The new “Super Drunk” law makes it a crime to drive with a blood alcohol content of .17
or greater. Under the “Super Drunk” law a driver’s blood alcohol level of .17 means installing an
alcohol-testing ignition device in your car in order to drive. This new law is effective on Halloween,
2010.
FIRST TIME PENALTIES ARE STIFF. A one-year license modification. The first 45 days -
absolutely no driving. The Secretary of State can return the license for the next 320 days, restricted
driving, but only after an ignition device (called a BAIID) is installed. Fines go up to a maximum
of $700.00. Potential jail time is increased from 93 days to as much as 180 days. Mandatory
attendance in a one-year alcohol treatment program. A first offender who later violates the driving
restrictions, or attempts to operate a vehicle with a 0.025 blood alcohol level gets twice the
penalties. Offenders get a new 45 day period of no driving, followed by 320 days of restricted
driving with the BAIID. On a long trip the driver must test about twice every hour. If it detects an
alcohol level of greater than .025, a warning signal goes off. The device reports violators to the
monitoring agency. Repeat offender sanctions remain unchanged.
Drunk driving has just become more costly because the BAIDD costs as much as $50 to
install, more again every month to maintain, and treatment programs are not always cheap.
WILL IT STOP DRUNK DRIVERS? Our courts already have the option to require a BAIDD
as a condition of being bonded. And, drunk drivers often know to plead to a lesser offense on their
first charge if they are given the chance – impaired driving. But if pleas aren’t offered or taken,
there will be more drunk driving trials for drivers to fight the accuracy of the BAIIDs readings.
Which will end up costing the public more money. So several Michigan drunk driving attorneys
are questioning whether the Super Drunk law is Super Good for Michigan after all. Time will tell.
