1. ISSUE
To review the results of the Open House and the Alternate Approval process for the
annexation of a parcel on Camozzi Road into the City of Revelstoke.
2. RECOMMENDATION
THAT the public input and the results of the Public Open House held on
September 22, 2015 at 2:00 p.m. in Council Chambers be received;
AND THAT the Certificate of Sufficiency for elector approval in accordance with
the Alternate Approval Process has been obtained be received;
AND THAT the City of Revelstoke has obtained the assent of the electors as
indicated by the Certificate of Sufficiency to petition the Minister of Community,
Sport and Cultural Development to extend the boundaries of the City of
Revelstoke as appeared in the Gazette under issue of September 17, 2015, and in
the Times Review local newspaper under issues August 12-19, 2015;
AND THAT all legislative requirements pertaining to the municipal boundary
extension in the Local Government Act and Community Charter have been met;
and
AND THAT the parcel approved for inclusion within the City of Revelstoke are
is PID: 012-858-889, Lot 1, Plan 11177, Section 12, Township 23, Range 2 West of
the 6th Meridian Kootenay District.

4. BACKGROUND
4.1. The subject property is located within the CSRD (Area B), is adjacent to the City of
Revelstoke and is accessed from Camozzi Road (see Figures 1 & 2).

4.2. At their meeting of April 8, 2014, Council passed a resolution supporting the processing
of the annexation request and directed staff to prepare a Financial Impact Analysis and
send out referral packages to the CSRD, City Departments, Provincial Agencies and
First Nations (see Figure 3). Staff were further directed to report back to Council
following receipt of referral responses and completion of the Financial Impact Analysis.
Referral responses were received from the CSRD, Ministry of Transportation and
Infrastructure, Ministry of Forests, Lands and Natural Resources, City of Revelstoke
Parks, Recreation and Culture Division.
4.3. At their meeting of June 24, 2014, Council passed a resolution supporting the subject
application being forwarded to the Province (see Figure 4). However, following the
November election the Province requested that the new Council consider whether they
wish to continue support of the municipal boundary extension process for the subject
application.
4.4. At their meeting of January 13, 2015, Council passed a resolution supporting the
subject application being forwarded to the Province (see Figure 5).
4.5. At their meeting of June 23, 2015, Council received the Provincial Ministry of
Community, Sport and Cultural Development Administrative Report on the subject
application (see Figure 6). Council passed a resolution authorizing Staff to complete the
steps outlined in the report which included follow-up notification to First Nations,
notification in BC Gazette and approval of electors of the municipality (alternate
approval process)(see Figure 7).
4.6. The City received public input from the adjacent property owner Northland Properties
Corporation in the form of three letters submitted during the Boundary Extension review
process (see Figure 8). Three people attended the Public Open House held September
22, 2015 at 2:00 p.m. in Council Chambers, no public input was received from the
participants (see Figure 9).
4.7. The Province requested that follow up notification of the Boundary Extension application
be sent to First Nations which was completed on August 6, 2015.
4.8. The Alternate Approval Process was completed on September 30, 2015. A Certificate of
Sufficiency was completed noting the process was completed and that no elector
signatures were received (see Figure 10). Advertising for the Alternate Approval
process were in the September 17, 2015 BC Gazette (see Figure 11) and in the Times
Review local newspaper from August 12-19, 2015 (see Figure 12).
5. FINANCIAL IMPLICATIONS
5.1. There are no known financial implications arising from the recommendation.
6. DISCUSSION
6.1. The owners of the subject property David Evans and Shelley Sharpe have submitted a
letter requesting an extension of the City of Revelstoke municipal boundary in order to
annex their property into the City The property owners have indicated they are seeking

the annexation in order to service the property with City services for construction of a
10,000 15,000 sq.ft. commercial hotel lodge.
6.2. The subject property is approximately 18 acres in size, is currently vacant, adjacent to
the City boundary on two sides and is directly adjacent to Camozzi Road. If the subject
property is annexed into the City, services would be obtained through an extension of
existing services located within Camozzi Road in the City.
6.3. If the subject property is annexed into the City of Revelstoke, prior to construction of a
commercial hotel lodge on the property the owner would need to apply for an Official
Community Plan (OCP) Amendment, Rezoning and Development Permit. The OCP
Amendment and Rezoning process would include public notification and a Public
Hearing.
6.4. If Council approves the subject Boundary Extension, Staff would prepare the final
package for submission to the Province.

