TRUE GOVERNMENT: THE CASE FOR REPEALING THE HEALTH CARE BILL

For any law to be “constitutional”—it must first and foremost enjoy the support and consent of a majority of the governed,
from which all U.S. government powers are derived. Obama’s seizure of one-sixth of the US economy via the Health Care
industry grab, does NOT enjoy the consent of the governed and on this basis alone, it is an unconstitutional law. It is for this
reason that my partner and I come resolved: That the United States federal government should significantly reform its
environmental policy.

OBSERVATION 1: Definitions and Overview


United States Federal Government: “Federal Government means all entities of the Government of the United States” - US
Code of Federal Regulations, Title 5, Chapter 1, Part 531, Sub- part b, 531.203 – Definitions

Significance: “Full of meaning or import; highly expressive or suggestive”- Oxford English Dictionary Second Edition 1989[Ethos]

Reform – “To convert, bring back, or restore (a thing or person) to the original form or state, or to a previous condition”–

GOAL: The affirmative team will be presenting a goals case with the goal of proper rule of government, a “government of the

1. The Constitution Violated

1. It must be within the limited federal powers enumerated in the Constitution


2. It must enjoy the support of the vast majority of “the governed,” from which all federal powers are derived
3. It must not infringe upon the individual rights of any citizen
4. It must not infringe upon the rights of any state, protected by the Tenth Amendment
5. It must become law by way of legal legitimate legislative process

Obama’s Health Care treachery violates all five of these standards and as a result, it cannot be allowed to stand. This is
about much more than health care. This is about a government allegedly of, by and for the people. A government which
acts against its people cannot be a government of, by and for the people. That government is beyond broken - it is
“unconstitutional” at its core.

2. Tax Increase

The historic overhaul of the nation's health care system that President Obama signed Tuesday, when combined with the fixes

2 Health Care Bill Repeal


OBSERVATION 4: We offer The Plan
The United States Fedral Government will enact and enforce our mandates.
Mandates:
1. H.R.3590: “Patient Protection and Affordable Care Act” also known as “Health Care Bill” will be repealed
Funding: No funding shall be needed for the enactment of this plan, by repealing the trillion dollar health care bill we
will save money.
Timeline: This plan will take effect immediately upon an Affirmative ballot.
The affirmative team reserves the right to further explain this plan as needed throughout the round.

OBSERVATION 5: Plan Advocate: Free market offers better solutions


Jillian Rayfield, TPM LiveWire, Sen. Jim DeMint, released a statement on March 21, 2010 saying

"Unless this trillion-dollar assault on our freedoms is repealed, it will force Americans to purchase Washington-approved

than the will of the American people. Americans told Washington to keep its hands off their health care in opinion polls, at
public protests, and at the ballot box, but their pleas were ignored. If the President and Democrats were serious about true health care reform,
there were many free-market solutions we could have easily passed. Americans support commonsense reforms such as purchasing
coverage across state lines, stopping frivolous medical lawsuits, and giving the same tax breaks to Americans who don't get their insurance at work.

ADVANTAGE 3. Upholding True Government

Our government has become “destructive” towards the very fundamental purposes of the government, to secure the
unalienable individual right to Life, Liberty and the Pursuit of Happiness.

The Declaration of Independence states quote ” - whenever any Form of Government becomes destructive of these
ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation
on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety
and Happiness.”end quote

The people are not safe living under a government that operates with such little regard for the Law of this Land, the US
Constitution.

Affirmitive Case 3
The Obama administration has acted far beyond its limited powers, now is the time to stop this before it gets out of hand.
