ISSUE: Re The hidden danger regarding interfering with religious education & Aboriginal history

As a CONSTITUTIONALIST I have my concerns as to where our Federal Government is heading, and


in particularly its ongoing unconstitutional conduct. Constitutionally the Commonwealth of Australia has
no legislative powers as to interfere with education, nor to fund Arts, Sports, etc. Regardless of this we
now find an onslaught is on our doorstep. And more and more republicans taking over a total disregard to
what our constitution stands for. Minsters of the Crown have their positions because of the constitution
and not despite of it, and surely at the very least they should show respect and honour the constitution.
Hansard 1-3-1898 Constitution Convention Debates (Official Record of the Debates of the National Australasian
Convention) QUOTE Mr. WISE.-If the Federal Parliament chose to legislate upon, say, the education questionand the Constitution gives it no power to legislate in regard to that question-the Ministers for the time being in each
state might say-"We are favorable to this law, because we shall get 100,000 a year, or so much a year, from the
Federal Government as a subsidy for our schools," and thus they might wink at a violation of the Constitution,
while no one could complain. If this is to be allowed, why should we have these elaborate provisions for the
amendment of the Constitution? Why should we not say that the Constitution may be amended in any way
that the Ministries of the several colonies may unanimously agree? Why have this provision for a
referendum? Why consult the people at all? Why not leave this matter to the Ministers of the day? But the
proposal has a more serious aspect, and for that reason only I will ask permission to occupy a few minutes in

that Australias democratic system of government is based on the Westminster system, although specific references

Andrews said the test would force potential citizens to know about Australias political system, Aboriginal history
and that the nations values were based on Judeo-Christian tradition. There are different Aboriginals races in

the various states, such as with the Dutch in Western Australia, and as such Aboriginal
history/heritage cannot be uniform, and should not be interfered with, but left with the states.

One cannot teach any religious issue because it would offend s116 of the constitution.
HANSARD 17-3-1898 Constitution Convention Debates Mr. DEAKIN.- What a charter of liberty is embraced
within this Bill-of political liberty and religious liberty-the liberty and the means to achieve all to which men in these
days can reasonably aspire. A charter of liberty is enshrined in this Constitution, which is also a charter of peace-of
peace, order, and good government for the whole of the peoples whom it will embrace and unite.

Our constitution (The Peoples will!) is part of the United Kingdom laws, under its Monarchy, and
one cannot separate it from its origins merely because republicans dictate to do so. Neither is our
political system based on Judeo-Christian tradition! We must reject the overtures of the republicans to
turn us into some republic by stealth. Neither can we allow them to play games with religious issues,
because in time a complete other dominant religion may hold powers in the Parliament/Government and
then if we now allow the Government to dictate religious issues then so can they then down the track. We
have a constitution and those who defy it simply should be held legally accountable as criminals.
