what to do regarding her nonMuslim husband who accepted her conversion without any problems and who also lets her educate the children the Islamic way.
However, when she asked for an advice, most of us told her that the husband has to take shahada (become Muslim) or she should not remain married to him

convert.IthinkthosecaseswouldbetheonlyprooftoconvincethepeopleofthatlistthatMuslimwomenarenotallowedtomarryorremainmarriedtonon
Muslimmeneventhoughtheyarenotagainstthewoman'sconversion.

that.
Allaahsays(interpretationofthemeaning):

AlQurtubisaid:
Andgivenot(yourdaughters)inmarriagemeans,donotgiveMuslimwomeninmarriagetoMushrik(pagan)men.Theummah(Muslimnation)isagreedthata
MushrikshouldnotmarryaMuslimwomanbecausethisislikeputtingIslaminaninferiorposition.(TafseeralQurtubi,3/72).

AlBukhaari(mayAllaahhavemercyonhim)said:
Chapter:whenamushrikorChristianwomanwhoismarriedtoadhimmi(nonMuslimlivingunderMuslimrule)oraharbi
(nonMuslim belonging to a people who are hostile towards Islam) becomes Muslim. Abd alWaarith said, narrating from
KhaalidfromIkrimahfromIbnAbbaas:ifaChristianwomanbecomesMuslimshortlybeforeherhusband,sheisforbidden
forhimMujaahidsaid:ifhebecomesMuslimduringtheiddah[waitingperiodfollowingdivorce],thenhemay(re)marry
her.Allaahsays(interpretationofthemeaning):Theyarenotlawful(wives)forthedisbelieversnorarethedisbelievers
lawful (husbands) for them [alMumtahanah 60:10]. AlHasan and Qutaadah said concerning two Magians who became
Muslimthattheirmarriagewasstillvalid.IfoneofthemhadbecomeMuslimandtheotherhadrefused,thewomanwould
havebeendivorcedandhewouldnolongerhaveanyrightsoverher.

Examplesofsuchwomeninclude:
Zaynab,thedaughteroftheProphet(peaceandblessingsofAllaahbeuponhim).ShewasmarriedtoAbulAasibnalRabeeduringtheJaahiliyyah(preIslamic
daysofignorance)butwhenshebecameMuslim,theirmarriagewasannulled,andshewentandstayedwithherfather(peaceandblessingsofAllaahbeupon
him).WhenherhusbandbecameMuslim,theProphet(peaceandblessingsofAllaahbeuponhim)sentherbacktohim.
(NarratedbyalTirmidhi,1143AbuDawood,2240IbnMaajah,2009classedassaheehbyImaamAhmad,1789.AlTirmidhisaid,thereisnothingwrongwith
itsisnaad).
Thecorrectviewisthatthehusbandcangobacktoherwithnoneedtorenewthemarriagecontract.

Ifthewomanisstillinheriddah(waitingperiod),hehasmoreright(thananyoneelse)tomarryher.Ifheriddahhasended,sheisfreetochoosewhethertogo
backtohimornot.
AlTirmidhisaid:
Onthebasisofthishadeeth,thescholarssaidthatifawomanbecomesMuslimbeforeherhusband,thenherhusbandbecomesMuslimwhilstsheisstillinher
iddah,thenthehusbandhasmorerighttoherwhilstsheisstillinheriddah.ThisistheviewofMaalikibnAnas,alOozaai,alShaafai,AhmadandIshaaq.
(SunanalTirmidhi,Hadeeth1142).
IbnAbdalBarrsaid:
There is no dispute among the scholars concerning the fact that if a nonMuslim woman becomes Muslim then her iddah ends, her husband has no rights
concerningherifhehasnotbecomeMuslimduringheriddah.

IbnalQayyimsaid:
ButwhattherulingoftheProphet(peaceandblessingsofAllaahbeuponhim)indicatesisthatthemarriagecomestoahalt.IfhebecomesMuslimbeforetheend
ofheriddah,thensheis(still)hiswife,butifheriddahends,thenshemaymarrywhomevershewants.Ifshelikes,shecanwaitforhim,andifhebecomesMuslim
sheishiswifeandthereisnoneedtorenewthemarriagecontract.

ItwasreportedthatAnassaid:AbuTalhahmarriedUmmSulaymandthemahr(dowry)betweenthemwasIslam.UmmSulaymbecameMuslimbeforeAbuTalhah.
Heproposedmarriagetoherandshesaid,IhavebecomeMuslim.IfyoubecomeMuslimIwillmarryyou.SohebecameMuslimandthatwasthemahrbetween
them.

ThedaughterofalWaleedibnalMagheerah,thewifeofSafwaanibnUmayyah,becameMuslimbeforehim,andthemarriagewasannulled.ThenhebecameMuslim
lateron,andshewentbacktohim.ItwasnarratedbyMaalikinalMuwatta,1132.IbnAbdalBarrsaid:Idonotknowofanyunbrokensaheehisnaadforthis
hadeeth,butitisfamousandwellknowntothescholarsofseerah,IbnShihaab,theleaderofthescholarsofseerah,andalShubi.Thefameofthishadeethis
strongerthanitsisnaadinshaAllaah.
