INTRODUCTION
Consistent with Section 89 of the Nigerian Communications Act 2003 which mandates the
Commissiontomonitorallsignificantmattersrelatingtotheperformanceofalllicensedtelecoms
service providers, the Compliance Monitoring and Enforcement Department has developed
monitoringstrategiestoprosecutetheabovemandateandachievetheCommissionsobjectives
of fair competition, ethical market practices and optimal quality of service in the Nigerian
telecomsindustry.
ACTIVITIES
Thefollowingrepresenttheoutcomesandachievementsofthemajorcompliancemonitoring
andenforcementactivitiesinQuarter(3),2015
1. COMMISSIONSANCTIONSMOBILENETWORKOPERATORSFORSALESOFPREREGISTERED
SIMCARDS
The Commission sanctioned four (4) mobile network operators, namely MTN, Airtel,
GlobacomandEMTS(Etisalat)atotalsumofN40,000,000.00(FortyMillionNaira)forsales
ofpreregisteredSIMCards.Thebreakdownofthefeesisasfollows:
(i) MTN
:N21,800,000.00(TwentyOneMillion,EightHundredThousandNaira)
(ii) Airtel
:N3,800,000.00(ThreeMillion,EightHundredThousandNaira)
(iii) Globacom:N7,400,000.00(SevenMillion,FourHundredThousandNaira)
(iv) EMTS
:N7,000,000.00(SevenMillionNaira)
ThesanctionswereinaccordancewiththeprovisionsoftheNCCRegulationonTelephone
SubscribersRegistration,2011andtheoperatorshavesincepaidtheaboveamounts.
2. NOTICEOFSANCTIONTOMTNNIGERIACOMMUNICATIONSLIMITEDREGARDINGFAILURE
TODEACTIVATE402(FOURHUNDREDANDTWO)IMPROPERLYREGISTEREDMSISDN
TheCommissionhasfinedMTNNigeriaCommunicationsLimitedthesumofN80,400,000.00
(EightyMillion,FourHundredNaira)forfailuretodeactivateatotalof420(FourHundred
andTwo)MSISDNthatwereincompleteandimproperlyregistered.Thefinehasbeenpaid.
3. COMMISSION SEALS OFF SKANNET FOR OPERATING WITH EXPIRED INTERNET SERVICE
PROVIDER(ISP)LICENCE
Duringthequarter,theofficeofMessrsGeneralDataEngineeringServicesNigeriaLimited
(SKANNET) was sealed for operating with an expired ISP license and failure to fulfill its
financialobligationsinlinewiththetermsandconditionsofthelicence.
4. DIRECTIVETOWAKANOW.COMTODISCONTINUETHESALEOFGLOBALTRAVELSIM
TheCommissionssurveillanceandintelligencegatheringexerciserevealedunauthorizedsale
of Global Travel SIM Cards by Wakanow.com. Whereas our investigation confirmed that
Wakanow.comdidnothaveanyvalidtelecommunicationlicence,italsorevealedthatthe
SIMCardswerenotregisteredconsistenttotheprovisionsoftheNCCTelephoneRegulation
onSubscriberRegistration.
Arisingfromtheabovefindings,theCommissiondirectedWakanow.comasfollows:
I.
To immediately deactivate all Global Travel SIM Cards from being used within the
Nigeriantelecomspace;
II.
ToimmediatelysuspendthesaleofitsGlobalTravelSIMCardsuntiltheorganization
obtainsallnecessaryauthorizationsfromtheCommission.
Whereas the Wakanow.com had notified the Commission of its full compliance, the
Commission would continue to monitor the activities of the company to ensure that it
remainsinfullcompliancewiththeNCA2003andothersubsidiarylegislation.
Consequentlyandpursuanttosection53(1)oftheNCA2003,theCommissionon3rdAugust
2015directedallmobileserviceoperatorstocomplywiththefollowingdirections:
I.
Thatwhereasubscribersdatabundleaccountisfullydepletedbeforetheduedate,
serviceprovidersshouldnotifythesubscriberviaSMS,givinginformationregarding
thetariff/billingrateforautomaticmigration;
II.