9.2 Option 1:
Council may deny the Boundary Extension application. The final submission would not
be sent to the Province, the application would be closed and the owner would be notified

This memorandum serves as the Ministry of Community, Sport, and Cultural Development's
(Ministry) Administrative Report for the boundary extension proposal submitted by the City of
Revelstoke dated October 8, 2014.
Description of Proposed Boundary
This proposal is to support a petition from the City of Revelstoke to include the subject property
described below within the municipal boundary of the City of Revelstoke. The request has
originated from the current property owners, David Evans and Shelley Sharpe of Whistler, BC.
The subject property is currently located within Electoral Area B of the Columbia Shuswap
Regional District and is zoned currently zoned Rural and Resource (RSC).
The legal description of the subject property is:
LOT 1, SECTION12 TOWNSHIP 23 RANGE2 WEST OF THE 6TH
MERIDIANKOOTENAY DISTRICT
PLAN11177 (PID# 012-858-889)
Rationale
The current property owners, David Evans and Shelley Sharpe, have indicated they are seeking
the annexation of the subject property in order to connect the property with City of Revelstoke
services for construction of a 10,00015,000 sq ft commercial hotel lodge. Services would be
obtained through an extension of existing services at Camozzi Road, which is currently located
within the municipal boundary of the City of Revelstoke. If required, any future rezoning of the
property would come under the purview of the City of Revelstoke after the extension is finalized.
Benefits accrue to the municipality from potential increases in tax revenues from subject lands.
There are no additional road maintenance costs resulting from this proposal.
Compliance With Technical Criteria
Contiguity The subject property is adjacent to the existing City of Revelstoke municipal
boundary and thus satisfies the requirement for Contiguity with the current boundary.

Council Resolution
The Revelstoke City Council passed a resolution in support of this proposal
on September 20, 2014.
Regional District The Columbia Shuswap Regional District passed a resolution on February 20,
2015, in support of the proposed boundary extension (with the provision that the Columbia
Shuswap Regional District and the City of Revelstoke endeavor to resolve the Thomas Brook
water users supply issue).
Stakeholder Groups There are no service providers to consult, outside of the Columbia Shuswap
Regional District, and these parcels are adjacent to, but not within the Agricultural Land Reserve
and do not involve Crown land. No other agencies outside of the Columbia Shuswap Regional
District have direct interests in the extension area.

The City sent a referral package on April 29, 2014, to the following First Nations:
The Province prefers at least one attempt to fo||owupwith potentially affected Nations that do
not provide an initial response on boundary extension proposals, even if the extension appears
minor in nature. Thus, the Province requires the City to send a followup letter to each First
Nation that provides an update on progress and notifies them of the pending process to seek
approval from the municipal electorate on the proposed boundary extension.

The Province will also notify each First Nation when a final decision has been made by the
Lieutenant Governor in Council on the boundary extension request.
Consultation with Property Owners
No other property
- The portion
of Camozzi Road should remain under the MOTls jurisdiction until such time
there is another proposed boundary amendment. At that time, transfer of this section of
road should be considered.
There is one administrative step remaining for the boundary extension to proceed:
1) Send notification letter to each First Nation that provides an update on progress and
notifies them of the pending process to seek approval from the municipal electorate on
the proposed boundary extension.

1) Public notice of the proposed extension published once in BCGazette (as per 5. 20(3)(b) of
Local Government Act).
2) Obtain approval of the electors of the municipality in relation to the proposed extension
(as per s. 20(3)(c) of Local Government Act).
The approval of the municipal electorate is a pre~condition of the municipal council request for
the boundary change. Approval of the electors may be obtained by conducting a referendum
under Part 4 [Assent Voting] of the Local Government Act or by alternate approval process under
section 86 [Alternative approval process] of the Community Charter.
Under either process, the public notice should include the rationale for the boundary extension
and a map to accurately describe it. Section 84 [Approval of the electors] of the Community
Charter requires that public notice be printed once in the BCGazette and twice in a local
publication. Publication in the BCGazette as part of the elector approval process also satisfies
statutory notice reguirements in s. 20[3[[b[ of the Local Government Act.

