of "Judge Lyerla's car" and the alcohol in
question was served at his house and Judge Lyerla is the Magistrate in the 11thjudicial
district??????
Please send the 11thjudicial district an out of district judge on the Zappa case so it doesn't
just get washed under the table because it happened to an officer in a judges car and the
whole thing smells very, very fishy!!!!!!
In 2010DM95 Wachterrecuses and Gariglietti is judge and Lori Fleming is attorney who
are all members at Crestwood at this time period. This would seem like a conflict of
interest for attorney Lori Fleming to go in front of her father-tn-law's co worker, her and
her father-in-law's private member at Crestwood, and private member of the Catholic
Church in town as well. Did the opposing party know all this info and was it revealed on
record by the judge before the case???????
I appreciate your committee taking the time to thoroughly investigate the above mentioned
conflict of interests of the judges that have been mentioned up above. I would like to go
ahead and have the commission add Honorable Robert Fleming out of Labette County
District Court to this complaint for his conflicts of interests as well including the fact that an
out of district judge needs to finish the John Zappa Case.
I also noticed that on ,udge Lynch's financial disclosure report in April 15, 2005 that
he owned the building of 1023 Military, Baxter Springs which in fact is "Lynch Meek
& Battitori" which he was hearing their cases which should be another obvious
economic conflict of interest.
I also think that all the judges in Crawford County need a "101" course on how to correctly
fill out a financial disclosure report form under 601B Rules 3.12, 3.13, 3.14, and 3.15 since
certain judges list their credit card debt and investments and others don't and fail to do so
and none list their mortgage. I think they should also be reporting their memberships and
positions at Crestwood County Club, Knights of Columbus, and the Catholic Church and any
other membership of an organization that they have so conveniently forgotten to include. I
think it is only fair for the citizens of the 11 tit judicial district to know what attorneys and
judges are members of certain organizations which might lead to frequent disqualifications
as a judge. It also seems to me to be a concern if Chief Judge A.J.Wachter, Judge Robert
Fleming, Judge Loy, and Judge Lori Fleming discuss any court related material with deputy
sheriff Stu Hite or Kyle Fleming since the public is paying for all the 11 tit district court
judges salaries and the salary of a Crawford County deputy Sheriff and the public might
need an accounting ledger to show how much time was spent on each case since it's very
possible that they discuss court related material at these so called "PRIVATEGET
TOGETHERS"as the public is paying their fees for them to drink, laugh, and dance it
up!!!!!!!!!!!!!!!! !
Thank your for your time and I will continue to sort through all the pictures I have received
from private members of "Crestwood" and "Knights of Columbus" that feel that there are
some serious "CONFLICTSOF INTERESTS"being committed by public officials in the 11th
judicial district and I am also waiting on the Private Guests Lists so that I can add for my
evidence to help your committee complete the investigation. I also want to make a note
that I feel that "THE FLEMINGLAWFIRM"should be disqualified from going in front of Lori
Fleming, Kurt Loy,A.J.Wachter, and Robert Fleming because they are all members of
Crestwood, Colgan, and Knights of Columbus not to mention "Wilbert and Towner ties",

50th ANNIVERSARY
Fifty years of Family, Friendship and Tradition was celebrated ith a tribut~ to our f
din members
and original charter members on Friday night June 27,2008 Kurtis Loy served as emcee. Our club
begin as an idea by Dottie Miller and the vision of ten couples WI mcorpora Ion taking place in
1958. Four of our original founding member families were represented at the dinner: Mr. Bill
Daugherty, Mrs. Edythe McNally, Mrs. Dottie Miller and Mr. & Mrs. George & Josie Nettels. In
addition to the founders, active charter members were also recognized for their years of affiliation
with Crestwood. Those attending were Jeanne Benage, Joyce Cumiskey, Joe Keller, Joan Miller,
Fred Mitchelson, Mary Pogson, Yvonne Robertson and Don Widner.
Numerous past presidents of Crestwood were also present and recognized for their service to the
club. Crestwood's first PGA golf professional, Pete Reyburn and wife Pat traveled from Florida to
take part in the celebration. Todd Casey, current PGA Golf Professional and Club Manager, was
given a standing ovation as he was presented a plaque honoring him for his unrelenting dedication
and service for the past 20 years.
Theresa Swink and Debbie Hawley unveiled a commemorative portrait of our ten foundin members
that will hang in the entry hall. The following dedication toast was delivered by Kurtis Lay:
"To our founders .. 50 years ... from 1958 to 2008 nearly one-quarter the age of our country.
purchased has become so welf groomed and improved that Crestwood is welf known as the diamond not in the
rough, but in the four-state area. We have alf this because of your vision. I often wonder if gin or wine played any
part of our destiny. All of this we have because of you. This is ours because of you. From an idea in 1958 to this
marvelous Country Club we enjoy tOday. Your vision and wilfingness is carried forward today by alf of us that now
share your dreams. You are the foundation of Crestwood, may the most you wish for be the least you get. Thanks
for the memories. Thanks for everything."
The celebrations continued through out the weekend with golf tournaments, kids games, Hawaiian
luau with pig roast, live music and culminated with a fantastic fireworks display.
