I am Ruben Santiago Y Santos, 30 years old, single, resident of No. 25 Lot 11, Block 13,
Phase II, Amparo Ville, Brgy. Balingasa, Quezon City and employed by Guwardiya Sibil
as a Security Guard assigned at Amityville Clubhouse, and the accused in the abovecaptioned complaint, after having been sworn in accordance with law do hereby state as
follows:

PRELIMINARY STATEMENT
The person questioning me is Atty. Mariline Marcelino-Lee with office address at Rm.
143 Love Building, 44 Peace St., Quezon City. This interrogation is being done at her
office address. I affirm that I am answering her questions fully conscious that I do so
under oath and may face criminal liability for false testimony.

We are offering the testimony of the accused for purpose of

proving and establishing that the accused is innocent of the
alleged rape filed by the complainant.

Ruben Santiago was on duty at Amityville Clubhouse on the

September 23, 2008, but was no longer at the said place
when the alleged crime was committed and that no such
crime could have been committed against the
complainant

for both the complainant and the accused were

never at the

alleged place and time of the crime.

QUESTION AND ANSWER

Q1: Where are you assigned as a Security Guard?

A1: At Amityville Clubhouse.
Q2: Where you on duty on September 23, 2008?
A2: Yes, ma'am.
Q3: What were you wearing on the said date?
A3: I was wearing my uniform for we are required to do so when on duty.
Q4: When did your duty end?
A4: I finished my duty at 5 pm.
Q5: What did you do after your duty ended?
A5: I went straight home.
Q6: Do you have any proof that you did not stay at the clubhouse after your duty?
A6: Yes, ma'am. We have our logbook to prove that.
Q7: Did you celebrate your birthday on the said date?
A7: No.
Q8: When did you celebrate your birthday?
A8: I celebrated it on the date of my birthday which is September 3.
Q9: Where did you celebrate it?
A9: I celebrated it at the Amityville Clubhouse.

Q10: Are you, as a guard permitted to celebrate your birthday on the said place?
A10: I celebrated it after my duty ended at 6 pm and had sought the permission of the
association president who allowed me to have a party there until 10 pm.
Q11: Who were present during the celebration?
A11: My co-security guards including Basmayor and his friends, Vangie, Trish, and the
complainant.
Q12: Do you know these ladies?
A12: No, ma'am. They were invited by Basmayor.
Q13: What time did you finish your celebration?
A13: At 10:30 pm.
Q14: Was the complainant still at the place at that time?
A15: No, ma'am. She left earlier.