Greetings:
Further to the May 23, 2014 letter from Rob Toor, Corporate Council for Northland Properties
Corporation, the Ministry of Forests, Lands and Natural Resource Operations (F LNRO) Mountain
Resorts Branch (MRB) affirms that the Resort Master Plan and its corresponding legal document, the
Master Development Agreement (MDA) between the Province of British Columbia and Mt. MacKenzie
Resort Limited (later Revelstoke Mountain Resort) were approved following comprehensive Provincial
review of input from various interest holders, including local governments.
The Master Plan review contemplated local government landuseobjectives of the time and sought to
align the proposed development and amenities to them. The modification of planning objectives adjacent
to Revelstoke Mountain Resort (RMR) has the potential to limit congruence between the MDA and local
plans such as the OCP, which were developed based on the approved Master Plan. This incongruence is
not only problematic for the resort, but also for the Province and for the municipality, should parasitic
competition reduce the resorts viability.
MRB agrees, as Northland contends, that RMR would be negatively impacted in the event that additional
servicing capacity was not available to support future development/expansion when required by RMR.
Further, MRB acknowledges the notion that adjacent developments avoiding frontendinfrastructural
costs would be benefrtting at the expense of RMR, particularly if the product or service offerings were in
direct competition with those available at the resort. As per the FLNRO All Seasons Resort Policy, the
ability to earn bed units is tied to the creation of uphill and downhill skier capacity through the
establishment of costly infrastructure. The ability of a third-party developer to construct commercial
accommodation immediately adjacent to the resort, without having been made to develop costly
infrastructure,most certainly provides an unfair competitive advantage.
Lastly, MRB does not recognize a lack of commercial accommodation capacity within RMR base area
lands, and would question the justification of adding capacity outside of the development area where it
was originally not contemplated. Instead, we would encourage the exploration of partnership
opportunities for resort investment within the Development Area boundary and consistent with the
approved Resort Master Plan.

writing to you to express our strong objections to the Development moving forward as it

Resort?
As per Section 6.3 of the Citys Council Report, if the Property is armexed into the City,
the
services would be obtained through an extension of the existing services locatedwithin
Camozzi
Road (the Services). If the City grants an extension of the Services for the Development,
the
Resort will expect a reimbursementfor the time and funds spent on such infrastructure
costs of
suchServices. The Services were constructed to service the Resorts current and ?iture
developmentneeds. If the Development and/or developers are able to connect to the Services,
this may affect the Resorts ?xturedeve1opmentsusage of these Services.

The MDA never contemplated that the City would use the Services and the infrastructure

water, sewer and septic services, roads, ski trails, chair lifts, platfonns, tower poles,
footings,
lines, cables, gondolas, and any other facilities(together, the Infrastructnre) to further
expand
its boundariesto allow a parasitic developmentto bene?t from all the works,
Infrastructure,and
the approximate $200 million invested at the Resort, wi?iout such development
incurring the
costs of the In?astructure. Allowing such developments will dampen
Inlrastructuregrowth at the
Resort and directly and negatively affect the interestsof the Resort.
This Development would set the Resort back for many years, as any potential developer
would
not have to pay for such In?astructure costs the Resort incurred,realizing
in a lower cost of entry
for any potential development. In addition, the Resort would see a
dramatic decrease in
investors purchasing at the Resort, as investors could purchase from competition with
no pre
costs. This would cause an unfair advantage for such parasitic developments.
Infrastructure
This was not contemplated when the MDA and the Resort was planned.
Furthermore,there is an abundanceof land available within the City limits, for anyone wishing
to build a hotel, and therefore, there is no reason to annex this
property for this Development. In
addition there are ample lands available for such a development at the base of
the Resort, and
within the MDA and City limits; the Resort is more than happy to discuss these
opportunities
with any developer.
We reiterate, the Resort is strongly opposed to the City or the Regional
District allowing
the annexation of the Property into the City; and/or properties near
the Resort for any
rezoning to increase density.

(copy enclosed for your records), we con?rm that we have been advised that the despite our and

process for:
Extension of the municipal boundary to
include the subject property:
Lot 1, Plan 11177, Section 12, Township
23, Range 2, West of the 6th Meridian,
Kootenay District into the City of
Revelstoke.
Notice is hereby given that under section
86 [Alternative approval process] of the
Community Charter and section 20 of the
Local Govemmenr Act, the Council of the
City of Revelstoke intends to petition the
Minister of Community, Sport and Cultural
Developmentto:
The current property owners, David
Evans and Shelley Sharpe, are seeking
the annexation of the subject property in
order to connect the property with City
of Revelstoke services for construction of
a l0,000l5,000 square foot commercial
hotel lodge. Services would be obtained
through an extension of existing services at
Camozzi Road, which is currently located
within the municipal boundary of the
City of Revelstoke. If required, any future
rezoning of the property would come under
the purview of the City of Revelstoke after
the extension is ?nalized.
Bene?ts accrue to the municipality from
potential increases in tax revenues from
subject lands.
