APPLICATION: Reopening; administrative closure
ORDER:
The respondent's motion to reopen and administratively close proceedings is granted. On
August 11, 2015, the Board dismissed her appeal. On the same day, the respondent filed an
unopposed motion to administratively close proceedings. The motion included a statement from
the Department of Homeland Security indicating that it did not oppose administrative closure.
Given the circumstances, the motion to reopen is granted; the Board's August 11, 2015, decision
is vacated; and the proceedings will be administratively closed pending a determination whether
the respondent may be eligible for and deserving of a favorable exercise of prosecutorial
discretion. The proceedings before the Board are administratively closed. Matter ofAvetisyan,
25 I&N Dec. 688 (BIA 2012).
If either party to this case objects to the continued administrative closure of these
proceedings, a written request to reinstate the proceedings may be made to the Board. The Board
will take no further action in the case unless a request is received from one of the parties. The
request must be submitted directly to the Board of Immigration Appeals Clerk's Office, without
fee, but with certification of service on the opposing party.