Thatallserviceprovidersshouldhenceforthstopautomigrationofsubscribersdata
service to the PayAsYouGo (PAYG) account upon depletion of the data bundle
account,exceptwiththeexpressconsentandauthorizationofthesubscriberviaSMS.
AfollowupCompliancecheckbytheCommissionrevealedthefollowing:
a) Etisalatisincompliancewithdirection#1&direction#2oftheCommissions;
b) Globacomisincompliancewithdirection#1assubscribersreceiveSMSdetailingtariff
rateforautomigrationondepletionoftheirdatabundle.However,Globacomfailed
toobtainexpressconsentfromsubscribersbeforemigrationtoPAYGandtherefore
inviolationofdirection#2;
c) MTNisincompliancewithdirection#1butfailedtohighlightthetariffrateforPAYG
billing. In addition, data service is not suspended on depletion of the data bundle
accountevenwithoutanauthorizationviaanSMSfromthesubscriber.
d) Airtelisnotincompliancewiththeabovedirections;
Consequentupontheabove,theCommissionhasissuedanoticeofintentiontosanctionthe
concernedserviceproviders.
6. COMPLIANCEMONITORINGOFMOBILENUMBERPORTABILITY(MNP)

NOTE
Please note that as at the time of this report, the figures for September 2015 was being
compiled.
7. MOBILENUMBERPORTABILITY(MNP)SCHEME
Toaddresstheincreasingcasesofportrequestrejections,theCommissionhasresolvedto
monitorandsanctionviolationswithMNPprocesstimeobligations.Consequentuponthe
above, series of compliance checks were carried out regarding timer violations by Donor
operators with resepct tovalidation and deactivation responses which have timelines of
(Two)2hoursand1hourrespectively.
Thefollowingviolationswereobservedduringthequarter:
(a) TimerViolationsbyEtisalat
AtimerdeactivationviolationbyEtisalatregardingaCorporatePortrequestofover
63 lines belonging to Neoconde Energy Limited. The company had initiated a
corporateportoutrequestfromEtisalattoAirtelon7thAugust,2015at9.13ambut
waspartiallycompletedasat1.52pmonthesameday.Asaresult,thesesubscribers
wereunabletoreceivecallsfromEtisalatsnetwork.
(b) TimerViolationsbyMTN
AtimerdeactivationviolationbyMTNregardingaCorporatePortrequestofover109
linesbelongingtoNigerianBreweriesPlc.Thecompanyhadinitiatedacorporateport
outrequestfromMTNtoGlovialeadMSISDN:07036735494on11thAugust,2015at
1.20pmbutwaspartiallycompletedasat11.22amon14thAugust,2015.Asaresult,
thesesubscriberswerenotnotbeenabletoreceivecallsfromMTNSubscribers.
Inthesamevein,atimervalidationviolationsbyMTNregardingfour(4)individual
Port requests from MSISDNs: 08139382308, 08143810152, 08135485305 and
08162108093.MTNbreachedthetimeroftwo(2)hoursforvalidationoffour(4)port
requestsfromtheNPCasstatedintheMNPBusinessRules.
(c) TimerViolationsbyGlobacom
A timer validation violations by Glo regarding eleven (11) individual & one (1)
corporatePortrequests.Glohadbreachedthetwo(2)hoursallowableforvalidation
of six (6) port requests from the NPC as stated in the MNP Business Rules. Glo
validatedoneoftheseportrequestsovernine(9)hoursafterreceiptfromtheMNP
adminsitrator. Glo also breached the one (1) allowable hour for the Donor to
deactivateonehundredandfortyseven(147)PortedoutlinesbelongingtoReckitt
LimitedconsistentwithprovisionsoftheMNPBusinessRules.
Alltheabovetimerviolationsarecurrentlyundergoingenforcmentactions.
Etisalathasbeendirectedtorepatriatethelinesbacktothelegitimateoperatorwhilethe
caseiscurrentlyenforcementattention.
