Introduction

The UK's benefit payment systems do not systematically record the nationality of benefit
claimants, as nationality is not in and of itself a criterion of eligibility for benefits. Attempts to
obtain an official estimate of the total annual cost of welfare benefits issued to immigrants to
the UK or non-UK nationals have been unsuccessful for this reason.1
Consequently we do not have a complete picture of the number of migrants to the UK or
foreign nationals in the UK who receive UK social security benefits and tax credits, or the
cost of this. The main figures that are available are set out in this note.

DWP working-age benefits paid to migrants

The DWP has in recent years conducted a series of data-matching exercises which show the
number of claimants of DWP-administered working-age benefits (encompassing out-of-work,
disability, carer and bereavement benefits) who were non-UK-nationals when they first
registered for a UK National Insurance number (NINo). This is not the same as those who
are currently non-UK nationals, as some of these will have subsequently obtained British
nationality. Moreover, this measure does not capture foreign-born individuals who were
naturalised (obtained UK nationality) prior to NINo registration.
The most recent NINo-based analysis was published in August 2014:
NINo allocations to adult overseas nationals entering the UK: registrations to June 2014,
DWP, 28 August 2014.
The headline figures for all working-age DWP benefit claimants, broken down into broad
geographical groupings, are shown in table 1 (below).

As of February 2014, of the 5.3 million working-age claimants in the DWP benefit
client group, 7.4% (395,420) were non-UK nationals when they first registered for a
NINo.

Within this group, 130,990 claimants (2.5% of the total client group) were EU
nationals when they first registered for a NINo, and 264,430 claimants (5.0% of the
total) were non-EU nationals.

There were 67,270 claimants from the EU accession countries that joined the EU
from 2004 onwards these accounted for 1.3% of all claimants.

Table 2 shows a breakdown by benefit type. As of February 2014 11.7% of JSA claimants
were of non-UK origin (5.7% EU and 6.0% non-EU).
Table 3a shows the top 40 countries of origin for claimants of working-age benefits in
February 2014 who were non-UK nationals at point of NINo registration.

Child and Working Tax Credits

In addition to the DWP analyses of the working-age benefit caseload, HM Revenue and
Customs (HMRC) have produced data on the number of families in receipt of tax credits
where at least one adult in the family was a non-UK national at the point of registration for a
National Insurance number (NINo).
Based on a snapshot of the tax credit caseload as of March 2014, the figures show:

738,900 families containing an individual who was a non-UK national at the point of NINo
registration were in receipt of tax credits 15.9% of the total tax credit caseload of
4.6 million;

Within the non-UK category, more were from outside the EU (421,100 families) than from
within the EU (317,800 families);

As regards single recipients of tax credits, individuals from elsewhere in the EU


outnumber those from outside the EU. This is especially true in the case of single people
without children and in receipt of Working Tax Credit 11.2% of claimants in this
category were nationals of another EU member state at the point of NINo registration,
compared to 3.8% who were from outside the EU;

Among out-of-work couples receiving Child Tax Credit, 56,800 families (15.0% of the total
in the category) contained an individual who was a non-EU national at point of NINo
registration, while 19,100 (5.0%) contained an individual from another EU member state.2

HMRC have estimated the annual tax credits entitlements of families containing a non-UK
national at the point of NINo registration:

4.9 billion in 2012/13, or 16.6% of the total 29.6bn tax credits paid that year,3

5.2 billion in 2013/14,4 or 17.4% of the total 29.7bn.5

Of the 5.2 billion in 2013/14, 1.2 billion was paid to out-of-work families, 3.8 billion to inwork families with children and 0.2 billion to in-work claimants without children.6
Table 4a (below) sets out the March 2014 tax credit caseload broken down by tax credit
award type, singles/couples and world area of origin based on NINo registration.
Table 4b shows the equivalent data for the previous year (March 2013).
Both of these sets of figures were obtained from HMRC by means of Freedom of Information
requests placed by Michael OConnor (and Jonathan Portes of the NIESR).

Child Benefit

As of August 2012 Child Benefit was being paid to 990,000 families noted as a non-UK
national when they registered for a National Insurance number (NINo).7 This amounted to
12.5% of the 7.9 million families in receipt of Child Benefit in August 2012.8

UK family benefits for children resident elsewhere in the EEA

Under provisions in EU law on social security coordination within the European Economic
Area (EEA), Child Benefit and Child Tax Credit may be payable to EEA migrants in the
United Kingdom in respect of their dependent children resident in another Member State.
The provisions relating to payment of family benefits for children resident in another
Member State are in EC Regulation 883/2004.
Tables 5 and 6 show figures provided in response to Parliamentary Questions. These HMRC
figures do not record the nationality of the recipient, only the country where the children live,
so these figures may include Child Benefit awards paid to UK nationals with children living in
other EEA countries. These figures also include Switzerland, which is not in the EEA but is
covered by the same social security regulations.
The 20,400 families in receipt of Child benefit in respect of children living elsewhere in the
EEA in December 2013 accounted for around 0.3% of the total 7.55 million families receiving
Child Benefit.9

Asylum support

Asylum seekers i.e. persons waiting for a decision on an asylum application are not
entitled to mainstream means-tested social security benefits. Instead, they may be eligible for
accommodation and/or financial support (asylum support) from the Home Office. Cash
support for asylum seekers is less generous than social security benefits and is administered
entirely separately from the mainstream social security system.10
The number of destitute asylum seekers receiving subsistence cash support and/or
temporary accommodation from the UK Border Agency under section 95 of the Immigration
and Asylum Act 1999 is shown below:
