Introduction
The National Capital Plan (the Plan) came into effect on 21 January 1990. In accordance with the Plan
(Section 2.4), Special Requirements apply to development on all land which fronts directly onto Approach
Routes and is not more than 200 metres from the middle line of Northbourne Avenue.

Special Requirements state that development is to conform to a Development Control Plan (DCP) agreed
by the National Capital Authority (NCA) which ‘seeks to enhance the surrounding predominately rural

character and landscape outside the urban areas. As the Approach Routes enter the built up areas, the
emphasis shall shift to a more formal character’.

The NCA has received independent requests for a DCP to be prepared and an amendment to an
existing DCP for two sites along the northern section of Northbourne Avenue. This DCP will facilitate
redevelopment of Exhibition Park in Canberra (EPIC) service station site (Block 1 Section 75 Lyneham,
Part Block 5 Section 71 Lyneham, Block 4 Section 72 Lyneham, and Blocks 429, 444 and 445 Gungahlin

District) and the Kamberra Winery Site (Part Block 18 and 19 Section 71 Lyneham, and Block 20 Section 71
Lyneham). As the sites are in close proximity to each other one DCP is proposed for the area.

Draft Development Control Plan No: 171/10/0002 has been prepared in accordance with the Plan..
Part 1: Context
1 Background
DCP No. 171/10/0002 has been developed for two sites in close proximity to each other, the Kamberra
Winery site and Exhibition Park in Canberra (EPIC) service station site, fronting Northbourne Avenue.

The Kamberra Winery is an existing developed facility located on Block 19 Section 71 Lyneham. The site
owner is looking to redevelop parts of the site and has requested that the NCA prepare a revised DCP for
the site. DCP No. 171/98/0009 currently applies to the site and will be superseded by the finalisation of
DCP No. 171/10/0002.

Block 4 Section 72 Lyneham and Block 429 Gungahlin District form part of a developed site fronting
Northbourne Avenue. The ACT Government, through EPIC, has requested the NCA prepare a DCP to set out
planning and urban design policies to guide future development on the site.

DCP No. 171/10/0002 covers a distance of approximately 1.2 km along Northbourne Avenue.

1 Preamble
The subject area is adjacent to Northbourne Avenue, north of Mouat Street, which is an
Approach Route under the National Capital Plan (the Plan). Special Requirements under
Section 2.4 of the Plan apply to the area that state:

“ Development is to conform to Development Control Plans (agreed by the National Capital


Authority) which seek to enhance the surrounding predominately rural character and landscape
outside the urban areas. As the Approach Routes enter the built up areas, the emphasis shall
shift to a more formal character”.

The provisions of this Development Control Plan (DCP) apply to the portions of Blocks 4, 18, 19

and 20 Section 71 Lyneham, Block 1 Section 75 Lyneham, Blocks 4 and 5 Section 72 Lyneham,
Blocks 429, 444 and 445 Gungahlin District which lie within 200 metres of the middle line of
Northbourne Avenue. In the absence of a provision in the Plan to the contrary, all developments
should be in accordance with the relevant provisions of the Territory Plan 2008.

The subject area is Territory Land outside the Designated Area of the Plan and therefore
the ACT Planning and Land Authority (ACTPLA) is responsible for assessing development

applications relating to the subject area. In doing so, ACTPLA is required to ensure any proposal
is not inconsistent with this DCP or the Plan.

The Northbourne Avenue road reservation forms part of the Designated Areas of the Plan and
therefore the National Capital Authority (NCA) is responsible for granting works approval within
the Northbourne Avenue road reservation.

2 Planning and Urban Design Objectives


2.1 Enhance and formalise the character of Northbourne Avenue as an Approach Route.

2.2 Maintain and reinforce the landscaped character of Northbourne Avenue.

2.3 Allow for redevelopment of Parts Block 18 and 19 Section 71 Lyneham; Block 20 Section 71 Lyneham;
Block 1 Section 75 Lyneham; Part Block 5 Section 72 Lyneham; Block 4 Section 72 Lyneham; Blocks
429, 444 and 445 Gungahlin District with an appropriate scale to Northbourne Avenue.

2.4 Ensure that any buildings within the area subject of this DCP demonstrate a high architectural
design quality, particularly when viewed from Northbourne Avenue.
3 Land Use
3.1 Land use on Blocks 18, 19 and 20 Section 71 Lyneham, Block 1 Section 75 Lyneham, Blocks 4
and 5 Section 72 Lyneham, Blocks 429, 444 and 445 Gungahlin District shall be consistent with
the ‘Broadacre Area’ land use of the National Capital Plan, and the land use of the Territory
Plan. Where an inconsistency arises between the Territory Plan and the National Capital Plan,
the National Capital Plan shall prevail

4 Building Height
4.1 Building height for development of this area shall be a maximum of 10 metres above natural
ground level. Natural ground level shall be taken to the median level of the block boundary
adjacent to Northbourne Avenue.

4.2 Rooftop plant shall be an integral part of the overall design and consistent the requirements of
Section 6 ‘Roofscape Design’ of this DCP..

4.3 Buildings and other permanent structures should be designed to a high architectural design
standard and must ensure an overall consistency in form, massing and detail.

4.4 Buildings are to be designed to appear as predominately low horizontal built forms within the
landscape setting.

5 Building Setback
5.1 Buildings or significant structures should be setback in accordance with the requirements set
out in DCP Drawing No: 171/10/0002

5.2 Minor encroachments of building articulation elements may be permitted provided the
development meets the objectives set out under Section 2 of this DCP.

6 Roofscape Design
6.1 Careful consideration should be given to the roof form and roofscape of buildings as viewed
from Northbourne Avenue and Flemington Road.

6.2 Roof top plants and equipment, if required, must be enclosed. The enclosure shall be carefully
integrated with the roof form and design of the building. All such plant and equipment shall be
concealed from view.

7 Building Materials and Colours


7.1 The facades and roof of buildings shall be constructed of high quality and durable materials.
Highly reflective external materials are not permitted.

7.2 Colour of external finishes of buildings and structures must ensure that they are appropriate to
and not discordant with the general development and amenity of the locality.

7.3 Building materials, construction and finishes should be responsive to microclimate issues.
Use of sunscreen devices as articulation elements should be employed to achieve climate
responsive facades.
8 Landscape Design
8.1 A high standard of landscape design is required for the area along the Northbourne Avenue frontage.

8.2 A landscape management plan must accompany any major development proposal. The
objectives of the landscape plan are to:
»» Ensure the existing landscape character of the area is maintained and enhanced;
»» Ensure that particular attention is given to the integration of building design, landscape and
signage to ensure reinforcement of the parkland character with the extensive use of canopy
trees and minimal use of shrubs to create filtered views through the trees to the buildings.
»» Minimise the visual impact of buildings and structures visible from the Northbourne Avenue frontage;
»» Ensure consistency of landscape treatments across the area.

8.3 Refer to Development Control Plan Drawing No. 171/10/0002. The setback area identified as
Landscape Zone A should be devoted to planting and be free of significant structures, vehicular
driveways and car parking. Signs may be permitted within this zone provided they meet the
requirements set out below under the heading ‘Signs’. Driveways and/ or car parking is
permitted in Landscape Zone B.

9 Vehicular Access and Car Parking

9.1 Access off Northbourne Avenue is limited to the locations as set out in DCP Drawing No.
171/10/0002.

9.2 A traffic assessment is to be submitted in relation to major development proposals for the area.
The determination of what constitutes ‘major’ is at the discretion of the approving authority.

9.3 On- site car parking is to be in accordance with the ACT Parking and Vehicular Access General
Code of the Territory Plan.

9.4 The visual impact of large car parking areas must be minimised through adequate screening
and landscape treatment.

9.5 Careful consideration should be given to the access, internal circulation and parking of service
and heavy goods vehicles within the area.
10 Signs
10.1 Careful consideration should be given to the integration of signs with building design and
landscaping to ensure they do not detract from the Northbourne Avenue frontage.

10.2 All signs on buildings shall be below the eaves or parapet capping.

10.3 No signs shall be permitted on Blocks 19 and 20 Section 71 Lyneham, Section 75 Lyneham, or
444 and 445 Gungahlin District other than road signs and than those indicated on DCP Drawing
No. 171/10/0002.

10.4 Two ground or pole entrance signs for the site entries to the Kamberra Winery site will be
permitted (as defined by Appendix IV: Signs Policies of the Territory Plan).

10.5 A single free standing Pylon sign is permissible for the EPIC service station site (Block 4 and
429 Gungahlin District) as defined by Appendix IV: Signs Policies of the Territory Plan. No other
free standing advertising signage will be permitted.

11 Mechanical Plant and Equipment, Electrical


Substations, Storage and Service Areas
11.1 All mechanical plant and equipment should be contained within buildings or located within

service enclosures appropriately screened from Northbourne Avenue. External air conditioning
units and plant shall not be visible from Northbourne Avenue.

11.2 Careful consideration should be given to the siting of any electrical substation, storage and
service areas (including storage sheds) if required. Any such structures or areas must be
carefully sited and totally screened from the view from Northbourne Avenue.

11.3 Rainwater tanks are to be fully integrated into the building design or screen from view from
Development Control Plan No:171|10|0002

Northbourne Avenue.

12 Fencing
12.1 Fencing which obscures filtered views into the site from Northbourne Avenue and detracts from
the presentation of the Avenue will not be permitted. Fencing is to be highly integrated with the
landscape design using high quality materials. The use of Colorbond, Cyclone, barbed or razor
wire is not permitted.

13 Sustainable Development
13.1 Development proposals will demonstrate a high level of performance in terms of environmental
design where applicable including energy efficiency, climate management and water sensitive
urban design.
