REACTION PAPER ON RAMOS vs DE LOS SANTOS MEDICAL CENTER
Patients lives were entrusted to the doctors and as well as to its team in
providing the needed care, medical interventions and treatment when going to
the hospital. This is a clear case of negligence in accordance with the practice
of health care delivery. The surgeon, Dr. Hosaka, with anesthesiologist Dr.
Guttierez, must be both held liable for negligence under Article 19 of the Civil
Code which requires a person, in the performance of his duties, to act with
justice and give everyone his due. Another is the faulty intubation that caused
the petitioner Erlinda to be in comatose condition because she omitted to
perform a thorough preoperative evaluation of the patient.
This serves as an eye opener to the public most especially to the health
care providers to be very keen, careful and responsible for their actions
because we are handling everyday lives of our patients.
I also agree for the ruling by the Supreme Court that reverse the finding of
liability on the part of DLSMC for the injury suffered by petitioner Erlinda, and to
declare the liabilities to Dr. Hosaka and Dr. Guttierez to pay the petitioners.

This case was primarily a contention that had the respondent doctors
exercised due care and diligence, they would not have rushed the performance
of the Widal Test and hastily concluded that Jorge was suffering from typhoid
fever and then administered the antibiotic without first conducting sufficient
tests on the patients compatibility with said drug. They also charged the
hospital with negligence in hiring negligent doctors.
I am also in favor of the ruling of the Court of Appeals that no
presumption of negligence can be applied to Dr. Rico because he did his job
also as to the standards of professional care and operating procedure followed
in the hospital and proper management and treatment has been applied. Dr.
Rico did not depart from the reasonable standard recommended by experts as
she in fact observed due care required in the circumstances.
Though the Widal Test is not conclusive, it remains a standard diagnostic
test for typhoid fever and, in the present case, greater accuracy through
repeated testing was rendered unobtainable by the early death of the patient.

Also Dr. Rico made everything to the best of his abilities in rendering
effective professional care and management. Jorges death might be brought
about by the complications of the disease he had prior to admission.
